The full text of Jiangsu Tourism Regulations in 219 (II)
The tourism authorities of the local people's governments at or above the county level shall, during the Spring Festival, National Day and other legal holidays, release to the public the service information related to tourists, such as the passenger flow of major scenic spots, the comfort index of sightseeing and the reception status of tourist hotels.
article 34 the tourism authorities of local people's governments at or above the county level shall make use of modern information technology to improve the database of basic tourism information, and realize interconnection with the information of relevant departments to promote the development of smart tourism.
article 35 the local people's governments at or above the county level and their relevant departments shall rationally arrange tourist traffic routes, plan and construct tourist transit stations, tourist distribution centers, scenic spots connecting roads and other tourist public service facilities, and link them with the transportation development plan.
relevant departments of tourism and transportation of local people's governments at or above the county level should set up tourist signs in scenic spots and roads leading to scenic spots according to needs, and improve the setting of signs such as guidelines and tourist symbols.
article 36 the tourism authorities of the local people's governments at or above the county level shall promote the service of tourism companies into the community, and provide convenience for community residents to travel and complain about their rights.
tourism operators such as travel agencies, hotels and restaurants, restaurants and entertainment in scenic spots are encouraged to strengthen cooperation with financial institutions and logistics enterprises to provide tourists with safe and convenient financial and logistics services.

article 38 encourages the public to participate in voluntary tourism activities and engage in public welfare services such as civilized guidance, tour explanation and tourism consultation.
Chapter IV Tourism Management and Services
Article 39 Tourism operators shall enjoy the following rights in tourism management activities:
(1) The right of independent management shall be protected by law, and illegal inspections, fees collection, fund-raising and apportionment shall be refused;
(2) Intellectual property rights are protected by law, and no unit or individual may illegally obtain, use or disclose tourist routes, marketing plans, sales channels, customer information and other business secrets that have not been made public by tour operators;
(3) Refusing tourists' requests that violate the law or violate public order and good customs;
(4) other rights stipulated by laws and regulations.
Article 4 Tourism operators shall perform the following obligations in their tourism business activities:
(1) Abide by laws and regulations and provide standardized tourism services in accordance with national standards and industry standards;
(2) following the principles of voluntariness, equality, fairness, honesty and credit, and performing obligations as agreed in the contract;
(3) protect tourism resources and tourism environment;
(4) training tourism professionals in laws and regulations, professional ethics, professional norms, business skills and safety precautions;
(5) Establish and implement the responsibility system for tourism safety to ensure the personal and property safety of tourists;
(6) accept the supervision and management of relevant administrative departments;
(7) other obligations stipulated by laws and regulations.
article 41 a tour guide or tour leader shall be appointed by a travel agency to provide services for tourists. Travel agencies shall bear corresponding legal responsibilities for the service behavior of their appointed tour guides and tour leaders.
Tour guides and tour leaders should wear tour guide cards and tour leader cards when they take up their posts, and carry copies or certificates of travel travel itinerary provided by travel agencies and travel transportation contracts signed between travel agencies and carriers with corresponding qualifications.
the tour guide card and tour guide card are for personal use only, and shall not be altered, lent or rented.
article 42 a travel agency shall, in accordance with the provisions of laws and regulations, conclude a labor contract with the tour guides it employs, pay labor remuneration consistent with its professional level and service quality, and pay social insurance fees such as pension and medical care.
if a travel agency temporarily hires a tour guide or tour leader to provide services for tourists, it shall conclude a temporary employment contract with the tour guide or tour leader, stipulate the rights and obligations of both parties, and pay the service fees specified in the package tour service contract in time.
article 43 when organizing tourism activities, a travel agency shall conclude a written travel contract with tourists. The format of a written travel contract can refer to the model contract text jointly recommended by the tourism authorities of the State Council and the administrative department for industry and commerce.
if a travel agency uses a self-made format contract, it shall inform the local tourism authorities and the administrative department for industry and commerce in writing before using the contract.
article 44 tourist attractions should set up tourism supporting services and auxiliary facilities such as water supply, power supply, gas supply, parking lots, toilets, communication facilities and barrier-free facilities in accordance with national and local standards, set up standardized Chinese and foreign-language guidance and safety warning signs in a conspicuous position in time, and publicize the contact information of consultation, complaint and assistance.
the opening of tourist attractions should meet the conditions stipulated by laws and administrative regulations, and listen to the opinions of the tourism authorities.
article 45 implement the service system of full-time interpreters in tourist attractions. Tourism industry organizations can send tour guides and tour leaders to provide temporary explanation services for tourist attractions.
the management agencies or operators of tourist attractions shall not hinder the explanation service of tour guides. When tour guides provide explanation services in tourist attractions, they shall abide by the management system of interpreters related to tourist attractions.
article 46 tickets for tourist attractions built with public resources, as well as other items for which fees are charged separately, such as scenic spots and means of transportation, shall be set by the government or guided by the government, and the price increase shall be strictly controlled. If the investment cost of the project charged separately has been recovered, the price shall be reduced or the fee shall be cancelled accordingly.
article 47 those who operate travel agency business through the internet shall obtain a travel agency business license in accordance with the law, and publicize the information published in their business license or the electronic link logo of their business license in a prominent position on the homepage of their website or the homepage engaged in business activities, and indicate their business license information. Travel agencies engaged in online tourism business shall inform the local county-level tourism authorities in writing.
online tour operators should conclude paper or electronic contracts with tourists, and provide paper or electronic invoices for collecting tour service fees or other related fees.
the travel service information provided by online travel operators for tourists should be true and reliable. If they provide transportation, accommodation, catering, sightseeing, entertainment and other booking services, they should choose operators with corresponding business qualifications as service providers.
article 48 when a travel agency rents a passenger vehicle or ship, it should choose a carrier with corresponding qualifications and a vehicle or ship that has been insured with statutory compulsory insurance.
when a travel agency signs a travel contract with a carrier, it shall specify the transportation plan, and stipulate the transportation route, transportation price, requirements of vehicles and ships, seating requirements of tour guides or tour leaders, liability for breach of contract and other matters.
passenger vehicles and ships undertaking tourism and transportation shall meet the requirements of ensuring personal and property safety, be equipped with drivers and crew with corresponding qualifications, satellite positioning devices with driving record function, seat belts, fire fighting, lifesaving and other safety facilities and equipment, and keep the safety facilities and equipment in normal use.
Chapter V Integrity Management and Civilized Tourism
Article 49 Travel agencies, tourist attractions and operators who provide services such as transportation, accommodation, shopping, catering and entertainment for tourists shall operate in good faith according to law, protect the legitimate rights and interests of tourists, and abide by the following provisions:
(1) The information released is true and accurate, and no false propaganda, deception or misleading of tourists shall be allowed;
(2) Fair competition, and no unfair competition such as giving or receiving kickbacks;
(3) tourists shall not be tricked, forced or forced to buy goods or receive services in any form;
(4) Respect and protect the personal privacy of tourists, and do not illegally use or disclose the personal information of tourists.
Article 5 A travel agency shall not organize tourism activities at unreasonably low prices to trick tourists, and obtain improper benefits such as kickbacks by arranging shopping or paying for other tourism projects.
when a travel agency provides a package tour service for tourists, if both parties reach an agreement through consultation or the tourists request to arrange shopping or pay for other tours, it may conclude a supplementary contract with the tourists, and shall abide by the following provisions:
(1) It shall not affect the itinerary of other tourists;
(2) You are not allowed to obtain improper benefits such as kickbacks by arranging shopping or paying for travel projects separately;
(3) it is not allowed to designate or recommend shopping places or tourism projects that are not open to the public and pay separately;
(4) Express the basic information of the agreed shopping places and tourism projects paid separately to tourists in advance, and inform them of possible risks.
if a tourist purchases goods in a shopping place agreed upon in a written contract with a travel agency, and the seller adulterates the goods, passing the fake goods off as genuine ones, passing the substandard goods off as qualified goods, or selling invalid or deteriorated goods, the tourist may ask the travel agency for compensation; After compensation, the travel agency has the right to recover from the commodity seller.
article 51 the tourism authorities of the local people's governments at or above the county level shall guide the tourism industry organizations to establish and improve the credit files of tourism operators and their employees, and collect and record their credit information in a timely, accurate and complete manner.
tourism industry organizations should evaluate the integrity of their members according to laws, regulations and articles of association, and announce them to the public.
Article 52 The tourism authorities of the local people's governments at or above the county level shall publicize the following information of tourism operators generated in the course of performing their duties to the public through the enterprise credit information publicity system:
(1) Information on the approval, modification and renewal of administrative license;
(2) information on administrative punishment;
(3) other information that should be publicized according to law.
tour operators shall, in accordance with the relevant provisions of the "provisional regulations on enterprise information disclosure" of the State Council, consciously fulfill the statutory obligation of information disclosure, and timely and truly disclose their relevant information.
article 53 the tourism administrative department of the local people's government at or above the county level shall establish a reputation evaluation system for tourism operators, organize tourism industry organizations to carry out evaluation, listen to the opinions and suggestions of consumer associations or consumer representatives, and publish the reputation evaluation results to the society on a regular basis in combination with the list of abnormal business operations and the list of serious illegal enterprises recorded in the enterprise credit information publicity system.
