Chapter 1 General Provisions Article 1 In order to effectively protect and rationally utilize tourism resources, regulate the tourism market order, protect the legitimate rights and interests of tourists and tourism operators, and promote the high-quality development of the tourism industry, according to the "People's Republic of China ***China Tourism Law" and relevant laws and administrative regulations, combined with the actual conditions of this province, these regulations are formulated. Article 2 These Regulations shall apply to the preparation of tourism planning, protection and utilization of tourism resources, tourism operations and services, tourist activities, tourism safety and related management and supervision within the administrative region of this province.
If laws and administrative regulations have provisions on tourism activities and supervision and management, these provisions shall be followed. Article 3 The development of tourism industry shall adhere to the principles of combining government guidance with market operation, combining the protection of tourism resources with rational utilization, and unifying social benefits, economic benefits and ecological benefits, cultivating and strengthening market entities, developing characteristic tourism products, and developing tourism. New business formats and all-region tourism will promote regional cooperation, amplify the comprehensive effects of tourism, and promote the construction of a strong tourism province. Article 4 People's governments at or above the county level shall establish a comprehensive coordination mechanism for tourism to solve major problems in tourism development and promote the integrated development of tourism and other related industries. Article 5: The tourism administrative departments of the people's governments at or above the county level are responsible for the comprehensive coordination, industry guidance, supervision and management, and public services of the tourism industry within their respective administrative regions.
Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, jointly carry out the management and service of the tourism industry. Article 6 Tourism operators shall operate with integrity, compete fairly, assume social responsibilities, and provide tourists with safe, healthy, hygienic and convenient tourism services.
Encourage healthy, civilized and environmentally friendly tourism methods, encourage various social organizations to carry out tourism publicity and popularize tourism knowledge. Article 7 Tourism industry organizations should strengthen industry self-discipline, play the role of service, guidance, coordination and supervision, and safeguard the legitimate rights and interests of tourism operators, tourism practitioners and tourists. Chapter 2 Tourism Planning and Resource Protection and Utilization Article 8 People’s governments at or above the county level shall incorporate tourism development into national economic and social development plans.
The provincial people's government and the people's governments of cities (prefectures) and counties (cities, districts) with rich tourism resources should organize the preparation of tourism development plans in accordance with the requirements of the national economic and social development plans. When utilizing tourism resources that cross administrative regions and are suitable for overall utilization, a unified tourism development plan shall be prepared by the people's government at the higher level or negotiated by the relevant city (state), county (city, district) people's government.
Tourism development planning should include the overall requirements and development goals of tourism development, requirements and measures for the protection and utilization of tourism resources, as well as tourism product development, tourism service quality improvement, tourism culture construction, tourism image promotion, Requirements and promotion measures for the construction of tourism infrastructure and public service facilities.
People's governments at all levels should organize an evaluation of the implementation of the tourism development plan prepared by the government at the same level and announce it to the public. Article 9 The tourism department of the Provincial People's Government shall work with relevant departments to prepare the province's tourism development plan and submit it to the Provincial People's Government for approval and implementation.
The tourism authorities of the municipal (prefecture) and county (city, district) people's governments shall, based on the province's tourism development plan, work with relevant departments to prepare the tourism development plan for their respective administrative regions, and consult with the tourism authorities at the next level The opinions shall be submitted to the people's government at the corresponding level for approval and implementation.
The approved tourism development plan may not be changed without authorization; if changes are really necessary, the original approval authority must be reported for approval. Article 10 The people's governments at or above the county level shall formulate tourism development plans based on the overall national economic and social development plans of the region, and shall be connected with the plans for the protection and utilization of land space, ecological environment protection, and other natural resources, cultural relics and other human resources. .
According to the tourism development plan, people's governments at or above the county level can prepare special plans for the development and utilization of key tourism resources, and put forward special requirements for tourism projects, facilities and service functions in specific areas. Article 11 When the people's governments at or above the county level prepare territorial spatial planning and urban and rural planning, they shall fully consider the spatial layout and construction land requirements of relevant tourism projects and facilities. The planning and construction of transportation, communications, water supply, power supply, environmental protection and other infrastructure and public service facilities should take into account the needs of tourism development.
When formulating other relevant plans, people's governments at or above the county level shall take overall consideration of tourism functions and the development of tourism. Article 12 When using natural resources and cultural resources to carry out tourism activities, the natural features, historical features and national characteristics shall be maintained in accordance with the law, and cultural relics and historic sites shall be protected. The planning of new areas and the renovation of old areas in key tourist towns should coordinate the planning of tourism functions, reflect local cultural characteristics, and the architectural style should be coordinated with the surrounding environment. Article 13: Tourism construction projects that are newly built, renovated, or expanded using tourism resources shall comply with the tourism development plan, and environmental impact and social impact assessments shall be conducted in accordance with the law. Article 14 The construction of tourism facilities and the establishment of tourism projects must comply with relevant national and provincial regulations on energy conservation, emission reduction, and ecological protection. Encourage tourism operators to use new energy and new materials, create green and environmentally friendly enterprises, and develop eco-tourism products; encourage tourists to use low-carbon tourism methods to carry out green tourism and healthy tourism.
