Regulations of Yunnan Province on Scenic Spots (202 1 Revision)

Chapter I General Provisions Article 1 In order to strengthen the management of scenic spots, effectively protect and rationally utilize scenic spots resources, these Regulations are formulated in accordance with the Regulations of the State Council on Scenic Spots and relevant laws and regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the planning, construction, protection, utilization, supervision and management of scenic spots within the administrative area of this province.

The term "scenic spots" as mentioned in these Regulations refers to areas with ornamental, cultural or scientific value, concentrated natural and cultural landscapes and beautiful environment approved by the State Council and the provincial people's government, which can be used for people to visit or carry out scientific and cultural activities. Article 3 The people's governments at or above the county level shall strengthen the leadership over the management of scenic spots, incorporate the protection and utilization of scenic spots into the national economic and social development plan, and ensure the funds needed for planning, protection and management by the finance at the same level. Article 4 The competent department of provincial scenic spots shall be responsible for the supervision and management of scenic spots in the whole province.

State (city), county (city, district) people's government to determine the competent department of scenic spots is responsible for the supervision and management of scenic spots within their respective administrative areas.

Other relevant departments of the people's governments at or above the county level, such as ecological environment, natural resources, housing and urban construction, water conservancy, culture and tourism, ethnic and religious affairs, shall be responsible for the relevant supervision and management of scenic spots in accordance with the prescribed division of responsibilities. Fifth scenic area management institutions established by the people's governments at or above the county level where scenic areas are located are responsible for the protection, utilization and unified management of scenic areas. Article 6 The people's governments at or above the county level shall organize a general survey of scenic resources within their respective administrative areas to determine their present situation, characteristics and values.

The competent department of provincial scenic spots is responsible for organizing the special investigation and evaluation of scenic resources in this province and guiding the declaration of scenic spots. Seventh to encourage all sectors of society to participate in the protection and utilization of scenic resources in accordance with the planning of scenic spots, and guide private capital to invest in the development and construction of scenic spots.

People's governments at all levels and scenic area management agencies shall take measures to protect the legitimate rights and interests of investors. Eighth people's governments at or above the county level shall commend or reward units and individuals that have made outstanding contributions in the protection and management of scenic spots. Chapter II Establishment, Planning and Construction Article 9 Scenic spots are divided into national scenic spots and provincial scenic spots, and their declaration and establishment shall be handled in accordance with the Regulations of the State Council on Scenic Spots and the relevant provisions of this province.

The delineation of scenic spots should be scientific and reasonable, taking into account the needs of local economic and social development and people's production and life. If it affects people's production and life or causes losses to people's property, it shall be reasonably solved or compensated in accordance with relevant regulations. Tenth scenic spots are divided into core scenic spots and other scenic spots.

Core scenic spots refer to natural and cultural scenic spots with important scientific, aesthetic or cultural values; Other scenic spots refer to areas outside the core scenic spots.

The specific scope of the core scenic spots and other scenic spots shall be delineated and set up by the scenic spot management agency according to the approved plan. Eleventh newly established scenic spots and nature reserves shall not overlap or cross; Where the established scenic spots and nature reserves overlap or cross, the planning of the scenic spots and nature reserves shall be coordinated with each other. Article 12 Where a people's government at or above the county level applies for revocation of a provincial-level scenic spot that has been approved for establishment, the competent department of the provincial-level scenic spot shall organize investigation, demonstration and evaluation, and if it is really necessary to revoke the provincial-level scenic spot, it shall be submitted to the provincial people's government for approval and announcement. Thirteenth national and provincial scenic spots overall planning and detailed planning in accordance with the "Regulations" of the State Council and the relevant provisions of the province to organize the preparation, consultation, evaluation, demonstration, approval and filing, and connected with the relevant statutory planning.

The planning and organizing organs of scenic spots should adopt fair competition methods such as bidding, and choose urban and rural planning units with corresponding qualification levels to undertake specific preparation work.

The competent department of provincial scenic spots may entrust relevant institutions to evaluate the planning of scenic spots, and carry out examination and approval or revision in accordance with relevant technical specifications and standards. Article 14 The people's governments of counties, townships and towns shall organize the compilation of overall town planning, township planning and village planning according to law, and those involving scenic spots shall meet the requirements of the overall planning of scenic spots. Before the above-mentioned planning is submitted for approval, the opinions of the management agencies of scenic spots shall be sought.

If the town master plan, township plan and village plan that have been compiled do not conform to the planning of scenic spots, they shall be revised and adjusted according to the planning of scenic spots. Fifteenth construction projects in scenic spots should conform to the approved planning of scenic spots.

It is forbidden for any unit or individual to carry out various construction activities before or in violation of the approved planning of scenic spots. Sixteenth in the scenic area can be built in line with the planning of scenic spots, and related to the protection and utilization of scenic resources, infrastructure, tourism facilities, cultural and sports facilities and other projects.

It is forbidden to set up or set up various development zones in scenic spots, and it is forbidden to build hotels, guest houses, nursing homes, training centers and other buildings and structures unrelated to the protection of scenic resources in core scenic spots; Has been completed, it should be in accordance with the planning of scenic spots, the deadline to move out.
