Chapter III Planning of Regulations on the Administration of Scenic Spots in Zhejiang Province

The basis of planning, protection, construction and management of scenic spots. The planning of scenic spots must follow the following principles:

(a) linked with the national economic and social development plan, and coordinated with the local regional land planning and urban planning;

(two) in accordance with the provisions of laws and regulations on the protection and utilization of scenic resources;

(three) pay attention to the protection of the complete features of natural landscape and the historical features of human landscape, and highlight the landscape characteristics of scenic spots;

(four) coordinate the relationship between protection and construction, short-term and long-term, local and overall, and make overall plans for various undertakings in scenic spots. The overall planning of scenic spots mainly includes: the nature and scope of scenic spots and their peripheral protection zones, the division of scenic spots, and functional zoning (including public tourist areas, residential areas, fire-forbidden areas, etc. ), environmental capacity and tourist scale prediction, tourism routes and sightseeing projects, environmental protection, greening, public infrastructure and tourist service facilities and other professional planning, recent development goals and major construction projects, as well as measures to implement the overall planning.

Detailed planning mainly includes: the nature, characteristics and scope of scenic spots, the protection scheme of scenic spots, the layout of infrastructure such as greening, sightseeing facilities and tourism service facilities, and the scheme design of important buildings. The planning of scenic spots shall be subject to grading examination and approval:

(a) the overall planning and detailed planning of scenic spots in cities and counties shall be examined and approved by the people's governments of cities and counties;

(two) the overall planning of provincial scenic spots, approved by the provincial people's government; Detailed planning, examination and approval by the provincial construction administrative department or its entrusted department;

(three) the overall planning of national scenic spots, after the audit by the provincial people's government, submitted to the State Council for approval; Detailed planning, examination and approval by the provincial construction administrative department.

After the detailed planning of national and provincial scenic spots is approved, it shall be copied to the relevant provincial administrative departments. The approved planning of scenic spots must be strictly implemented, and no unit or individual may change it without authorization.

In the process of planning and implementation of scenic spots, if the nature, development scale, overall layout, land use and functional zoning, planning period and other contents of scenic spots need to be significantly revised, they must be reported to the original examination and approval authority for examination and approval. Scenic spots must be built in strict accordance with the approved plan.

Before the detailed planning of scenic spots is approved, no permanent construction shall be carried out. Individual projects that really need to be built must go through feasibility analysis and technical demonstration, and be submitted for approval according to the detailed planning and approval authority of scenic spots. The site selection of major construction projects such as roads, ropeways, cable cars, large-scale cultural facilities, sports facilities and amusement facilities, hotel buildings and landmark buildings with signs of scenic spots in national scenic spots shall be proposed by the scenic spot management agencies and submitted to the municipal and county scenic spots authorities for review. In line with the planning requirements of scenic spots, it shall be reported to the Ministry of Construction for examination and approval according to the prescribed procedures, and go through the relevant procedures such as project establishment.

The site selection of other construction projects in national scenic spots and all construction projects in provincial scenic spots shall be proposed by the scenic spot management agencies and submitted to the municipal and scenic spot authorities for review. In line with the planning requirements of scenic spots, it shall be reported to the provincial construction administrative department or its entrusted department for examination and approval, and go through the relevant procedures such as project establishment.

The site selection of all construction projects in the city and county scenic spots is proposed by the scenic spot management agencies. If it meets the planning requirements of the scenic spots, it shall be reported to the competent department of the city and county scenic spots for examination and approval, and the relevant procedures such as project establishment shall be handled.

Where the site selection of construction projects in scenic spots requires the approval of relevant departments in accordance with laws and regulations, it shall be approved by relevant departments first. If a construction project in a scenic spot needs to apply for land after approval, the construction unit or individual shall apply for a planning permit for the construction land of the scenic spot to the competent department of the city or county scenic spot or its entrusted scenic spot management institution with the relevant approval documents. City and county scenic area departments or their entrusted scenic area management agencies shall verify the location and boundaries of land use according to the nature and scale of planned construction projects, and issue the "Planning Permit for Scenic Area Construction Land" according to the prescribed procedures.

After obtaining the planning permit for construction land in scenic spots, the construction unit or individual may apply for land to the land administration department of the people's government at or above the county level in accordance with the land examination and approval authority. Where the laws and regulations require the approval of the relevant departments, they shall be approved by the relevant departments first. The construction unit or individual shall, after handling the procedures of site selection, project establishment and land use approval, prepare the design scheme of the construction project, and carry out preliminary design and construction drawing design in accordance with the prescribed procedures and requirements.

After the design scheme, preliminary design and construction drawing design of the construction project are examined and approved by the competent department of city and county scenic spots or the scenic spot management agency entrusted by it, the planning permit for the construction project of scenic spots will be issued. However, the design scheme and preliminary design of important construction projects in national and provincial scenic spots identified by the provincial administrative department of construction shall be submitted to the provincial administrative department of construction for examination and approval by the administrative department of scenic spots in the city or county or its entrusted scenic spot management institution.

The construction unit or individual may apply for the commencement formalities only after obtaining the planning permit for the construction project of the scenic spot. Units undertaking the construction of scenic spots must have the construction qualification that meets the requirements of construction projects.

Construction in scenic spots must be civilized and safe, effective measures should be taken to protect topography, forest vegetation and water bodies, and the site should be cleaned up in time after the project is completed.
