Provisions of Zhuhai Municipality on Tourism Management

Chapter I General Provisions Article 1 In order to strengthen the management of tourism, protect and rationally develop and utilize tourism resources, safeguard the legitimate rights and interests of tourists and tour operators, and promote the development of tourism, these Provisions are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 "Tourism" as mentioned in these Provisions refers to the industry that attracts and receives tourists by using tourism resources and tourism service facilities, and provides services such as sightseeing, transportation, accommodation, catering, shopping, culture and entertainment for tourists. Article 3 All units and individuals that develop and construct tourism resources, engage in tourism management and participate in tourism activities within the administrative area of this Municipality shall abide by these Provisions. Article 4 The tourism administration department of the people's governments of cities and counties (districts) is the competent tourism department (hereinafter referred to as the competent tourism department), which is responsible for the overall planning, macro-control, comprehensive coordination, supervision and inspection of the tourism industry.

The relevant government departments shall perform their respective duties according to law, and support and cooperate with the tourism authorities to do a good job in tourism management. Fifth city and county (District) people's governments should increase investment in tourism, strengthen the construction of tourism infrastructure, and take measures to promote the coordinated development of tourism and related industries.

The Municipal People's Government shall establish a coordination system for tourism development and regularly convene relevant departments to coordinate major issues in tourism development. Article 6 The development of tourism should adhere to the unity of social benefits, economic benefits and environmental benefits, highlight local characteristics, give play to the advantages of tourism resources, and create a civilized, orderly, clean and beautiful tourism environment. Seventh to encourage and support investment in tourism resources development and tourism management.

Encourage and support the development of tourism education, train tourism professionals and improve the quality and service quality of tourism professionals. Chapter II Protection and Development of Tourism Resources Article 8 The tourism resources mentioned in these Provisions refer to natural and cultural landscapes that can attract tourists, be developed and utilized for the development of tourism, and generate comprehensive economic and social benefits. Ninth city and county (District) tourism authorities are responsible for the survey and evaluation of tourism resources within their respective jurisdictions, and participate in the formulation of the overall plan for the protection and utilization of tourism resources.

The construction of tourist attractions, hotels, hotels, amusement parks (parks), large cruise ships, tourist ropeways and other tourist projects shall be submitted for approval in accordance with the relevant provisions after obtaining the written consent of the tourism authorities. Tenth development and utilization of tourism resources must adhere to the principles of environmental protection, unified planning, rational development and scientific management. Article 11 No unit or individual may, without authorization, develop tourism resources, destroy ecological balance, pollute the environment, or destroy natural landscape, cultural landscape and historical and cultural heritage. Chapter III Tourism Management Article 12 The term "tourism operators" as mentioned in these Provisions refers to legal persons, other organizations and individuals who specialize in or mainly engage in tourism management activities. Thirteenth engaged in the following tourism business, must apply to the tourism authorities:

(1) Travel agencies;

(2) hotels and hotel management companies;

(3) tourism;

(four) tourist attractions, artificial tourism projects;

(5) Tourism consultation;

(six) other tourism business as prescribed by laws and regulations.

The competent tourism department shall make a reply within fifteen days from the date of receiving the application in accordance with the management authority, and shall explain the reasons for disapproval. Fourteenth no unit or individual may engage in tourism business activities without a license, and may not transfer or transfer the travel agency business license in disguise. Fifteenth tour operators enjoy the following rights:

(1) Operating independently according to law;

(two) to establish or join the tourism industry association according to law;

(3) refusing illegal charges, fines and apportionment,

(4) Refusing to forcibly sell commodities or forcibly resettle personnel;

(5) refusing to be inspected by personnel without legal inspection certificates;

(six) to report and accuse the units or individuals that infringe upon their legitimate rights and interests;

(seven) other rights stipulated by laws and regulations. Sixteenth tour operators shall perform the following obligations:

(a) shall not engage in business inconsistent with its business scope;

(two) public service items and service standards, and shall not deceive and mislead tourists by advertising or other means; Strictly fulfill the service standards agreed in the contract, and shall not change or cancel the service items or lower the service standards without authorization except for force majeure;

(three) respect the right of tourists to choose their own goods and services, and shall not induce, pester or force tourists to buy tourist goods or accept services;

(4) It is not allowed to transfer business risks to tourists or impose business risks on tourists in the agreed form in the travel contract;

(five) accept the supervision and inspection of the tourism authorities on their service quality, tourism safety, service charges and other operating conditions, and submit tourism statistics and other materials in accordance with the provisions;

(six) to take safety measures to ensure the personal and property safety of tourists, inform tourists of possible dangers in the process of traveling in time, and take effective protective measures when the dangers occur;

(seven) operating in good faith and fair competition, and shall not disturb the order of the tourism market in any form. Article 17 The business premises of a travel agency must be hung with signs uniformly made by the tourism authorities.
