Shanxi Province Road Transport Regulations

Chapter 1 General Provisions Article 1 In order to ensure the safety of road transportation and people's lives and property, protect the legitimate rights and interests of all parties involved in road transportation, and maintain the order of the road transportation market, in accordance with the "People's Republic of China and the National Highway Traffic Regulations" "Transportation Regulations" and relevant laws and regulations, and based on the actual conditions of this province, these regulations are formulated. Article 2 These Regulations shall apply to those engaged in road transportation operations, road transportation related businesses and road transportation management activities within the administrative region of this province.

The term road transport operations as mentioned in these regulations includes road passenger transport operations (hereinafter referred to as passenger transport operations) and road freight transport operations (hereinafter referred to as freight operations). Road transportation related businesses include road transportation stations (fields), motor vehicle maintenance, comprehensive motor vehicle performance testing, motor vehicle driver training, car rental, logistics services and other businesses. Article 3 People's governments at or above the county level shall adhere to the principle of coordinating the integration of urban and rural road transportation and develop road transportation.

Road transportation management should adhere to the principles of legality, openness, fairness, justice, efficiency and convenience.

Those engaged in road transportation operations and road transportation-related businesses must operate in accordance with the law, be honest and trustworthy, have fair competition, be safe and convenient, and be environmentally friendly and energy-saving. Article 4 People's governments at or above the county level shall formulate road transportation development plans in their respective administrative regions based on the needs of local economic and social development, and organize their implementation.

People's governments at or above the county level should take measures to support the development of rural passenger transport and logistics. Article 5 The transportation departments of the people's governments at or above the county level are responsible for organizing and leading the road transportation management work within their respective administrative regions.

Road transportation management agencies at or above the county level are responsible for the specific implementation of road transportation management work.

The development and reform, public security, finance, land, housing and urban and rural construction, planning, industry and commerce, environmental protection, safety supervision, quality supervision, tourism, price and other departments of the people's governments at or above the county level shall, in accordance with their respective statutory Responsibilities and do a good job in road transportation management related work. Article 6 The Provincial People's Government shall include road transportation management funds in the fiscal budget, unify the budget, manage them uniformly, and use special funds for special purposes.

The people's governments at or above the county level shall include the funds for the control of the sources of overloading and overloading in the fiscal budget of the same level. Article 7 Road transport operators are encouraged to implement large-scale and intensive operations.

Encourage the development of drop-and-pull cargo transportation, and encourage the use of containers, closed van transportation and other methods for road cargo transportation. Chapter 2 Road Transport Operations Section 1 General Provisions Article 8 A licensing system is implemented for road transport operations.

No unit or individual may forge, alter, transfer or rent the road transport business license. Article 9 The people's government of a city divided into districts shall establish a road transportation emergency support team to perform emergency road transportation tasks such as emergency rescue, disaster relief, and war preparation; it shall provide reasonable economic compensation to road transportation operators who undertake emergency road transportation tasks. Section 2 Passenger Transport Operations Article 10 Road transport management agencies at or above the county level shall publish the supply and demand status of the passenger transport market every six months. When there are major changes in the supply and demand situation, they shall announce it in a timely manner.

Road transportation management agencies at or above the county level can adopt the method of coordinated bidding for main lines and branch lines to open rural passenger lines in remote areas. Article 11 If a passenger transport operator does not put into operation for more than 180 days from the date of obtaining the operating license, or if it suspends operations for more than 180 consecutive days after operation, it shall be deemed to have automatically terminated its operations, and the original licensing authority shall Cancel its business license.

After obtaining the operating license, the passenger transport operator of the line shall provide continuous transportation services and shall not suspend, terminate or transfer them without authorization. Article 12: Line passenger transport that meets the requirements for safe operation can, with the approval of the original licensing authority, operate in a public transport mode and enjoy the same preferential policies as urban public transport passenger transport. Article 13 Chartered passenger transport operators shall sign a chartered vehicle contract with the charterer and carry it with the vehicle. They may not operate on fixed routes or at fixed points, or solicit passengers other than those under the chartered vehicle contract. Article 14 The tourist passenger transport operator shall sign a tourist charter contract with the tourist charterer and carry it with the vehicle. Section 3 Freight Operations Article 15 Freight operators shall not transport goods prohibited by laws and administrative regulations.

When freight operators accept goods that are restricted or certificated by laws and administrative regulations, they should check and confirm that the relevant procedures are complete and valid before transporting them. Article 16 Freight operators shall take effective measures to prevent cargo from scattering, raising dust, and leaking. Article 17 Freight operators transporting large objects shall formulate road transport plans. If transport exceeds the limit, relevant procedures shall be handled in accordance with relevant national regulations.

Vehicles engaged in transporting large objects should be equipped with uniform signs and hoist flags in accordance with regulations; sign lights should be installed when driving at night and parking for rest. Article 18 The transportation administrative department of a districted city may entrust the road transportation management agency of a districted city to specifically organize the professional qualification examination and the issuance and management of professional qualification certificates for drivers, loading and unloading managers, and escorts engaged in the transportation of dangerous goods. . Chapter 3 Road Transport Related Businesses Section 1 Road Transport Stations (fields) Article 19 People’s governments at or above the county level shall incorporate the construction of road transport stations (fields) and logistics parks into local urban and rural planning and overall land use planning, and Provide support in terms of land, funds, etc.
