Measures for the administration of land use in Dalian Jinshitan National Tourism Resort

Article 1 These Measures are formulated in accordance with the Land Administration Law of the People's Republic of China, the Provisional Regulations of the People's Republic of China on Assignment and Transfer of Urban State-owned Land Use Rights and other relevant provisions in order to strengthen the land use management of Dalian Jinshitan National Tourism Resort and rationally develop and utilize land resources. Article 2 The land in Dalian Jinshitan National Tourism Resort (hereinafter referred to as the resort) shall be uniformly managed by Dalian Jinshitan National Tourism Resort Management Committee (hereinafter referred to as the resort management committee) according to law.

No unit or individual may occupy or illegally transfer the land in the resort, and may not change or destroy the topography, landforms and natural resources in the resort without authorization. Article 3 The system of paid and regular use of state-owned land in the resort area shall be implemented. China people, companies, enterprises, other organizations and individuals at home and abroad (except as otherwise provided by law) can obtain the land use right in the resort through land transfer and paid allocation.

Land users who have obtained land use rights must abide by the laws, regulations and relevant provisions of China, and their legitimate rights and interests are protected by the laws of China. Article 4 The transfer of the land use right of the resort shall be organized and implemented by the administrative committee of the resort in accordance with the Administrative Measures for the Transfer and Transfer of the State-owned Land Use Right of Dalian, and the land management department of the resort and the land user shall sign a land use right transfer contract as the transferor.

Land users should pay a deposit of 20% of the transfer amount when signing the contract, and pay all the transfer fees within 60 days from the date of signing the contract. After the land user pays all the transfer fees, he can register the land use right, get the land use certificate and obtain the land use right, and pay the land use fee every year according to the contract. Article 5 Units and individuals applying for paid allocation of land in resorts shall, on the strength of the approval documents and relevant materials for the establishment of resorts, go through the land use procedures with the land management department of resorts, sign land use contracts, obtain land use certificates and obtain land use rights. Article 6 If the land use right is obtained by paid allocation, the land user shall pay the land purchase fee and development supporting fee in one lump sum according to the land use contract, and pay the land fee annually.

The administrative committee of the resort shall promptly announce the land charging standards within the region, and make adjustments according to the economic development of the resort and the changes in environmental conditions, and the adjustment interval shall not be less than three years. During the term of the land use contract, land users shall pay land fees according to the new standards from the year of adjustment. Seventh land users who have obtained the right to use land must break ground within the time limit stipulated in the land use or land transfer contract. Overdue, the cancellation of land use permits, land acquisition fees, development supporting fees or transfer fees paid will not be refunded. Eighth land users who have obtained the right to use the land shall not change the use and scope of the land without authorization, and shall go through the relevant procedures again when necessary. Article 9 Where the land use right is obtained by means of transfer, the land use right may be transferred, leased or mortgaged according to law, and shall be registered according to regulations.

Failing to invest in the development and utilization of land according to the time limit and conditions stipulated in the land use right transfer contract, the land use right shall not be transferred or leased. Article 10 Where the land use right is obtained by paid allocation, the land use right shall not be transferred, leased or mortgaged. If it is really necessary to transfer, lease or mortgage, it shall be approved by the resort management Committee, sign a contract for the assignment of land use rights, and pay the transfer fee for land use rights. Article 11 If the land use right is obtained by means of transfer, the land use right and the ownership of buildings and other attachments on the ground shall be obtained free of charge by the resort management committee from the date of expiration of the land use right, and the land user shall return the land use certificate and go through the cancellation of registration in accordance with the regulations. Twelfth land use rights expire, land users need to renew, should be six months before the expiration of the application to the resort management committee, after approval, re sign the land use or transfer contract, pay the relevant fees, and go through the registration formalities.
