Regulations of Guizhou Province on Tourism Management

Chapter I General Provisions Article 1 In order to protect and rationally develop and utilize tourism resources, standardize the order of the tourism market, safeguard the legitimate rights and interests of tourists and tour operators, promote the development of tourism, and make it a pillar industry of the national economy of our province, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this province. Article 2 "Tourism" as mentioned in these Regulations refers to an industry that uses tourism resources and tourism service facilities to engage in tourism business activities and provide services such as transportation, sightseeing, catering, accommodation, shopping, culture and entertainment for tourists. Third within the administrative area of this province, the development and utilization of tourism resources, tourism investment, tourism management and tourism activities must abide by these regulations. Article 4 The people's governments at or above the county level shall strengthen their leadership over tourism, incorporate the development of tourism into the national economic and social development plan, increase tourism investment and tourism infrastructure construction, improve the tourism environment, strengthen tourism propaganda, open up the tourism market, support the development of tourism education, and organize the implementation. Article 5 The development of tourism should implement the unified planning of the whole province and adhere to the principle of integrating economic benefits, social benefits and ecological benefits. The tourism administrative department of the sixth provincial people's government is responsible for the industry management of the province's tourism industry. The tourism management department of the people's governments at or above the county level shall be responsible for the industry management of tourism within their respective administrative areas.

The departments specified in the preceding paragraph are collectively referred to as tourism management departments.

The relevant administrative departments of the people's governments at all levels shall, according to their respective responsibilities, cooperate with the tourism management departments to do a good job in tourism management. Chapter II Tourism Planning Article 7 The development of tourism resources should adhere to unified planning, rational development, supporting construction and scientific management to achieve sustainable utilization. Eighth provincial people's government is responsible for the preparation of the overall planning of tourism development, and organize the implementation.

The people's governments at or above the county level shall, according to the overall planning of the province's tourism development, formulate the tourism development planning of their respective administrative regions under the guidance of the provincial tourism administrative department.

The overall planning of tourism development should be connected with the national land planning, the overall urban planning and the professional planning of national scenic spots.

Other types of planning should consider the tourism function as a whole. Article 9 The construction of tourist star-rated hotels, scenic spots (spots) and large and medium-sized special tourist facilities shall conform to the tourism development plan, and shall be submitted for approval in accordance with relevant construction procedures after being approved by the tourism management departments at or above the state and city (region). Tenth areas rich in tourism resources, convenient transportation and suitable for relatively concentrated construction of tourism facilities can establish tourist resorts.

To apply for the establishment of a provincial or national tourist resort, it shall be examined and approved by the provincial tourism administrative department, and then submitted to the provincial people's government or the State Council for approval. Eleventh the development and utilization of tourism resources and the construction of tourism facilities must be coordinated with the surrounding ecological environment and human landscape, and laws and regulations on resources, environment, cultural relics protection and soil and water conservation must be strictly enforced. Do not pollute the environment and destroy the ecological balance.

It is forbidden to build landscapes that are harmful to people's physical and mental health. Chapter III Tourism Development Article 12 The provincial people's government shall establish a joint conference system for tourism work to coordinate and solve major problems in tourism work. Article 13 The provincial people's government shall arrange special funds for tourism development, which shall be included in the annual financial budget and increased year by year, and shall be earmarked for tourism promotion, public welfare tourism project construction and loan discount. Among them, the tourism promotion funds are arranged by the provincial tourism administrative department for the promotion work; The construction of public welfare tourism projects and the use of loan interest subsidies shall be handled in accordance with the overall planning and capital construction procedures of the province's tourism development. Fourteenth people's governments at or above the county level can arrange special funds for tourism development according to the needs of tourism development in this area. Fifteenth people's governments at all levels should provide preferential conditions to encourage domestic and foreign enterprises, organizations and individuals to invest in the development and utilization of tourism resources in this province, build tourism infrastructure and service facilities, and operate tourism. Sixteenth to encourage and support the development of characteristic tourism in ethnic minority areas and economically poor areas. Seventeenth to encourage and support the development of tourism commodities that reflect the unique natural scenery, ethnic customs and cultural landscape of this province. Eighteenth provincial tourism administrative departments to formulate and organize the implementation of the overall planning of international and domestic tourism market development, coordinate external publicity, organize major promotional activities, and guide the development of large-scale tourism activities and important tourism products in the province. Nineteenth organizations and individuals that have made contributions to the development of tourism shall be commended or rewarded by the people's governments at or above the county level. Chapter IV Tourism Management Article 20 The application, examination and approval, operation and management of travel agencies in the province, and the establishment of branches by travel agencies outside the province shall be handled in accordance with the Regulations of the State Council on the Administration of Travel Agencies. Tourism operators with the qualifications of tourist attractions (spots), transportation, catering, accommodation, shops, culture and entertainment, and tourism commodity production can apply for fixed-point operation, and can receive the tourism team only after the approval of the tourism management department at or above the state and city (region) and the award of fixed-point tourist signs.

Designated tourist units shall not transfer or transfer designated tourist resources and designated tourist signs in disguised form.

Travel agencies are not allowed to arrange reception for tourist teams in non-designated tourist units.

Tourism designated signs are uniformly issued by the provincial tourism administrative department.
