Interim Measures of the Guangzhou Municipal People's Government on the Management of Foreign Travel Agencies' Tourism Services in Guangzhou
Chapter 1 General Provisions Article 1 In order to promote the healthy development of tourism and strengthen the management of tourism offices of foreign travel agencies in Guangzhou, in accordance with the "Interim Regulations on the Management of Travel Agencies" promulgated by the State Council and the "Interim Regulations on the Management of Travel Agencies" promulgated by the National Tourism Administration The Measures for the Implementation of the Interim Regulations on the Management of Travel Agencies" and relevant provincial and municipal regulations are formulated based on the specific conditions of our city. Article 2: These measures apply to all foreign travel agencies located in Guangzhou (including counties under the city, the same applies below). Article 3 The tourism office of a foreign travel agency in Guangzhou (hereinafter referred to as the foreign tourism office) is a contact agency established by a foreign travel agency in Guangzhou to engage in non-profit tourism business related to the travel agency.
The name of the travel agency shall always be "×× Travel Agency (Travel Company) Liaison Station in Guangzhou". Article 4: Foreign tourism agencies shall accept the supervision and guidance of the Guangzhou Municipal Tourism Bureau. Chapter 2 Organization Establishment and Approval Procedures Article 5 The following conditions must be met to establish a foreign tourism agency in Guangzhou:
(1) A travel agency applying to establish a foreign tourism agency must be in compliance with the national and provincial regulations According to the government's regulations on the management of travel agencies, foreign travel agencies must be approved by the local tourism administrative department and have a business license issued by the industrial and commercial administrative department.
(2) The person in charge of the foreign tourism office must be a regular staff member of the travel agency, and no more than five other personnel may be included.
(3) Foreign tourism agencies must have fixed office space (including self-owned houses or houses with a lease of more than one year) and necessary communication equipment.
(4) Pay management fees in accordance with regulations (specific charging methods will be formulated separately). Article 6: Foreign tourism agencies must be reviewed and approved by the Guangzhou Municipal Tourism Bureau and issued a "License for Foreign Travel Agencies in Guangzhou" before they can start their work. Article 7 When a foreign travel agency establishes a tourism agency in Guangzhou, it shall follow the following procedures:
(1) The local travel agency shall submit an application signed by the legal representative to the Guangzhou Municipal Tourism Bureau.
(2) Fill out the "Application Registration Form for Foreign Travel Agencies to Open Tourism Offices in Guangzhou" and submit the following certificates and materials:
1. A travel agency business license issued by the local tourism administrative department and a business license issued by the industrial and commercial administrative department.
If a photocopy of the business license is provided, it must be stamped by the local Administration for Industry and Commerce.
2. The local tourism administrative department shall issue a certificate approving the establishment of a tourism office in Guangzhou.
3. The legal representative of the local travel agency signs the authorization letter for appointing the person in charge of the tourism office in Guangzhou and the resume of the person in charge. Article 8 Travel agencies from foreign countries and Hong Kong, Macao and Taiwan regions that establish tourism offices in Guangzhou shall comply with the relevant provisions of the "Opinions on the Establishment of Permanent Tourism Services by Foreign Enterprises in China" issued by the National Tourism Administration of the People's Republic of China and the People's Republic of China. After approval by the National Tourism Administration, within 30 days from the date of approval by the National Tourism Administration, apply to the Guangzhou Municipal Tourism Bureau to obtain the "License for Foreign Travel Agencies in Guangzhou Tourism Office" with the approval document, and apply to the Guangzhou Municipal Administration for Industry and Commerce The bureau can only start work after completing the industrial and commercial registration and other formalities. Chapter 3: Scope of Work of Foreign Tourism Agencies Article 9: Foreign tourism agencies within Guangdong Province can only handle transit reception in Guangzhou (that is, travel back to the local area via Guangzhou) or be responsible for the tour groups (persons) sponsored by the travel agency. Entrust travel agencies in Guangzhou area to handle Guangzhou tourism liaison work. Businesses that “do not travel back to the local area, only travel in Guangzhou or travel to other places via Guangzhou” are not allowed. Article 10: Foreign tourism agencies outside Guangdong Province can only carry out horizontal cooperation work with their own travel agencies and travel agencies in Guangzhou. If you need to organize a tour group (person) to travel to Guangzhou or need to recruit tour groups in Guangzhou, you must entrust a travel agency in the Guangzhou area to handle or cooperate with a travel agency in the Guangzhou area to book rooms, order meals, book planes, cars, ferry tickets, and tours and other travel receptions business. Article 11 Travel agencies from foreign countries and Hong Kong, Macao and Taiwan regions in Guangzhou shall engage in non-profit tourism liaison activities. Tour groups organized by them that travel to Guangzhou or transit through Guangzhou must entrust Legal travel agencies in Guangzhou handle tourism reception services (including booking rooms, meals, flights, cars, ferry tickets and tours). Article 12: Foreign tourism agencies in Guangdong Province must have clear signs and flags when picking up and returning local tourist groups (persons) in Guangzhou. The accompanying tour guide should hold a national tour guide certificate and wear a tour guide card. Article 13: Foreign tourism agencies shall provide various reports and information to the Guangzhou Municipal Tourism Bureau in a timely manner in accordance with regulations. Article 14 If the name of a foreign tourism agency is changed, the office is relocated, or the person in charge of the agency or staff is replaced, the change registration procedures must be completed at the Guangzhou Tourism Bureau within 15 days from the date of change; To cancel, the Guangzhou Municipal Tourism Bureau should be notified in writing twenty days before the cessation of work. After the relevant matters are cleared, the cancellation procedures should be completed with the original license and registration authority. Article 15: The "License for Foreign Travel Agencies in Guangzhou Tourism Services" held by foreign tourism agencies shall undergo an annual inspection every year.
