First, the concept of legal rules

Legal rules, also known as legal norms, although all discussions and academic achievements in the legal field are generally around legal rules, people have different views on what legal rules are. This once again proves a principle: the more basic the concept, the greater the possibility of disagreement, and all theoretical achievements begin with different opinions on the basic concept and rigorous logical argumentation. Li Guilin wrote: "Legal norm is a special social norm, which is a behavior rule with strict logical structure, which is formulated or recognized by the state and guaranteed by the state's coercive force." Zheng believes: "In short, the rule of law is one of the basic elements of law, and it is a general provision in law that clearly gives legal meaning to a factual state." We believe that legal rules can be analyzed from the aspects of subject, object, way, content and function.

The so-called legal rules refer to the general provisions that legislators give legal meaning to social or natural facts with common provisions through written symbols and use them to specifically guide the rights and obligations of the subject. Here, the first thing we encounter is the nationality of legal rules, the main body of production of legal rules. As we all know, rules are everywhere in the material world and human society. Even those irregular material movements, scientists are still looking for its stipulation, such as the stipulation of antimatter. Similarly, even those weird social behaviors, sociologists are seeking and studying their prescriptive contents. However, the spontaneous existence of natural rules and social rules is not a legal rule in the pure legal sense (perhaps, in social law, spontaneous social rules with universal binding force can also be regarded as legal rules-the so-called folk spontaneous customary rules), legal paper "On Legal Rules". Therefore, legal rules exist consciously first.

However, many social rules exist consciously, such as discipline rules, village rules and regulations, company articles of association, cooperation agreements, etc., but they are not legal rules. On the contrary, in a society with a sound legal system, they must be regulated by legal rules. There is no problem of conscious existence of natural rules. Even in the case of "humanized nature", people still transform nature with the help of spontaneous natural rules themselves. However, natural rules can be transformed into people's behaviors, thus becoming social rules for people to "act according to natural rules". For example, infectious diseases are natural phenomena, but we can grasp the law of their occurrence and make it a social code of conduct for people to prevent this disease in the law on the prevention and control of infectious diseases. But even if such a rule becomes a legal rule, it must be handled by the subject (legislator) with power, because people can't be legislators of others or each other at will, otherwise it will be impossible to form a uniform order in people's communication behavior.

It can be seen that legal rules can only come from legislators in national laws. So, who is the legislator? Theoretically, although people can design it as a rational person, a wise person, a philosopher and so on. In the practice of human national law, they have only experienced three kinds of legislative subjects. One is the emperor's personal legislation represented by imperial power, so that "the former master is the law and the latter master is the law." Second, the main body of representative legislation, represented by parliament, is characterized by legislation indirectly expressing public opinion requirements.
