The contents of the Interim Measures for the Administration of Tourism Standardization
Article 1 In order to strengthen the management of national tourism standardization, promote the construction of tourism standardization, and comprehensively improve the quality and management level of tourism services, these Measures are formulated in accordance with the Standardization Law of People's Republic of China (PRC) and the Regulations for the Implementation of the Standardization Law of People's Republic of China (PRC).
Article 2 Tourism standardization is the technical basis of tourism work and an important means to improve the overall efficiency of tourism and realize scientific management. Tourism standardization is an important part of the national standardization work, which is organized and implemented by the Standardization Department of the National Tourism Administration and guided by the standardization administrative department of the State Council.
Article 3 The main task of tourism standardization is to organize the formulation of national standards and industry standards related to tourism within the whole industry (hereinafter referred to as standards); Implement standards and conduct supervision and inspection; Guide and promote tourism enterprises to carry out standardization work; Promote the institutionalization and standardization of the tourism industry, and improve the safety guarantee ability, quality level and management level of the tourism industry.
Article 4 Tourism standardization is an important part of tourism management, and tourism administrative departments at all levels should strengthen management and bring it into the scope of industry management.
Article 5 Actively adopt international standards and advanced foreign standards, especially those of the International Organization for Standardization, the World Tourism Organization, developed tourism countries and specialized agencies, and actively integrate with the international community; Actively participate in international standardization activities, participate in the research and formulation of relevant international standards, and safeguard the interests of the country and the tourism industry.
Chapter II Organization and Management
Sixth tourism standardization work to implement the principle of unified leadership, division of responsibilities. Tourism administrative departments at all levels and tourism enterprises can set up tourism standardization management and working institutions, equipped with full-time and part-time staff, and strengthen organizational management.
Seventh National Tourism Administration Standardization Department unified leadership and management of the national tourism standardization work, its main responsibilities are:
(a) to implement the national standardization laws, regulations, guidelines and policies, formulate specific implementation measures for this industry, and organize their implementation;
(two) to organize the preparation and implementation of the national tourism standardization work plan;
(three) to organize the formulation, revision and review of national standards and industry standards related to tourism, and to be responsible for the approval, numbering, publication and filing of management standards;
(four) responsible for organizing and managing the publication and distribution of national standards and industry standards for the tourism industry;
(five) to organize the implementation or in conjunction with the relevant business management departments of the National Tourism Administration to implement the relevant standards, and to supervise and inspect the implementation;
(six) responsible for the daily work of the National Tourism Standardization Technical Committee;
(seven) to guide the work of local tourism administrative departments and tourism enterprises' tourism standardization management and working institutions;
(eight) to organize the professional training, assessment and qualification certification of national tourism standardization personnel;
(nine) to organize and participate in the meetings and activities of the National Professional Standardization Technical Committee;
(10) Organizing and participating in international standardization conferences and activities of relevant international organizations;
(eleven) the organization of the declaration of the results of tourism standardization and the recognition and reward of tourism standardization work.
Article 8 The business management department of the National Tourism Administration is responsible for the management of standard projects within its business scope, and its related responsibilities are:
(1) Organizing the formulation and revision of relevant standards according to the entrustment of the National Tourism Standards Committee and the standard project plan;
(two) according to the standard project implementation plan, organize the implementation of relevant standards, and carry out supervision and inspection.
Article 9 The National Tourism Standardization Technical Committee is responsible for the technical centralized management and standard interpretation of the national tourism standardization work, and its main responsibilities are:
(a) to carry out research on the basic theory of tourism standardization and put forward suggestions on the principles and policies of tourism standardization;
(two) to assist in organizing the formulation, revision and review of tourism standards, and to be responsible for organizing the formulation of tourism standard planning system;
(three) responsible for the review of tourism standards, responsible for the technical content of the standard; Make suggestions on mandatory standards or recommended standards;
(four) to be responsible for the analysis and research of the achievements of tourism standardization, and to investigate and analyze the implementation of standards;
(five) the organization of tourism standardization information exchange and consulting services;
(six) to carry out international exchanges and cooperation in tourism standardization and undertake the work related to international standardization.
Article 10 The tourism administrative departments of all provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for leading and managing the work of tourism standardization within their respective administrative areas, and their main responsibilities are:
(a) to implement the national standardization laws, regulations and regulations on the administration of tourism standardization, formulate measures for the administration of tourism standardization in this region, and organize their implementation;
(two) to formulate plans and plans for the standardization of tourism in this region, and organize their implementation;
(three) to undertake the formulation and revision of standard projects issued by the National Tourism Administration;
(four) according to the standard implementation plan, organize the implementation in this area, and carry out supervision and inspection;
(five) to guide the standardization of enterprises in the region and accept the standards of enterprises in the region for the record;
(six) to undertake other standardization work assigned by the National Tourism Administration.
Eleventh tourism enterprise standardization management institutions or working institutions responsible for the management of the enterprise standardization work, should do the following work:
(a) to implement the laws, regulations, guidelines and policies of the state and the tourism industry on standardization;
(two) the implementation of national standards and industry standards related to tourism;
(three) to formulate and implement enterprise standards that are stricter than national standards and industry standards;
(four) the implementation of supervision and inspection standards;
(five) to carry out standardization publicity and training activities, and organize the recognition and reward of the standardization achievements and standardization work of this enterprise.
Chapter III Formulation, Examination and Release of Standards
Twelfth standards formulated and revised by the tourism industry are divided into national standards, industry standards and enterprise standards, and there are no local standards.
Thirteenth tourism standards shall be formulated and revised in accordance with the following principles:
(a) to ensure the safety of tourism, improve the service quality and management level, and safeguard the legitimate rights and interests of tourism enterprises and tourists;
(two) is conducive to the rational use of tourism resources, protect the environment and achieve sustainable development; Popularize scientific and technological achievements, improve economic benefits, meet the needs of management, and achieve advanced technology, economic rationality, safety and reliability, and feasible operation;
(3) It is conducive to promoting foreign cooperation and international exchanges;
(four) industry standards and enterprise standards shall not conflict with national standards, enterprise standards shall not conflict with industry standards, and relevant standards shall be unified, coordinated and matched;
(five) to encourage the direct adoption of national standards and advanced foreign standards, and actively participate in the formulation of international standards;
(six) in line with the relevant policies of the state and the tourism industry, support and cooperate with the implementation of relevant laws and regulations;
(seven) actively play the role of scientific research institutions, institutions of higher learning, industry associations and academic groups.
Fourteenth according to the scope of management of tourism industry standards approved by the administrative department of standardization of the State Council, the following technical requirements that need to be unified and standardized in the whole country or within the scope of the tourism industry shall be formulated as national standards or industry standards:
(a) Basis, information and general standards of tourism;
(2) tourist signs and terminology standards;
(3) Standards for tourism infrastructure and project facilities;
(4) Quality standards for tourism services;
(5) Standards for tourism planning and resource investigation;
(6) Characteristic tourism products and quality standards;
(seven) standards for tourism safety, health, environmental protection and labor protection;
(eight) other standards stipulated by the tourism standard planning system.
Fifteenth tourism enterprises are encouraged to formulate enterprise standards for the technical requirements, management requirements and work requirements that need to be coordinated and unified in their operation, management and work.
Enterprise standards are the technical basis for enterprises to organize production, operation and management, which runs through the whole process of production, operation and management activities and is an important basis for promoting technological progress and strengthening modern management of enterprises.
Enterprise standards shall be approved, numbered and published by enterprises, and filed in accordance with relevant regulations.
Sixteenth tourism national standards and industry standards are divided into mandatory standards and recommended standards.
Standards for safeguarding human health and personal and property safety and standards that are mandatory by laws and regulations are mandatory standards, including:
(1) Standards to ensure the production, operation, management and labor safety of the tourism industry;
(2) Tourism planning and construction standards;
(3) Hygienic standards for public places, tourist restaurants and environmental protection standards;
(four) important tourism terms, symbols, codes, signs and text format standards.
Other tourism standards are recommended standards.
Article 17 The compilation of national standards and industry standards shall conform to the national standards of Standardization Guidelines (GB/T 1) and the industry standards of Tourism Standardization Guidelines, and the compilation of enterprise standards may also refer to the above standards.
Eighteenth national standards and industry standards, the revision of the project plan, by the National Tourism Standardization Technical Committee on a regular basis every year to the National Tourism Administration Standardization Department proposed the next year's standard system, revision of the project plan; After unified summary and overall coordination by the Standardization Department of the National Tourism Administration, the national standard plan project was submitted to the standardization administrative department of the State Council for examination and approval, and the industry standard plan project was submitted to the National Tourism Administration for examination and approval, and the annual national standards and industry standards were officially issued to revise the project plan and tasks.
Nineteenth national standards and industry standards revision project planning tasks by the National Tourism Standardization Technical Committee to determine the standard drafting unit issued, and is responsible for urging the standard drafting unit to complete on time as planned; The revision of major standards shall be organized and supervised by the Standardization Department of the National Tourism Administration.
Twentieth national standards and industry standards review, unified organization by the National Tourism Administration Standardization Department, the specific work undertaken by the National Tourism Standardization Technical Committee; The approval and release of national standards and industry standards shall be handled in accordance with the relevant provisions of the Measures for the Administration of National Standards and the Measures for the Administration of Industry Standards formulated by the administrative department of standardization in the State Council.
Twenty-first standards should be reviewed in time after implementation, and the National Tourism Standardization Technical Committee should be entrusted by the Standardization Department of the National Tourism Administration to organize the implementation according to relevant regulations. Confirmation, revision, revision or abolition of standards shall be reviewed, approved and promulgated by the Standardization Department of the National Tourism Administration in accordance with relevant regulations.
Chapter IV Implementation and Supervision of Standards
Twenty-second mandatory standards, once approved, all tourism enterprises must implement. All products and services provided in tourism production and operation activities must meet the standard requirements. It is forbidden to produce, sell and provide products and services that do not meet the requirements of safety, health and environmental protection.
Twenty-third recommended standards are policy standards recommended and promoted by the state, and all parties are encouraged to actively adopt them. When the recommendation standard is enforced by the National Tourism Administration or used as a contract basis, the recommendation standard should also be enforced within its effective scope.
Article 24 Standards must be formulated for the provision of products and services. Where there are no national standards and industry standards, enterprise standards shall be formulated. The development of new products and services must fully consider the requirements of standardization, and products and services that do not meet the requirements of standardization are not allowed to be provided to the society.
Twenty-fifth in the process of implementing standards must have the material and technical conditions, should be included in the unit construction, training, technical transformation plan.
Twenty-sixth problems found in the implementation of standards, should be promptly consulted to the standard interpretation unit, major issues should be promptly reported to the National Tourism Administration Standardization Department and related business management departments.
Twenty-seventh the implementation of national standards and industry standards must be approved by the National Tourism Administration. The tourism administrative departments of all provinces, autonomous regions and municipalities directly under the Central Government shall, in accordance with the unified arrangements of the National Tourism Administration and in light of local conditions, formulate specific implementation measures. The implementation of important standards should be reported to the National Tourism Administration in a timely manner.
Twenty-eighth tourism standardization management institutions at all levels shall, in accordance with the division of management responsibilities, supervise and inspect the implementation of standards. The National Tourism Standardization Technical Committee accepted the entrustment to assist the relevant competent departments to supervise and inspect the implementation of the standards.
Chapter V Standardization Fund
Article 29 The National Tourism Administration shall set up special funds for standardization, which shall be used for special purposes and jointly managed by the Finance Department of the National Tourism Administration and the Standardization Department. Special funds are used for the following aspects:
(a) to provide subsidies for the formulation and revision of national standards and industry standards for tourism;
(two) the standard review meeting fee and labor fee;
(three) the annual meeting of the National Tourism Standardization Technical Committee and related activities;
(four) to carry out standardization research, special conferences and international exchanges and other activities.
Thirtieth national standards for the formulation and revision of funds, according to the provisions of the national standard funds management, allocated by the administrative department of standardization of the State Council, the insufficient part by the National Tourism Administration to make up or negotiate with the standard drafting unit to solve.
Thirty-first industry standards formulation and revision funds, from the National Tourism Administration standardization special funds allocated, the insufficient part by the standard planning department to solve.
Article 32 The expenses for the formulation and revision of enterprise standards shall be settled by the enterprise itself and may be included in the operation and management costs.
Thirty-third provincial tourism standardization management institutions work funds by the relevant administrative funds and business funds.
Article 34 The working funds of the National Tourism Standardization Technical Committee shall be raised and used in accordance with the articles of association of the National Tourism Standardization Technical Committee, and the insufficient part shall be allocated by the standardization special funds of the National Tourism Administration.
Chapter VI Reward and Punishment
Thirty-fifth all kinds of tourism standards are scientific and technological achievements, and the standards with high technical level and remarkable achievements will be recommended and declared to the relevant departments for scientific and technological achievement awards.
Thirty-sixth tourism administrative departments at all levels and tourism enterprises shall commend and reward the collectives or individuals who have made important contributions in standardization work, as well as those who have been engaged in standardization work for a long time and made achievements.
Thirty-seventh enterprises in violation of standards or non-standard operation, resulting in adverse consequences and major accidents, shall be investigated for corresponding administrative, economic and legal responsibilities.
Thirty-eighth standardization staff due to dereliction of duty, resulting in adverse consequences and heavy losses, should be investigated for corresponding administrative responsibility, economic responsibility and legal responsibility.
Chapter VII Supplementary Provisions
Article 39 These Measures shall be interpreted by the National Tourism Administration.
Fortieth these Measures shall come into force as of the date of promulgation.
