Shandong Province Scenic Area Regulations
Chapter 1 General Provisions Article 1 In order to strengthen the management of scenic spots and effectively protect and rationally utilize scenic spots resources, these regulations are formulated in accordance with the provisions of relevant laws and administrative regulations and in combination with the actual situation of this province. Article 2 These regulations shall apply to the establishment, planning, protection, utilization and management of scenic spots within the administrative region of this province.
The term “scenic spots” as mentioned in these Regulations refers to areas with ornamental, cultural or scientific value, relatively concentrated natural and cultural landscapes, beautiful environment, and where people can visit or conduct scientific and cultural activities.
The scenic spots are divided into national-level scenic spots and provincial-level scenic spots. Article 3 The work in scenic spots and historic areas shall follow the principles of scientific planning, unified management, strict protection, and sustainable utilization. Article 4 People's governments at or above the county level shall strengthen leadership over the work of scenic spots, coordinate and resolve major issues in the establishment, planning, protection, utilization and management of scenic spots, and include the funds required for the work of scenic spots into the fiscal budget of the same level.
The township (town) people's government and sub-district offices shall assist in the protection, utilization and management of scenic spots in accordance with their prescribed responsibilities. Article 5 The provincial housing and urban-rural development department is responsible for the supervision and management of scenic spots in the province.
The competent departments of housing and urban-rural development in cities and counties (cities, districts) divided into districts or the departments determined by the people's governments at or above the county level (hereinafter collectively referred to as the competent departments of scenic spots) are responsible for the supervision and management of scenic spots within their respective administrative regions. .
Departments of development and reform, finance, urban and rural planning, cultural relics, tourism, religion, public security, forestry, water conservancy, environmental protection, transportation, land and resources, ocean and fishery, price, industrial and commercial administration, urban management and law enforcement, etc. In accordance with their respective responsibilities, they will work together to manage the scenic spots. Article 6 The scenic spot management agency established by the people's government at or above the county level where the scenic spot is located is responsible for the specific work of the protection, utilization and management of the scenic spot, and accepts the guidance and supervision of the competent department of the scenic spot. Article 7: All units and individuals have the obligation to protect scenic and historic resources and have the right to stop and report acts that damage scenic and historic resources. Chapter 2 Establishment and Cancellation Article 8 People’s governments at or above the county level shall organize a general survey of scenic and historic resources within their own administrative regions, evaluate the status and protection and utilization value of scenic and historic resources, and complete the application for the establishment of scenic and historic areas. Article 9 The establishment of national-level scenic spots shall be handled in accordance with the conditions and procedures stipulated in the "Regulations on Scenic Spots" of the State Council, and shall be approved and announced by the State Council.
The establishment of provincial-level scenic spots must meet the conditions stipulated by the state and the province. An application shall be submitted by the people's government of a city divided into districts or a county (city, district), and the provincial housing and urban-rural development department shall organize the organization in conjunction with other relevant departments. Demonstrate, put forward review opinions, and report to the Provincial People's Government for approval and publication. Article 10 The people's government that applies for the establishment of a scenic spot shall fully consult with the owners and use rights holders of the land, forests and other natural resources and houses and other properties within the scenic spot before applying for approval.
If the establishment of a scenic spot causes losses to the owners and users of land, forests and other natural resources and houses and other properties within the scenic spot, compensation shall be provided in accordance with the law; if it causes losses to the production and life of the indigenous residents, If it is affected, the people's government at or above the county level where the scenic spot is located shall provide support. Article 11 After the establishment of a scenic spot, the competent department of the scenic spot or the administrative agency of the scenic spot shall set up boundary stakes to mark the boundaries of the scenic spot in accordance with the approved scope of the scenic spot and the scope of the core scenic spot, and establish entrance markers at the main entrances of the scenic spot.
Scenic and historic area entrance markers shall be inlaid with the scenic and historic area emblem in accordance with regulations. National-level scenic spots shall use the emblem formulated by the housing and urban-rural development department of the State Council; provincial-level scenic spots shall use the emblem formulated by the provincial housing and urban-rural development department.
No unit or individual may use the name of a scenic spot without authorization, or misappropriate or counterfeit the emblem of a scenic spot. Article 12 If a provincial scenic spot has any of the following circumstances, the provincial housing and urban-rural development department will give a warning, order rectification within a time limit, investigate the responsibility in accordance with the law, and disclose it to the public:
(1) Self-scenery The overall planning of the scenic spot has not been completed within two years from the date of establishment of the scenic spot;
(2) The scenic spot resources have been seriously damaged or are at risk of loss;
(3) The county where the scenic spot is located People's governments at or above the national level and their relevant departments fail to perform statutory supervision duties, resulting in serious consequences;
(4) There are other major violations of laws and regulations or other serious problems.
When the warned scenic spots complete rectification or the rectification period expires, the provincial housing and urban-rural development department shall organize an evaluation; if the rectification requirements are not met, the provincial people's government shall be reported to the provincial people's government for cancellation.
The warning and cancellation of national scenic spots shall be implemented in accordance with relevant national regulations. Chapter 3 Planning Article 13 After the establishment of a scenic spot is approved, a scenic spot plan shall be prepared in accordance with the law. Scenic area planning is divided into overall planning and detailed planning.
When formulating plans for scenic spots, we should adhere to the principle of giving priority to protection and subordinating utilization to protection, highlighting the natural characteristics, cultural connotation and local characteristics of scenic spots, maintaining landscape style, maintaining ecological balance, and scientifically and rationally allocating tourist resources. , to promote the sustainable development of scenic spots.
