Regulations of Liaoning Province on Lightning Disaster Prevention and Management (revised 20 18)

Article 1 In order to prevent and mitigate lightning disasters, safeguard national interests and the safety of people's lives and property, and promote economic construction and social development, these Provisions are formulated in accordance with the Meteorological Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of our province. Second in the administrative area of our province engaged in lightning disaster prevention work, must abide by these provisions. Where laws and regulations provide otherwise, such provisions shall prevail. Article 3 The competent meteorological departments of provinces, cities and counties (including county-level cities and districts, the same below), under the leadership of the competent meteorological department at a higher level and the people's government at the same level, are responsible for the organization and management of lightning disaster prevention, do a good job in lightning monitoring, forecasting and early warning, lightning disaster investigation and evaluation and lightning protection science popularization, divide lightning-prone areas and their armor class, and announce them to the public in time.

Flammable and explosive construction projects and places such as oil depots, gas depots, ammunition depots, chemical warehouses, fireworks, petrochemicals, buildings and facilities in mining areas, tourist attractions or prone areas where lightning protection devices need to be installed separately are put into use, and large-scale projects with high lightning risk and no lightning protection standards and specifications need special demonstration, the competent meteorological departments are responsible for the design review, completion acceptance permit and supervision and management of lightning protection devices.

The design review and acceptance of lightning protection devices for housing construction projects and municipal infrastructure projects shall be included in the construction drawing review and completion acceptance for the record, and the housing and urban-rural construction department shall be responsible for supervision and management.

All professional departments are responsible for the supervision and management of lightning protection for professional construction projects such as highways, waterways, railways, civil aviation, water conservancy, electric power, nuclear power and communications. Fourth people's governments at or above the county level shall organize relevant departments to formulate lightning disaster prevention plans and strengthen the construction of lightning disaster monitoring and early warning system. Article 5 People's governments at or above the county level shall encourage and support scientific and technological research on lightning disaster prevention, popularize advanced scientific and technological research results, and improve the level of lightning disaster prevention. Article 6 Meteorological offices and stations affiliated to competent meteorological departments at all levels shall strengthen the monitoring of lightning disasters and improve the accuracy and service level of lightning disaster prediction. Meteorological offices and stations subordinate to other relevant departments shall provide relevant information needed for lightning disaster monitoring and forecasting to the competent meteorological departments in a timely manner. Seventh the following places and facilities, must be installed in accordance with the relevant provisions of the state lightning protection device:

(a) the first, second and third types of lightning protection buildings specified in the code for lightning protection design of buildings;

(2) Places for the production, operation and storage of inflammable and explosive articles, dangerous chemicals and other dangerous articles;

(3) Electric power, radio and television, communication facilities and computer network systems;

(four) other places and facilities where lightning protection devices should be installed as stipulated by the state. Lightning protection devices must meet the use requirements stipulated by the competent meteorological department of the State Council. Eighth lightning protection device design review, construction supervision and completion acceptance, in accordance with the provisions of laws and administrative regulations. Ninth lightning protection devices put into use after the implementation of regular inspection system. Lightning protection devices should be tested once a year, and lightning protection devices in oil depots, gas depots, ammunition depots, chemical warehouses, fireworks and firecrackers, petrochemical and other places with explosion and fire hazards should be tested once every six months. Tenth units engaged in the detection of lightning protection devices must carry out detection work in accordance with the provisions of relevant laws, regulations, rules and technical standards and norms, and issue detection reports. The data in the test report shall be fair and accurate. The detection unit of lightning protection device shall be responsible for the detection results. Eleventh lightning protection device testing institutions shall issue a test report after the implementation of lightning protection device testing. Unqualified, put forward rectification opinions. If the detected unit refuses to rectify or fails to rectify within the time limit, the lightning protection device detection institution shall report to the local competent meteorological department, which shall handle it according to its duties or hand it over to other relevant departments for handling. Twelfth lightning protection device owner or trustee shall designate a person to be responsible for the daily maintenance of lightning protection devices. When there are hidden dangers in lightning protection devices, measures should be taken in time to deal with them.

Units or individuals that have installed lightning protection devices shall take the initiative to entrust lightning protection device testing institutions with corresponding qualifications to conduct regular testing.

For lightning protection devices of residential buildings, the real estate management department should do a good job in daily maintenance, and take the initiative to entrust a lightning protection device testing institution with corresponding qualifications to conduct regular testing. Thirteenth any unit or individual shall not move, change or damage the lightning protection device without authorization. Fourteenth lightning protection products must meet the quality standards stipulated by the state. It is forbidden to produce, sell and use unqualified lightning protection products. Fifteenth competent meteorological departments shall not in any way require the relevant units and individuals to buy their designated lightning protection products. Sixteenth competent meteorological departments should strengthen the investigation, statistics and identification of lightning disasters, and publish the results of statistical analysis to the society. Article 17 After a lightning disaster occurs, the person in charge of the affected unit shall immediately take effective measures to organize rescue, reduce casualties and property losses, and immediately and truthfully report to the local safety production supervision and management department and the competent meteorological department in accordance with relevant state regulations. No unit or individual may conceal, falsely report or delay reporting lightning disasters. Eighteenth competent meteorological departments and other relevant departments shall, in accordance with their duties, inspect the lightning disaster prevention work, and the units under inspection shall not refuse or obstruct it.
