Regulations of Qingdao Municipality on Tourism Management (revised in 2004)

Chapter I General Provisions Article 1 In order to strengthen tourism management, protect and rationally develop tourism resources, standardize the order of the tourism market, safeguard the legitimate rights and interests of tourists and tour operators, and promote the development of tourism, these Regulations are formulated according to the specific conditions and actual needs of this Municipality. Article 2 "Tourism" as mentioned in these Regulations refers to the industries that use tourism resources and facilities to attract or receive tourists and provide services such as transportation, sightseeing, accommodation, catering, shopping and entertainment for tourists. Article 3 All units and individuals engaged in the development and construction of tourism resources, tourism business services and tourism activities within the administrative area of this Municipality shall abide by these regulations. Article 4 People's governments at all levels should incorporate tourism into the national economic and social development plan, strengthen the construction of tourism infrastructure, foster and support the development of tourism, expand the scale of tourism development, improve the overall level of tourism, and give play to the important role of tourism in national economic and social development in accordance with national industrial policies. Article 5 The development of tourism should follow the principle of integrating social benefits, economic benefits and environmental benefits, give full play to the advantages of tourism resources in this city, highlight local characteristics, create a good tourism environment and market order, and establish a civilized and healthy tourism fashion. Article 6 The municipal tourism administrative department shall be responsible for the overall planning, macro-control, comprehensive coordination, supervision and inspection of the city's tourism industry. Its main duties are: (1) to implement laws and regulations related to tourism; (two) the preparation of long-term tourism planning and annual plan and organize their implementation; (three) responsible for the general survey of tourism resources, the preparation of tourism resources protection and development and utilization planning, guidance, coordination and supervision of tourism resources protection, development and utilization; (four) to participate in the control planning and construction detailed planning of tourist areas; (5) Organizing and guiding tourism publicity, exploring international and domestic tourism markets, and managing outbound tourism affairs under centralized management; (six) to guide the education and training of tourism talents, and to organize and guide the technical business rating of employees; (seven) to participate in the organization and coordination of tourism safety work; (8) Accepting complaints from tourists; (nine) other duties entrusted by the Municipal People's government.

County-level cities (districts) tourism administrative departments are responsible for tourism management within their respective jurisdictions.

All relevant departments shall, according to their respective responsibilities, cooperate with the tourism administrative departments to do a good job in tourism management. Tenth tourism administrative departments at all levels shall be responsible for the investigation, evaluation and planning of tourism resources within their respective jurisdictions. Tourist area management agencies are responsible for the preparation of tourism resources protection, development and utilization planning in tourist areas, and organize the implementation after approval according to relevant regulations. Article 11 The development and construction of tourist areas and tourism construction projects shall conform to the planning for the protection, development and utilization of tourism resources, with overall arrangement, rational layout and coordinated development. Twelfth tourist areas, star-rated hotels and key tourism projects planning and construction (including new construction, expansion and reconstruction), the municipal tourism administrative department shall participate in the demonstration, review and acceptance. Thirteenth tourist areas should be in accordance with the planning and construction of tourism infrastructure, commercial service outlets and safety and health facilities. Its construction should be adapted to the overall construction of the tourist area, and the architectural style should be coordinated with the surrounding environment. Fourteenth development of tourism construction projects must carry out environmental impact assessment, and implement the policy of coordination and synchronization with environmental protection. Treatment facilities for waste water, waste gas and solid waste must be designed, constructed and put into use simultaneously with the main project. Eighteenth municipal tourism administrative departments shall, according to the national standards, make a preliminary evaluation and recommendation on the tourism quality grade of tourist areas (spots), and report it to the higher tourism administrative departments for evaluation. Chapter III Management of Business Services Article 19 Tourism operators shall operate according to law, improve service quality, fulfill the service standards agreed upon or agreed with tourists, and protect the personal and property safety of tourists. Twentieth travel agencies shall pay the quality deposit to the municipal tourism administration department in accordance with the relevant provisions of the state. All quality guarantee funds are paid by travel agencies, and their use and management are implemented in accordance with state regulations. The revenue and expenditure and management of the deposit shall be subject to the supervision of the financial and auditing departments. Twenty-first tour guides must pass the tour guide qualification examination organized by the state and obtain the tour guide certificate issued by the tourism administrative department before they can engage in tour guide business. Tour guides engaged in tour guide work must hold relevant certificates, wear tour guide cards and provide services in accordance with the prescribed duties and standards.

Travel agencies shall not use or employ persons without tour guide certificates to engage in tour guide work.
