Measures of Lanzhou Municipality on Tourism Management

Chapter I General Provisions Article 1 In order to rationally develop, utilize and protect tourism resources, safeguard the legitimate rights and interests of tourists and tour operators, and promote the sustained and stable development of tourism, these measures are formulated in accordance with the provisions of the Tourism Regulations of Gansu Province and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the development and construction of tourism resources, engaging in tourism management, participating in tourism activities and implementing tourism management within the administrative area of this Municipality.

Where there are provisions in laws and regulations, such provisions shall prevail. Article 3 The tourism administrative department of the Municipal People's Government shall be responsible for the supervision, management, guidance and service of the city's tourism industry.

County (District) tourism authorities shall be responsible for the supervision, management and service of tourism within their respective administrative areas.

The relevant administrative departments of cities and counties (districts) shall, in accordance with their respective responsibilities, do a good job in the development of tourism and the protection, development and utilization of tourism resources. Article 4 The development of tourism in cities and counties (districts) shall be incorporated into the national economic and social development plan, the construction of tourism infrastructure, supporting service facilities and tourist attractions (spots) shall be strengthened, the investment in key projects shall be increased, the tourism environment shall be continuously improved, and the development of tourism shall be promoted.

The people's governments of cities and counties (districts) should strengthen their leadership in tourism work, establish a joint conference system for tourism work, uniformly study and formulate the principles, policies and plans for tourism development and key tourism construction projects, and coordinate and solve major problems in tourism work.

Units and individuals that have made outstanding contributions and remarkable achievements in the development of tourism in their respective administrative areas shall be commended and rewarded. Fifth city and county (District) people's government to set up special funds for tourism development, included in the annual budget. Special funds for tourism development shall be implemented in accordance with relevant state regulations.

The Municipal People's Government encourages domestic and foreign enterprises, other organizations and individuals to invest in the tourism industry in accordance with the principle of "whoever invests benefits" to accelerate the development of tourism in this city.

Tourism authorities shall, jointly with relevant departments, provide relevant services for investors. Article 6 Tourism industry associations shall strengthen industry self-discipline, coordinate and guide members' business activities and related behaviors in accordance with their articles of association, safeguard the legitimate rights and interests of tourism operators and consumers, and assist relevant departments in the supervision and management of tourism business activities in this Municipality. Chapter II Planning and Construction Article 7 Tourism development shall be planned.

Tourism development planning shall be formulated by the municipal tourism administrative department in conjunction with relevant departments in accordance with the relevant provisions of special planning and implemented after approval by the Municipal People's government. Eighth tourist attractions (spots) should be based on the city's tourism development planning, the development of the scenic spots (spots) construction planning, reported to the municipal tourism authorities for the record. Ninth new construction, renovation and expansion of tourism projects and tourism facilities supporting construction projects, in accordance with the relevant provisions of the state. Tenth city and county (District) people's governments and relevant departments shall, according to the city's tourism development plan, strengthen the construction of road traffic, infrastructure, cultural activities and other places in tourist attractions (spots).

Special tourist vehicle parking stations (spots) should be set up in tourist attractions (spots) and famous restaurants, cultural activities places and shopping malls in urban built-up areas; If there is no parking station (point), special tourist vehicles are allowed to park temporarily nearby without affecting normal traffic. Eleventh Lanzhou Yellow River Scenic Area shall set up a tourist pier in accordance with the planning and construction; If there is no tourist wharf, the existing wharf shall ensure the berthing of tourist ships and provide convenient conditions for their tourism. Twelfth city and county (District) tourism authorities shall, jointly with relevant departments, optimize and integrate tourism resources within their respective administrative areas, develop and construct cultural tourism projects with cultural heritage, local characteristics and national characteristics, and enrich tourism activities. Chapter III Tourism Operators and Employees Article 13 Units and individuals engaged in tourism operation (hereinafter referred to as tourism operators) shall register according to law and obtain the qualification certificate for tourism operation before they can carry out business activities.

Engaged in rafting, rock climbing, bungee jumping and other special project tourism business activities, should be in the bid for tourism business qualification certificate, according to the law to the relevant departments to apply for special examination and approval procedures. Fourteenth travel agencies in the province to set up branches within the administrative area of this Municipality shall be subject to the examination and approval of the municipal tourism authorities.

Travel agencies from other provinces set up branches within the administrative area of this Municipality, which shall be audited by the municipal tourism authorities and approved by the provincial tourism authorities.

The establishment of tourism business branches shall be handled in accordance with the provisions of Article 13 of these Measures. Fifteenth travel agencies shall, in accordance with the relevant provisions of the state, pay the travel agency quality deposit to the local tourism authorities.

If the travel agency's fault infringes upon the legitimate rights and interests of tourists, and the travel agency needs to pay compensation or compensation, and the travel agency fails to pay compensation or compensation within the prescribed time limit, the competent tourism department may make advance payment from the travel agency's quality guarantee fund.

The collection, management, use and refund of the quality deposit of travel agencies shall be the responsibility of the tourism authorities, which shall be implemented in accordance with the relevant provisions of the state and published regularly every year. Sixteenth tour operators change their names, legal representatives, business premises, business projects, etc. , or closed down, changed jobs, closed down or terminated, it shall go through the formalities of change, registration and cancellation in accordance with the law, and report to the tourism authorities for the record within 15 days.
