Measures of Jilin Province on Tourism Management

Chapter I General Provisions Article 1 In order to promote the development of tourism in our province, protect and rationally develop and utilize tourism resources, and safeguard the legitimate rights and interests of tour operators and tourists, these measures are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this province. Article 2 These Measures shall apply to organizations and individuals engaged in tourism and related activities within the administrative region of this province. Article 3 Except as otherwise provided by national laws, any organization or individual at home and abroad may invest and develop tourism resources in this province, operate the tourism industry, and enjoy the preferential treatment stipulated by the state and this province. Article 4 The tourism administrative departments of the people's governments at or above the county level shall be in charge of the tourism work within their respective administrative areas.

Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, manage the tourism industry. Fifth organizations and individuals that have made remarkable achievements in the tourism industry shall be commended or rewarded by the people's governments at or above the county level or the tourism administrative departments in accordance with the relevant provisions. Chapter II Construction of Tourism Resources and Facilities Article 6 People's governments at all levels, tourism administrative departments and relevant departments shall take effective measures to rationally develop, utilize and protect tourism resources and facilities. Seventh new construction, renovation and expansion of tourist attractions, scenic spots, tourist star hotels and other supporting tourist facilities and projects, should follow the principle of environmental assessment first, then development and construction, and in accordance with the provisions of relevant laws, regulations and rules for approval. Eighth prohibit the construction of tourist attractions and scenic spots to promote feudal superstition. Ninth relevant departments shall, according to the tourism development plan, examine and approve the new construction, reconstruction and expansion of tourist attractions, scenic spots, tourist star hotels and their supporting facilities, make overall arrangements, and make rational layout to avoid blind construction and repeated construction. Article 10 An application for the establishment of a national tourist resort must be reviewed by the local people's government at or above the county level and submitted to the State Council for approval; An application for the establishment of a provincial-level tourist resort must be examined by the local people's government at or above the county level and submitted to the provincial government for approval. Chapter III Tourism Management Article 13 When a travel agency engages in domestic tourism business, it shall solicit the opinions of the tourism administrative department at or above the county level, apply to the provincial tourism administrative department, and obtain the Travel Agency Business License after examination and approval.

Travel agencies engaged in international tourism business shall solicit the opinions of the local tourism administrative departments at or above the county level, apply to the provincial tourism administrative departments, sign the examination opinions, and report to the the State Council tourism administrative department for examination and approval before conducting business activities.

The establishment of a Sino-foreign joint venture or cooperative travel agency shall go through the examination and approval procedures in accordance with state regulations. Fourteenth travel agencies approved the establishment, holding the "Travel Agency Business License" issued by the administrative department of tourism, to the administrative department for Industry and Commerce for business license, can start business. Fifteenth travel agencies should carry out business activities in accordance with the business scope approved by the Travel Agency Business License and business license. Sixteenth provincial travel agencies to set up unincorporated branches within the administrative region of this province shall apply to the provincial tourism administrative department, and after examination and approval, go through other relevant procedures in accordance with the relevant provisions of the state. Seventeenth without the approval of the tourism administrative department of the State Council, no unit or individual may engage in overseas tourism and border tourism business without authorization. Eighteenth personnel engaged in tour guide business, must have the qualification of tour guide, and obtain the "guide card" issued by the tourism administration department. Nineteenth tour guides engaged in tour guide business, should abide by professional ethics, show their certificates, wear a tour guide card, provide standardized services, and may not take advantage of their work to ask for or accept money or goods.

Tour operators shall not use or employ persons who are not qualified as tour guides and who have not obtained the Tour Guide Certificate to engage in tour guide business. Twentieth foreign-related tourist hotel star rating shall be handled in accordance with the relevant provisions of the state. Twenty-first tourism administrative departments shall handle the following matters in accordance with the conditions stipulated by the state and the province, and complete the handling of the qualified conditions within 30 days from the date of receiving the application from the parties; Do not meet the conditions, shall not be handled, and notify the applicant in writing:

(a) the signing opinions of tourism administrative examination and approval;

(2) Evaluating the star rating of foreign-related hotels. Twenty-second tourism administrative departments should establish and improve the tourism complaint system to protect the legitimate rights and interests of tourists.

Tourism operators should set up tourist complaint signs in a prominent position in the tourist business premises to facilitate tourists' complaints. Complaints against tourists shall be handled in a timely manner by the accepting unit, and a reply shall be made within 7 days from the date of receiving the complaint. Twenty-third tourism operators to carry out tourism business activities, should sign a tourism business contract according to law, travel agencies and tourists should sign a tourism service contract according to law, clear the rights and obligations of both parties. Twenty-fourth tourism operators engaged in tourism business activities, must meet the following requirements:

(a) abide by laws, regulations and rules, and shall not engage in activities inconsistent with its business scope;

(two) accept the supervision and inspection of the tourism administration department on its service quality, tourism safety and service charges;

(three) open service items, service price standards, reasonable fees;

(four) shall not set two kinds of service prices for Chinese and foreign tourists, and shall not deceive or mislead tourists;

(five) strictly fulfill the tourism service contract, and shall not change or cancel the service items and lower the service standards without authorization;

(six) respect the legitimate rights of minority tourists, and shall not refuse to serve minority tourists without reason;

(seven) respect the legitimate rights of ethnic minority tourists, and shall not refuse to serve ethnic minority tourists without reason;

(eight) the establishment of tourism safety management responsibility system, equipped with necessary safety facilities, to ensure the personal and property safety of tourists;

(9) Inform tourists of possible dangers in the process of traveling in time, and take effective protective measures in case of danger.
