Measures for the administration of tourist resorts in Zhejiang Province

Article 1 In order to strengthen the tourism management of resorts, rationally develop, utilize and protect tourism resources, speed up the construction of tourism facilities and promote the development of tourism, these Measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this province. Article 2 The term "tourist resort" as mentioned in these Measures refers to a tourist economic zone established with the approval of the people's government of the State Council and the province, which has clear geographical boundaries, meets the requirements of tourist vacation and can provide domestic and foreign tourists with high-quality comprehensive services such as vacation, leisure, sightseeing and entertainment. Article 3 According to the resource value, environmental quality, scale and other factors, tourist resorts are divided into provincial-level tourist resorts and national-level tourism.

Provincial tourist resorts are approved and announced by the provincial people's government, and national tourist resorts are approved and announced by the provincial people's government in the State Council. Article 4 The people's governments at or above the county level shall strengthen the leadership over the development and construction of tourist resorts, do a good job in organization and coordination, and create a good environment for the development and construction of tourist resorts. Article 5 The development and construction of tourist resorts shall adhere to the principles of unified planning, rational development, outstanding features, scientific management and strict protection, ensure the sustainable utilization of tourism resources, and realize the unification of economic, environmental and social benefits. Sixth tourism administrative departments of the people's governments at or above the county level shall be responsible for the supervision and management of the development, construction and business activities of tourist resorts.

The relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the supervision and management of the development, construction and business activities of tourist resorts. Article 7 The establishment of a tourist resort shall meet the following conditions:

(a) in line with the overall tourism development plan or development plan, the natural landscape, cultural landscape and other tourism and holiday resources in the region are rich and distinctive;

(two) clear geographical boundaries, in line with the overall land use planning, urban system planning and urban overall planning;

(3) Having obvious geographical advantages or other special advantages, and having public facilities such as transportation, communication, energy and water supply;

(4) There is no predictable threat of geological disasters such as mudslides and collapses;

(five) in line with the relevant provisions of the state on the protection of natural resources, historical and cultural heritage, and the environmental quality is good;

(six) other conditions stipulated by the people's Government of the State Council and the province. Article 8 To apply for the establishment of a tourist resort, the following documents and materials shall be submitted:

(a) an application for the establishment of a tourist resort;

(two) the feasibility study report of the tourist resort;

(three) the general situation of infrastructure construction and approved projects;

(four) regional environmental impact assessment report and approval documents;

(5) Other relevant documents and materials that should be submitted according to law. Article 9 For the newly-built provincial tourist resort, the municipal people's government with districts shall submit a written application, and the provincial tourism administrative department shall, jointly with the relevant departments of provincial planning, construction, environmental protection, land and resources, complete the examination within six months, and those who meet the requirements shall be submitted to the provincial people's government for examination and approval; Do not meet the conditions, be returned, and explain the reasons in writing.

The newly-built national tourist resort shall be approved by the provincial people's government and submitted to the State Council for approval. Article 10 The planning of tourist resorts shall be organized by the local counties (cities, districts) and municipal people's governments, reviewed by the relevant departments of tourism, planning, construction, environmental protection, land and resources of the province according to their respective functions and duties, and submitted to the provincial people's government for approval and implementation. Where there are other provisions in laws and regulations on the preparation and examination and approval of tourist resort planning, those provisions shall prevail. Eleventh approved tourist resort planning must be strictly implemented, and no unit or individual may change it without authorization.

During the implementation of the planning of tourist resorts, it is necessary to modify the planning of tourist resorts due to the adjustment of the overall layout, construction scale, land use nature and functional zoning, and major construction projects. , must be reported to the original examination and approval authority for approval. Twelfth development and construction of tourist resorts must go through the formalities for examination and approval of land use according to law. Involving the occupation of agricultural land, the approval procedures for the conversion of agricultural land must be handled.

(4) Ecological projects directly related to tourism.

Tourist resorts are prohibited from polluting the environment and projects explicitly prohibited by the state. Fourteenth tourist resorts are allowed to invest in the following projects after being approved according to law:

Duty-free shops and Sino-foreign joint ventures;
