Measures of Xiamen Municipality on the Administration of Water Tourism Passenger Transport

Article 1 In order to strengthen the management of water tourist passenger transport in this Municipality, protect the legitimate rights and interests of tourists and operators of water tourist passenger transport, and promote the development of water tourist passenger transport, these Measures are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on Waterway Transport Management and other relevant laws and regulations, combined with the actual situation of this Municipality. Second in the navigable waters under the jurisdiction of this Municipality, these Measures shall be applicable to the use of ships to carry passengers to engage in tourist passenger transport business activities. Article 3 The administrative department of Xiamen Port is the municipal water transport administrative department (hereinafter referred to as the competent department), which is in charge of water tourism and passenger transport in this Municipality and is responsible for organizing the implementation of these Measures. The waterway transport management institution to which it belongs shall be specifically responsible for the management of water tourism passenger transport in accordance with these Measures.

The relevant administrative departments of tourism, water conservancy, ocean, maritime affairs, public security and frontier defense shall, within the scope of their respective functions and duties, manage water tourism passenger transport. Article 4 The competent department shall, jointly with the development and reform and the relevant administrative departments, formulate the development plan of water tourism passenger transport in this Municipality, which shall be implemented after being approved by the Municipal People's Government.

The delineation of operating waters for water tourist passenger transport shall conform to the development plan of water tourist passenger transport in this Municipality. Article 5 The opening, alteration, increase or decrease of transport capacity and closure of water tourist passenger transport enterprises shall go through corresponding procedures in accordance with relevant state regulations. Article 6 A water tourist passenger ship shall engage in corresponding carrying services in accordance with the operating waters and routes approved according to law.

The term "water tourist passenger transport" as mentioned in these Measures includes:

(2) Passenger transport to transport tourists for leisure and entertainment in specific waters;

(3) Other ordinary tourist passenger transport. Article 7 Passenger ships whose airworthiness standards are lower than those in sheltered areas or whose ship age is more than 25 years shall not engage in special tourist passenger transport business. Article 8 Where a special tourist passenger ship needs to be added according to the development of the water tourist passenger transport market, the competent department shall formulate a new capacity plan and announce it to the public, and put it in by tender.

The tender documents for new special tourist passenger ships shall specify the requirements for ship type, ship age, ship facilities and special tourist passenger service quality. If a special tourist passenger ship is updated, it shall participate in the bidding for the new special tourist passenger ship; Those who have passed the quality assessment of special tourist passenger transport services in accordance with these Measures shall, under the same conditions, give priority to updating in accordance with the provisions of the tender documents.

The competent department may, according to the development of the water tourist passenger transport market, formulate a paid bidding scheme for special tourist passenger ships, which shall be implemented after being approved by the Municipal People's Government. Article 9 A water tourist passenger ship shall dock at the passenger terminal approved by the competent department, and sign a dock docking agreement with the passenger terminal with the validity period exceeding 1 year.

Ship flights engaged in water tourism passenger transport shall be reported to the waterway transport management institution for the record and announced to the public. Tenth ships engaged in special tourist passenger transport shall sign contracts with water tourist passenger transport service enterprises and implement unified management. Water tourist passenger service enterprises shall, in accordance with the principles of fairness, impartiality and openness, arrange and dispatch ships engaged in special tourist passenger transport in a "by ship, in order and on time" manner, realize "unified dispatch, unified electronic ticketing and unified settlement" and rationally allocate tourist passenger transport resources. Eleventh the determination and adjustment of the price of water tourism passenger transport shall be reported by the water tourism passenger transport enterprise to the price administrative department and the waterway transportation management institution for the record, and announced to the public 30 days in advance. Where laws and regulations provide otherwise, such provisions shall prevail.

Article 14 Water tourist passenger service enterprises such as passenger terminals and ticket outlets shall carry out business activities within the approved business scope, and shall not provide services such as passenger source stowage for illegally operated water tourist passenger ships, and shall not charge passengers for freight difference and other fees.

Water tourism passenger service enterprises shall announce the ship flight time, operating service charges and charging standards in their business premises. Fifteenth additional items such as cultural performances, teahouses, food and tobacco sales. , operated by water tourist passenger ships, shall be legally operated, and shall not be forced to buy or sell. Sixteenth water tourist passenger ships shall publish the name of the ship, the complaints telephone number of the ship operator and its competent department and the municipal tourism administration department in a prominent position in the cabin. Article 17 Water tourist passenger transport enterprises shall, in accordance with the provisions of relevant laws and regulations, ensure the seaworthiness of ships, equip them with safety facilities, formulate safety production systems and emergency rescue plans for major safety production accidents, establish and improve safety production management institutions, strengthen safety education and technical training for crew members, and ensure safety production.

Passenger ships engaged in special tourism shall be equipped with safety management personnel to be responsible for the safety inspection on board. Eighteenth passenger transport enterprises engaged in leisure and entertainment in the approved specific waters shall set up navigation signs in the operating waters, set up safety warning signs in eye-catching positions, and be equipped with lifeguards and special lifeboats for patrol.

Passenger transport enterprises engaged in special tourism shall abide by the relevant provisions on the administration of border security of coastal ships.
