Chapter I General Provisions
Article 1 These Measures are formulated in accordance with relevant laws and regulations in order to strengthen the management of hot air balloon sports, ensure flight safety and promote the development of hot air balloon sports.
Article 2 These Measures shall apply to balloon training, competition, performance, leisure, publicity, exploration and other flight activities carried out in People's Republic of China (PRC).
The State General Administration of Sport entrusts the air sports Association of China (hereinafter referred to as CAAC) to manage the national hot air balloon movement.
Under the leadership of the sports administrative department of the local people's government, the Provincial Aviation Association is responsible for the management of hot air balloon sports in this area.
Chapter II Pilot's Driving License
Article 4 Anyone who flies a hot air balloon shall hold a driver's license. Hot air balloon driver's license is divided into flight student's license, private driver's license and commercial driver's license.
Article 5 Qualifications and procedures for applying for a hot air balloon driver's driving license:
(1) flight student certificate
1, at least 14 years old;
2. Have good moral quality;
3. Be able to read, speak and understand Chinese, and have no accent or stutter that will affect two-way radio calls;
4. Hold a valid medical certificate issued by the Civil Aviation Administration of China;
5. Complete the hot air balloon theory course and pass the exam;
6, the unit or individual responsible for training, apply to the China Airlines Association;
7. After passing the qualification examination of China Air Transport Association, the flight cadet certificate will be issued.
(2) Private driving licence
1, at least 16 years old;
2. Have good moral quality;
3. Be able to read, speak and understand Chinese, and have no accent or stutter that will affect two-way radio calls;
4. Have a junior high school education or above;
5. Hold a valid medical certificate issued by the Civil Aviation Administration of China;
6. Pass the theoretical written test and flight test prescribed by the private driver's license;
7. The flight time shall not be less than 16 hours;
8. Apply to CAAC through the training unit;
9, by the applicant to fill in the "civil aircraft pilot license examination report form";
10, after passing the examination, submitted to the Civil Aviation Administration for examination and approval.
(3) Commercial driving license
1, at least 18 years old;
2. Have good moral quality;
3. Be able to read, speak and understand Chinese, and have no accent or stutter that will affect two-way radio calls;
4. Have a high school education or above;
5. Hold a valid medical certificate issued by the Civil Aviation Administration of China;
6. After passing the theoretical written test and flight test stipulated in the commercial driver's license, it will be reviewed by the China Aviation Association and issued by the Civil Aviation Administration;
7. The flight time exceeds 35 hours.
Article 6 A driver's license and a medical certificate must be valid at the same time before flying activities can be carried out.
Article 7 The annual inspection of driver's license shall be submitted by the holder to the China Aviation Association, and shall be submitted to the General Administration of Civil Aviation for annual inspection after passing the theoretical and technical examination and physical examination. The commercial driver's license is inspected once every 65432+0/2 months, the private driver's license is inspected once every 24 months, and the physical examination is inspected once every 65432+0/2 months.
Chapter III Training, Competition and Performance
Article 8 An entity applying for hot air balloon training shall submit a written application to the China Aviation Association, and it can only be carried out after passing the examination.
Article 9 The examination and approval procedures for holding hot air balloon competitions and performances in China:
(a) the holding of national and international hot air balloon competitions and performances must be approved by the China Airlines Association and reported to the State Sports General Administration for approval, and sponsored by the China Airlines Association;
(two) the holding of local hot air balloon competitions and performances must be approved by the sports administrative department at or above the county level. If the activity scale is above 10 (including 10), it must be reported to CAAC for the record, and CAAC will send inspectors.
To hold a hot air balloon competition, the organizer must be the sports administrative department or its approved sports association or air sports Association.
Article 10 An organization or individual applying for holding a hot air balloon competition (hereinafter referred to as the applicant) shall meet the following conditions:
(1) Being able to bear civil liability independently;
(2) Having an organization and management personnel suitable for the scale of the competition;
(three) there are specific competition rules and competition organization implementation plan;
(four) have the ability to provide funds and equipment suitable for the scale of the competition;
(5) Having the venues and facilities required for the hot air balloon competition.
Article 11 The names of hot air balloon competitions and performances must be consistent with the actual contents. Balloon competitions without the approval of the sports administrative department of the State Council shall not be labeled as "World", "International", "Asia", "China", "National", "National" and "China".
Twelfth pilots to participate in competitions and performances, must meet the following conditions:
(a) must be a member of the China Airlines Association, and pay the membership fee on time, abide by the articles of association of the association;
(2) Holding a valid hot air balloon driver's license and physical examination certificate issued by the Civil Aviation Administration of China;
(three) must hold the E-class hot air balloon pilot certificate issued by the China Airlines Association;
(4) Holding effective life insurance during the activity.
Chapter IV Clubs
Thirteenth organizations that carry out hot air balloon sports can set up clubs. To start a hot air balloon club, the following conditions must be met:
(1) Having the articles of association of the club that comply with laws, regulations and relevant provisions of the state;
(2) Having a hot air balloon that meets the airworthiness conditions;
(3) Having more than one hot air balloon pilot with a driving license;
(4) Having corresponding hot air balloon flight site and guarantee conditions;
(5) Having flight airspace approved by the local air traffic control department;
(six) there is a corresponding funding guarantee.
Fourteenth units or individuals with all the conditions of Article 22 may apply to the local sports authorities at or above the county level, and after approval, go through the registration formalities with the local civil affairs or industrial and commercial administrative departments.
Fifteenth units and individuals that apply to start a club shall submit the following documents and materials to the local sports department:
(a) the application report signed by the person in charge of the club;
(2) The articles of association, organization and list of leading members of the club;
(3) the name and address of the club;
(four) the license for the use of the site and airspace;
(5) A valid driver's license for the hot air balloon driver;
(6) hot air balloon airworthiness certificate;
(seven) proof of the source of funds of the club.
Article 16 The sports administrative department shall complete the examination within 15 working days after accepting the application, give a written reply of approval or disapproval, and report it to the China Aviation Association for the record after approval.
Article 17 A club shall perform the following duties:
(a) to carry out hot air balloon sports in accordance with national laws, regulations and relevant provisions;
(two) accept the management, business guidance and business supervision of the local and superior sports authorities;
(three) actively participate in activities organized by air sports associations at all levels;
(four) to educate the flight personnel on aviation regulations and safety, so that they can abide by the flight regulations and ensure flight safety;
(five) to carry out the free flight mission, declare the flight plan according to the regulations, and strictly organize the implementation.
Chapter V Alien Flight
Eighteenth foreign (territory) flight personnel to participate in hot air balloon flight activities in China, must be reported to the General Staff Department for approval 60 days before the event. And perform the following approval procedures:
(1) At the invitation of China Airlines Association, or foreign air sports organizations or individuals apply to China Airlines Association, China Airlines Association shall report to the State Sports General Administration, which will jointly examine and approve the application.
At the invitation of provinces, autonomous regions and municipalities directly under the Central Government, or overseas air sports organizations or individuals apply to provinces, autonomous regions and municipalities directly under the Central Government, the sports administrative departments of provinces, autonomous regions and municipalities directly under the Central Government shall report to the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and relevant state departments for approval.
(2) When foreigners fly in China (including using aircraft for their own use), the organizer shall go through the declaration formalities in accordance with the relevant provisions of the state, and send a copy to the Civil Aviation Administration and relevant units.
(3) When foreign personnel use their own aircraft to fly into or out of China's territory and fly within China's territory, the organizer shall also go through the declaration formalities with the Civil Aviation Administration of China in accordance with the Flight Management Rules for Foreign Civil Aircraft and other relevant regulations.
Nineteenth foreign (territory) flight personnel to participate in hot air balloon flight activities in China, must meet the following requirements:
(1) Holding a valid driver's license (or sports license) of the country (region) and being recognized by China Air Transport Association;
(2) Holding a valid medical certificate;
(3) If a person holds a personal insurance certificate, the organizer or the flight crew shall also insure the equipment and third party liability insurance;
(4) If you bring your own hot air balloon to air sports, your airworthiness certificate must be approved by the designated representative group of the State Sports General Administration authorized by the Civil Aviation Administration, and the safety and reliability of its equipment shall be the responsibility of the user himself.
Twentieth foreign pilots in China to participate in hot air balloon flight activities, must abide by the relevant laws and regulations of People's Republic of China (PRC), without the approval of the General Staff Department, aerial photography is prohibited.
Chapter VI Flight Accidents
Twenty-first hot air balloon flight accident level with reference to the "civil aircraft flight accident level" implementation.
Twenty-second flight accidents, by the flight organization unit reported to the provincial sports association, the provincial sports association to investigate the accident, the investigation results reported to the China Airlines Association for the record.
Chapter VII Equipment Management
Article 23 The development, production and sales of hot air balloons must be reported to the China Aviation Association. When selling, you must hold the hot air balloon airworthiness certificate, product inspection certificate, product certificate and product use and maintenance manual approved by the designated representative group of the State Sports General Administration.
Article 24 To use imported hot air balloons in China, it is necessary to hold airworthiness certificates and inspection certificates issued by the States parties to the Convention on International Civil Aviation, and the model is approved by the airworthiness designated representative group of the State Sports General Administration.
Twenty-fifth domestic units and enterprises selling imported hot air balloon equipment must be registered by China Airlines Association before going through the industrial and commercial formalities.
Twenty-sixth hot air balloons used by all units must be reported to the designated representative group of the State Sports General Administration for review and registered with the Civil Aviation Administration. Unregistered hot air balloons are not allowed to fly.
Article 27 A hot air balloon carrying out a flight mission must have a valid airworthiness certificate and nationality registration certificate, and the registration number should be clearly printed on the equatorial plane of the sphere.
Chapter VIII Reward and Punishment
Twenty-eighth China Airlines Association shall reward the clubs and pilots who have made outstanding contributions to the development of hot air balloon sports.
Article 29 CAAC will, depending on the seriousness of the case, give a warning, make corrections within a time limit, suspend the flight for rectification, revoke the flight driver's license, and suggest banning the club.
Thirtieth without the approval and registration of the sports administrative department, the sports administrative department has the right to order it to stop.
Chapter IX Supplementary Provisions
Thirty-first manned light air vehicles such as helium balloons and airships shall be implemented with reference to these measures.
Thirty-second clubs established before the promulgation of these measures, which do not conform to the provisions of these measures, shall go through the examination and approval procedures according to these measures.
Article 33 These Measures shall come into force as of the date of promulgation.
