4. The total charter fee and accommodation fee is 9,630 yuan. Party B pays a deposit of 500 yuan in advance, and pays 8,130 yuan before departure from Chengdu Shuangliu Airport on September 29. The remaining balance of 1,000 yuan will be delivered on October 7. Make payment before getting off at Chengdu Shuangliu Airport.
5. If the charter is terminated early due to Party B’s reasons, the fees charged will not be refunded; if the charter is withdrawn midway due to Party A’s reasons, Party A will refund the unfinished fees and pay 5% of the total amount. Compensation; if both parties reach an agreement and terminate the charter midway, the unfinished fees will be refunded.
6. If the chartered car needs to be extended, Party A must obtain consent and pay the corresponding fees.
7. The vehicles provided by Party A must be delivered to Party B on time and at the designated time and location. If Party B suffers losses due to delay, Party A will be responsible for compensation.
8. Party A should require the driver to inspect the vehicle at any time during the journey, and if there is any hidden danger, it should be solved immediately; Party B should supervise the operation of the vehicle at any time during the driving process, and if any hidden danger is discovered, it should be stopped immediately until until it is safe; if the driver refuses to listen to the dissuasion, Party B shall report it immediately and has the right to refuse to get on the bus. Party A shall do its best to assist Party B in recovering the losses caused by the driver and his unit.
9. If the vehicle provided by Party A breaks down due to vehicle failure or the driver's fault, Party A will repair it as soon as possible or arrange a corresponding vehicle replacement at the nearest location, and Party A will be responsible for the cost. If the itinerary cannot be completed on a certain day due to this delay, Party A will refund the car rental fee for that day and be responsible for Party B's accommodation on that day. If Party B proposes, both parties can negotiate to terminate the car charter and refund the remaining fees.
10. If the itinerary cannot be completed or is delayed due to other reasons, such as landslides, mudslides, traffic jams, non-vehicle traffic accidents and other force majeure reasons, Party B does not need to pay the car rental fee and driver during the delay. Accommodation and board, and other losses shall be borne by both parties independently, and neither party shall be held responsible. Both parties can negotiate to adjust the itinerary and resolve follow-up matters.
11. During the driving process, Party B shall respect the driver's work and shall not require the driver to make actions that are detrimental to safety, shall not affect the driver's safe driving, and shall not force the driver to change the itinerary, otherwise it will be Party B is responsible for the consequences caused by this.
12. Party A should purchase travel accident insurance for Party B before departure. If a traffic accident or other safety incident is caused by the driver or other third party, resulting in personal injury or property loss to Party B, Party A should assist Party B. Negotiate with the driver and the unit where the vehicle is located in accordance with the "Measures for Handling Traffic Accidents of the People's Republic of China", and make claims in accordance with relevant regulations on travel accident insurance.
13. Party B will provide the driver’s food and accommodation for this chartered car.
14. This contract shall be signed and sealed by both parties and shall become effective in duplicate. Each party shall hold one copy. Faxed signature is valid.
15. Matters not covered in this contract shall be implemented in accordance with relevant laws and regulations.
