Protection Regulations of Dongjiang Lake National Wetland Park
The "Hunan Province Dongjiang Lake Water Environmental Protection Regulations" was adopted by the 26th meeting of the Standing Committee of the Ninth People's Congress of Hunan Province on November 30, 2001, and was announced on the same day. Since 2002 It will come into effect on March 1, 2020.
Chapter 1 General Provisions
Article 1 In order to strengthen the water environment protection of Dongjiang Lake and prevent water pollution, in accordance with the "Law of the People's Republic of China on the Prevention and Control of Water Pollution" and other relevant These regulations are formulated in accordance with laws and administrative regulations and in combination with the actual conditions of the Dongjiang Lake Basin.
Article 2: These regulations apply to the water environment protection of the Dongjiang Lake Basin under the jurisdiction of Zixing City, Rucheng County, Guidong County, and Yizhang County.
Dongjiang Lake as mentioned in these regulations refers to Dongjiang Reservoir and Xiaodongjiang Reservoir; Dongjiang Lake Basin as mentioned in these regulations refers to Dongjiang Lake and the area that collects water from Dongjiang Lake.
Article 3: The water environment protection of Dongjiang Lake should adhere to the principles of unified management and hierarchical responsibilities to achieve the rational development and sustainable utilization of water resources.
Article 4: The Provincial People’s Government shall strengthen its leadership over the water environment protection work in the Dongjiang Lake Basin. The Chenzhou Municipal People's Government is fully responsible for the water environment protection work in the Dongjiang Lake Basin. The people's governments of Zixing City, Rucheng County, Guidong County and Yizhang County are responsible for the protection of the water environment in the Dongjiang Lake Basin within their respective administrative regions.
The people's governments of the province, Chenzhou City, Zixing City, Rucheng County, Guidong County, and Yizhang County should incorporate the water environment protection work in the Dongjiang Lake Basin into the national economic and social development plan, and take measures to prevent water pollution measures.
The people's governments of Chenzhou City and Zixing City, Rucheng County, Guidong County, and Yizhang County shall report on the water environment protection situation of the Dongjiang Lake Basin within their respective administrative regions in accordance with the requirements of the Standing Committee of the People's Congress at the same level. .
Article 5: Units and individuals operating in the Dongjiang Lake Basin are obliged to protect the water environment and have the right to discourage, report and accuse behaviors that pollute the water environment in the Dongjiang Lake Basin.
Article 6: Units and individuals with outstanding achievements in scientific and technological research, advanced technology promotion, and protection management of water environment protection in the Dongjiang Lake Basin shall be commended and rewarded by relevant people's governments and departments.
Chapter 2 Delimitation and Protection Objectives of Protected Areas
Article 7 The water environment protection scope of the Dongjiang Lake Basin is divided into first-level protected areas, second-level protected areas and quasi-protected areas. .
Scope of the first-level protected area:
(1) The waters between the Xiaodongjiang Reservoir Dam and the Dongjiang Reservoir Dam.
(2) Between the Dongjiang Reservoir Dam and Tushita Rock Island, the south is bounded by the connection between the southern end of the ridgeline of Tushita Rock Island and the whetstone on the other side, and the north is bounded by the ridgeline of Tushita Rock Island The water area bounded by the connection between the northern end and Pier 1 of Dongjiang Timber Factory's logging yard.
(3) The waterward slope of the first ridgeline connected to the water surface of the waters mentioned in items (1) and (2) above.
(4) Tushita Rock Island.
The scope of the second-level protected area:
(1) The waters of Dongjiang Lake except the first-level protected area.
(2) The land area on the waterward slope of the first ridgeline connected to the water surface of Dongjiang Lake, except for the area delineated by the first-level protection zone.
The scope of quasi-protected areas: the area within the Dongjiang Lake Basin except the first- and second-level protected areas.
Article 8: Signs and boundary markers should be set up on the boundaries of first-level protected areas, and no unit or individual may destroy or move them without authorization.
Article 9 The goals of water environment protection in the Dongjiang Lake Basin are:
The water quality of the first-level protected area shall comply with the Class II standards in the national "Surface Water Environmental Quality Standards" and the "Living Life Standards". The first-level standard of "Drinking Water Source Water Quality Standard".
The water quality of the secondary protection zone should meet the Class III standards of the national "Surface Water Environmental Quality Standards" and the secondary standards of the "Drinking Water Source Water Quality Standards". The water quality of rivers in quasi-protected areas entering secondary protected areas should meet the Class III standards in the national "Surface Water Environmental Quality Standards".
Chapter 3 Protection Measures
Article 10 The following regulations must be observed in quasi-protected areas:
(1) No unit or individual may engage in indigenous law Arsenic refining, gold beneficiation, tungsten beneficiation and other indigenous mineral processing are not allowed to operate production projects that seriously pollute the environment that are expressly prohibited by the state and provinces; units and individuals without water pollution prevention and control measures are prohibited from engaging in electroplating, tanning, pulp and paper, chemical industry , printing and dyeing and production activities of radioactive items.
(2) It is prohibited to dump industrial waste, domestic garbage and other waste within the river management range.
(3) Direct or indirect discharge of industrial wastewater into waters must comply with national and provincial wastewater discharge standards.
(4) It is prohibited to poison fish or fry fish.
(5) Other behaviors that pollute water bodies are prohibited.
Article 11 In addition to complying with the provisions of Article 10 of these Regulations, the following provisions must also be observed in the second-level protected areas:
(1) It is prohibited to build new buildings, expand mining, Mineral processing, smelting and other construction projects that discharge pollutants into water bodies; construction projects for reconstruction must reduce the amount of pollutants discharged.
(2) It is prohibited to use fish medicine that is harmful to human body and highly toxic and high-residue pesticides.
(3) It is prohibited to build solid waste centralized storage and disposal facilities, places and domestic waste landfills.
(4) Facilities for treating domestic sewage should be built in market towns where township people’s governments are located and places where tourist service facilities are relatively concentrated; solid waste such as domestic garbage should be collected, transported and disposed of in a timely manner.
(5) When ships and vehicles carry oil or toxic goods, they must take measures to prevent overflow and leakage.
(6) Passenger and tourist ships must be equipped with storage facilities for garbage, feces and oily sewage, and terminal management units should be equipped with facilities for collecting and transferring garbage, feces and oily sewage.
Article 12: In first-level protected areas, in addition to complying with the provisions of Articles 10 and 11 of these Regulations, the following provisions must also be observed:
(1) New construction, expansion, and reconstruction of construction projects other than hydropower and water supply projects are prohibited.
(2) Camping, picnics and water sports activities are prohibited.
(3) It is prohibited to set up gas stations and service outlets such as water commerce and catering.
Article 13 Construction projects and facilities that have seriously polluted the water resources of Dongjiang Lake and have been built in the protected area shall be dealt with in accordance with the following provisions:
(1) Without relevant administrative management If approved by the department in accordance with the law, it will be closed or demolished.
(2) If it is approved by the relevant administrative department in accordance with the law, it shall be rectified within a time limit; if it still fails to meet the emission standards after being rectified within a time limit, it shall be closed or dismantled.
Article 14: Ships using gasoline and diesel as fuel operating in Dongjiang Lake must switch to electricity, liquefied gas and other clean energy sources within a time limit.
Article 15: Cage fish farming is prohibited in first-level protected areas; cage fish farming in second-level protected areas must be carried out in accordance with the scale and location approved by the relevant administrative departments.
Article 16 In protected areas, afforestation should be carried out, forest structure should be optimized, and ecological forestry should be constructed; deforestation and land reclamation are prohibited to prevent soil erosion.
It is prohibited to cut down trees in first-level protected areas; cutting down trees in other areas must be submitted for approval in accordance with relevant laws and regulations.
Article 17 The people’s governments of Chenzhou City and Zixing City, Rucheng County, Guidong County, and Yizhang County shall formulate preferential measures to encourage villagers in protected areas to protect the ecological environment and gradually return farmland to forests. , return grass, develop ecological agriculture, and prevent agricultural chemicals such as fertilizers and pesticides from polluting water bodies.
For villagers in first-level protected areas and villagers in second-level protected areas who are seriously lacking production resources, unified arrangements should be made for gradual relocation and proper resettlement.
Article 18 The tourism management department of the Chenzhou Municipal People’s Government shall formulate tourism plans based on the requirements for protecting the water environment of Dongjiang Lake.
Tour operators and tourists should abide by laws and regulations on protecting the water environment and must not pollute water bodies.
Article 19 Dongjiang hydropower, water supply and other enterprises shall support and cooperate with the water environment protection work of Dongjiang Lake.
Chapter 4 Supervision and Management
Article 20 The Provincial People’s Government shall oversee environmental protection, development planning, economy and trade, land and resources, construction, transportation, agriculture, forestry, water conservancy, industry and commerce, and tourism. Relevant administrative departments such as Dongjiang Lake and other relevant administrative departments should do a good job in protecting the water environment of Dongjiang Lake in accordance with their respective responsibilities.
Article 21 The Chenzhou Municipal People’s Government shall organize the people’s governments of Zixing City, Rucheng County, Guidong County, Yizhang County and relevant departments to prepare a water pollution prevention and control plan for the Dongjiang Lake Basin and submit it to the people of the province Implemented after government approval.
The overall plan and other plans of the Dongjiang Lake Scenic Area shall be revised and adjusted in accordance with the requirements of these regulations.
Article 22 The environmental protection administrative department of the Chenzhou Municipal People’s Government shall set up water quality monitoring sections at the city and county junctions of the main rivers flowing into Dongjiang Lake, conduct regular monitoring and evaluation, and make the evaluation The results are reported to the Chenzhou Municipal People's Government and announced to the public.
The people's governments of Zixing City, Rucheng County, Guidong County, and Yizhang County shall ensure that the outbound water quality reaches the prescribed standards; if it fails to meet the prescribed standards, the Chenzhou Municipal People's Government shall instruct them to find out the reasons and take measures. Measures and rectification within a time limit.
Article 23 The people’s governments of Chenzhou City and Zixing City, Rucheng County, Guidong County, and Yizhang County shall increase their investment in water environment protection in the Dongjiang Lake Basin year by year; their forestry administrative management The department raises forest ecological benefit subsidy funds in accordance with the methods for raising and using forest ecological benefit subsidy funds formulated by the national and provincial people's governments to provide subsidies for the protection of ecological public welfare forests in the Dongjiang Lake Basin.
The Chenzhou Municipal People’s Government shall take measures to organize the rational development and utilization of Dongjiang Lake water resources; with the approval of the Provincial People’s Government, a certain proportion of the income from development and utilization operations shall be earmarked for the protection of the Dongjiang Lake water environment. and resettlement compensation.
Chapter 5 Legal Responsibilities
Article 24 Anyone who violates the provisions of Article 8 of these Regulations by destroying or moving without authorization the signs and boundary markers on the boundary line of the first-level protected area shall be punished by The environmental protection department of the people's government at or above the county level shall order corrections and compensation for losses.
Article 25 If a prohibited construction project is launched in violation of the provisions of Article 10 (1) of these Regulations, the local people's government at or above the county level shall order its closure; if it causes a pollution accident, it shall be punished in accordance with the "China Penalty shall be imposed in Article 43 of the Implementing Rules of the People's Republic of China's Water Pollution Prevention and Control Law.
Those who violate the provisions of Article 10 (2) of these Regulations shall be punished in accordance with the provisions of Article 39 (4) of the "Detailed Implementation Rules of the Water Pollution Prevention and Control Law of the People's Republic of China" .
Article 26 Those who violate the provisions of Article 11 (5) of these Regulations shall be ordered to improve facilities; those who cause water pollution accidents shall be punished in accordance with the "Water Pollution Prevention and Control Law of the People's Republic of China and the People's Republic of China" Penalty shall be imposed according to Article 43 of the Implementing Rules.
Anyone who violates the provisions of Article 11 (6) of these Regulations and fails to set up storage facilities for garbage, feces, and oily sewage shall be ordered to make corrections; anyone who dumps ship garbage into water bodies shall be punished in accordance with the "People's Liberation Army of China" The penalties are stipulated in Article 39 (5) of the Implementing Rules of the National Water Pollution Prevention and Control Law.
Article 27 Anyone who violates any of the provisions of Article 12 (1), (2) or (3) of these Regulations shall be ordered to close, dismantle or ban by the people's government at or above the county level.
Article 28 Anyone who violates other laws and regulations in a protected area shall be dealt with by the relevant departments of the people's government at or above the county level in accordance with the provisions of relevant laws and regulations.
Article 29: Anyone who refuses or obstructs state agency staff from performing their duties in protected areas in accordance with the law shall be punished in accordance with the "Regulations of the People's Republic of China on Public Security Administration Punishments"; if it constitutes a crime, he shall be punished in accordance with the law. Be held criminally responsible.
Article 30 In the water environment protection of the Dongjiang Lake Basin, if state agency staff neglect their duties, abuse their power, or practice favoritism for personal gain, they shall be given administrative sanctions by their unit or the superior authority; if it constitutes a crime, Investigate criminal liability in accordance with the law.
Chapter 6 Supplementary Provisions
Article 31 These Regulations shall come into effect on March 1, 2002.
