Interim provisions on the administration of tour guides

Article 1 These Provisions are formulated in order to strengthen the unified management of tour guides throughout the country, improve the service quality of tour guides, protect the legitimate rights and interests of tourists and tour guides, and promote the healthy development of tourism. Article 2 The term "tour guide" as mentioned in these Provisions refers to the personnel who arrange sightseeing for tourists (including tour groups, the same below) and provide guidance, explanation and tourism services.

According to the different requirements of travelers, tour guides use foreign languages, Putonghua or dialects, and minority languages for guidance. Article 3 Tour guides are divided into full escort, local escort and fixed-point escort.

A full-time accompanying tour guide refers to a person appointed or employed by a travel agency (including a travel company, the same below) to provide tour guide services for travelers in provinces, autonomous regions and municipalities directly under the Central Government. Designated tour guide, refers to the provinces,

Passengers traveling in autonomous regions and municipalities directly under the central government, and personnel who provide full tour guide services.

A local accompanying tour guide refers to a person appointed or employed by a travel agency to provide tour guide services for travelers in provinces, autonomous regions and municipalities directly under the Central Government. Designated accompanying tour guide refers to the person appointed or employed by a travel agency to provide tour guide services for tourists at sightseeing spots or sightseeing spots. Article 4 The lawful rights and interests of tour guides are protected by state laws, and no unit or individual may illegally interfere with their work tasks. Article 5 The main duties of tour guides are:

(1) Accepting the tour guide tasks assigned by travel agencies, and arranging and organizing tourists to visit according to the reception plan;

(two) responsible for guiding, explaining and spreading China culture to tourists;

(three) to cooperate with and urge the relevant departments to arrange transportation and accommodation for travelers, and to protect the personal and property safety of travelers;

(four) reflect the opinions and demands of travelers, and assist in arranging meetings, seminars and other activities;

(5) Answering passengers' inquiries and helping to deal with problems encountered during the journey. Article 6 Tour guides shall meet the following conditions:

(a) must be a citizen of China, love the motherland, support the social system of property rights, abide by the law, abide by the professional ethics of tourism, and be enthusiastic about serving passengers;

(2) Having a high school education or above, and having the language expression ability to be competent for tour guides;

(three) familiar with the tourism business, the ability to organize the reception;

(4) Being healthy and able to meet the needs of work. Article 7 A person who meets the conditions listed in the preceding article may engage in tour guide work only after passing the examination and going through the registration formalities. Article 8 Graduates of institutions of higher learning assigned to travel agencies who meet the conditions listed in Article 6 of these Provisions may serve as internship tour guides. Practice for one year, and may become an official tour guide after passing the examination. Ninth according to the needs of the work, travel agencies can recruit amateur tour guides in the society. Those who meet the conditions listed in Article 6 of these Provisions shall hold relevant certificates and pass the examination before they can serve as amateur tour guides. Article 10 The examination for tour guides shall be led and deployed by the National Examination Committee approved by the National Tourism Administration, and organized and implemented by the examination committees approved by the tourism administrative departments of all provinces, autonomous regions and municipalities directly under the Central Government. Article 11 Those who pass the examination shall go through the registration formalities by the National Tourism Administration or the tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government, and be issued with a tour guide card. Twelfth travel agencies are mainly responsible for the daily management of tour guides:

(a) to carry out political and ideological, professional ethics, legal system and discipline education;

(2) Organizing professional training for tour guides;

(three) responsible for internal assessment and rewards and punishments;

(4) Handling passengers' opinions on tour guides. Thirteenth tourism administrative departments can send people to inspect the work of tour guides, and the inspected tour guides shall not refuse unreasonably.

When performing the task, the inspectors shall produce the inspection certificates of the tourism administration department. Fourteenth tour guides should wear a tour guide card and carry a tour guide card when performing their duties. Fifteenth tour guides conscientiously implement the provisions, excellent service quality in the work, and make great achievements, which shall be rewarded by the tourism administration department or the travel agency. Sixteenth tour guides who have one of the following acts shall be punished by the tourism administrative department:

(a) do not perform the duties stipulated in Article 5 of these Provisions, resulting in serious consequences, shall be given administrative sanctions according to the seriousness of the case, and may detain the tourist guide card and tourist guide card;

(two) in violation of the provisions of the provisions of article thirteenth, unreasonably refused to check, detain the tour guide card and tour guide card;

(3) In case of any of the above-mentioned two acts, the tourist guide certificate and certificate shall be revoked and the registration of the tourist guide certificate shall be revoked with the approval of the tourism administrative department of the province, autonomous region or municipality directly under the Central Government. Seventeenth illegal interference with tour guides to perform their duties, resulting in consequences, by the tourism administrative department in conjunction with the relevant departments to deal with. Relevant departments should cooperate and support. Eighteenth did not go through the examination and registration procedures, shall not serve as a tour guide. Those who carry out tour guide activities without authorization and collect tour guide fees shall be confiscated by the tourism administrative department and may be fined less than three times the illegal income.
