Chapter 1 General Provisions
Article 1 In order to strengthen tourism safety management, improve the ability to respond to tourism emergencies, ensure the personal and property safety of tourists, and promote the sustainable and healthy development of the tourism industry, in accordance with the Tourism Law of the People's Republic of China, The "Work Safety Law of the People's Republic of China", the "Emergency Response Law of the People's Republic of China", the "Travel Agency Regulations" and the "Regulations on Reporting, Investigation and Handling of Work Safety Accidents" and other laws and administrative regulations were formulated. this method.
Article 2 The safety production of tourism operators, the safety supervision and management of tourism authorities, and the response to tourism emergencies shall comply with the provisions of relevant laws, regulations and these Measures.
The term "tourism operators" as mentioned in these Measures refers to travel agencies and scenic spots, hotels and other units for which local regulations stipulate that the tourism authorities have industry supervision responsibilities.
Article 3 The tourism authorities at all levels shall, under the leadership of the people's government at the same level and the guidance of the superior tourism authorities and relevant departments, within the scope of their duties, guide, prevent and prevent tourism safety work in accordance with the law. Supervision, training, statistical analysis and emergency response.
Article 4 Tourism operators shall assume the main responsibility for tourism safety, strengthen safety management, establish and improve safety management systems, pay attention to safety risk warnings and prompts, and properly respond to tourism emergencies.
Tourism employees should strictly abide by the safety management system of their units, receive education and training on production safety, and enhance their ability to prevent and handle tourism emergencies.
Article 5 Tourism authorities, tourism operators and their employees shall fulfill their obligations to report tourism emergencies in accordance with the law.
Chapter 2 Operation Safety
Article 6 Tourism operators shall comply with the following requirements:
(1) Service venues, service items, facilities and equipment comply with relevant Requirements of safety laws, regulations and mandatory standards;
(2) Equip necessary safety and rescue personnel, facilities and equipment;
(3) Establish safety management system and responsibility system;
(4) Ensure capital investment in safety work.
Article 7 Tourism operators shall regularly inspect the implementation of safety measures in their units and eliminate potential safety hazards in a timely manner; regarding possible tourism emergencies and the adoption of safety precautions, they shall promptly report to the department in accordance with regulations Report to the local people's government or relevant departments of the people's government.
Article 8 Tourism operators shall conduct risk monitoring and safety assessments on the products and services they provide, perform safety risk warning obligations in accordance with the law, and when necessary, take measures such as suspending services and adjusting activity content.
Those who operate high-risk tourism projects or provide tourism services to the elderly, minors, and disabled people shall take corresponding safety protection measures as necessary.
Article 9 Tourism operators shall conduct safety production education and training for employees to ensure that employees master the necessary safety production knowledge, rules and regulations, operating procedures, job skills and emergency response measures, and understand that they are Rights and obligations regarding production safety.
Tourism operators should establish safety production education and training files, and truthfully record the time, content, participants, and assessment results of safety production education and training.
Tourism employees who have not been educated and trained in safety production are not allowed to work; special operations personnel must undergo special safety operation training in accordance with relevant national regulations and obtain corresponding qualifications.
Article 10 Tourism operators should proactively inquire about personal health information related to tourism activities, require tourists to use tourism facilities and receive services in accordance with express safety procedures, and require tourists to take measures against tourism operators comply with safety precautions.
Article 11 When organizing and receiving tourists, travel agencies shall reasonably arrange travel itineraries and order products and services from qualified suppliers.
If the travel agency and its employees discover that the services provided by the performance assistant do not comply with laws and regulations or have safety hazards, they shall stop or replace them.
Article 12 When organizing outbound tourism, travel agencies shall produce safety information cards.
The safety information card should include the tourist’s name, exit document number and nationality, as well as emergency contact person, contact information and other information, and should be filled out in Chinese and the official language of the destination (or English).
Travel agencies should hand safety information cards to tourists to carry with them and inform them to fill in their own information such as blood type, allergy medications and major diseases.
Article 13 Tourism operators shall formulate contingency plans for tourism emergencies in accordance with the law, connect them with the contingency plans of the local people's governments at or above the county level and their relevant departments, and organize regular drills.
Article 14 After a tourism emergency occurs, tourism operators and their on-site personnel shall take reasonable and necessary measures to rescue injured tourists, control the development of the situation, and prevent the expansion of damage.
Tourism operators shall, in accordance with the requirements of the people's government that performs unified leadership responsibilities or organizes the handling of emergencies, cooperate with the emergency response measures taken by it, and participate in the emergency rescue and aftermath work organized by the local people's government.
If a tourism emergency occurs overseas, the travel agency and its tour leader shall make every effort to respond to and handle the emergency under the guidance of the Chinese embassy, ??consulate or government agency in the local area.
Article 15 After a tourism emergency occurs, the on-site personnel of the tourism operator shall immediately report it to the person in charge of the unit. After receiving the report, the person in charge of the unit shall report it to the county level where the occurrence occurred within 1 hour. The tourism authorities, work safety supervision and management departments and other relevant departments responsible for work safety supervision and management shall report; the person in charge of the travel agency shall also report to the local tourism authorities at or above the county level where the unit is located.
When the situation is urgent or a major or particularly major tourism emergency occurs, relevant personnel on site may directly report to the tourism authority at or above the county level, the safety production supervision and management department and the responsible person responsible for safety production supervision at the place of occurrence and where the travel agency is located. Reports to other relevant departments with management responsibilities.
If a travel emergency occurs overseas, the leader of the travel team should immediately report it to the local police, the Chinese embassy or consulate in the local area or a government agency, and the person in charge of the travel agency. The person in charge of the travel agency shall report to the local tourism authority at or above the county level where the unit is located within one hour after receiving the report from the tour leader.
Chapter 3 Risk Warning
Article 16 The state establishes a warning system for tourist destination safety risks (hereinafter referred to as risks).
Based on the degree of harm that may be caused to tourists, the degree of emergency and the development trend, the risk warning levels are divided into level one (extremely serious), level two (serious), level three (serious) and level four. (General), marked in red, orange, yellow and blue respectively.
The classification standards for risk warning levels shall be formulated or determined by the National Tourism Administration in conjunction with relevant departments such as foreign affairs, health, public security, land, transportation, meteorology, earthquakes and oceans.
Article 17 Risk warning information shall include risk category, warning level, possible affected areas, starting time, precautions, measures to be taken, issuing authority, etc.
If the end time of the first-level and second-level risks can be released at the same time as the risk warning information content, they should be released at the same time; if they cannot be released at the same time, they will be released through the original channel after the risk disappears.
Level 3 and 4 risk warnings do not need to publish the risk end time, and will end naturally after the risk disappears.
After the issuance of Article 18 risk warnings, travel agencies shall take the following measures according to the risk level:
(1) For level four risks, strengthen warnings to tourists.
(2) For Level 3 risks, necessary safety precautions shall be taken.
(3) If there is a second-level risk, stop organizing or leading groups to the risk area; if you are already in the risk area, adjust or suspend the itinerary.
(4) For first-level risks, stop organizing or leading groups to risk areas, and organize the evacuation of tourists who are already in risk areas.
Other tourism operators should strengthen risk warnings for tourists according to the level of risk warnings, take corresponding safety precautions, properly accommodate tourists, and suspend or close according to the requirements of the government or relevant departments Tourism projects or places that are vulnerable to risks.
After the issuance of the risk warning Article 19, tourists should pay attention to relevant risks, strengthen personal safety precautions, and cooperate with the national measures to temporarily restrict tourism activities in response to risks, as well as the measures taken by relevant departments, institutions or tourism operators. safety precautions and emergency response measures.
Article 20: The National Tourism Administration is responsible for issuing risk warnings for overseas tourist destination countries (regions) and risk areas covering the entire country or across provincial administrative regions. The issuance of first-level risk warnings must be approved by the State Council; the issuance of risk warnings for overseas tourist destination countries (regions) must be approved by the foreign affairs department.
Local tourism authorities at all levels shall promptly forward the risk warnings issued by the superior tourism authorities and be responsible for issuing risk warnings involving their own jurisdictions other than those specified in the preceding paragraph.
Article 21 Risk warning information shall be released to the public through official websites, mobile phone text messages and media channels that are easily accessible to the public. Level one and level two risk warnings should be notified to relevant media at the same time.
Chapter 4 Safety Management
Article 22 The tourism authorities shall strengthen the following daily management of tourism safety:
(1) Supervise tourism operators Implement relevant laws and regulations on safety and emergency management, and guide them to implement relevant national standards, industry standards or local standards, and improve their ability to operate safely and respond to emergencies;
(2) Guide tourism operations Organize and carry out safety and emergency management training for practitioners, and organize and carry out publicity and popularization activities of tourism safety and emergency knowledge through news media and other channels;
(3) Statistical analysis of incidents within this administrative region The situation of tourism safety accidents;
(4) Other tourism safety management work stipulated by laws and regulations.
The tourism authorities should strengthen guidance on tourism safety and emergency management in star-rated hotels and A-level scenic spots.
Article 23: Local tourism authorities at all levels shall formulate and revise contingency plans for tourism emergencies in their region or department in accordance with relevant laws and regulations, and report them to the tourism authorities at the next higher level. Keep records and organize emergency drills when necessary.
Article 24: Local tourism authorities at all levels shall, under the leadership of the local people's government, provide guidance on the compliance of scenic spots with safe opening conditions in accordance with the law, and verify or cooperate with relevant scenic area authorities in verifying the maximum carrying capacity of scenic spots. Guide scenic spots to use ticket reservations and other methods to control the flow of scenic spots; when the number of tourists may reach the maximum carrying capacity, cooperate with the local people's government to take measures such as diversion and diversion.
Article 25 After a tourism emergency occurs, the tourism administrative department at or above the county level in the place of occurrence shall activate a tourism emergency emergency plan in accordance with the requirements and relevant regulations of the people's government at the same level, and take the following measures One or more measures:
(1) Organize, coordinate, and cooperate with relevant departments to carry out rescue and aftermath treatment for tourists to prevent secondary and derivative incidents;
(2) ) Coordinate medical, rescue and insurance agencies to provide rescue and aftermath treatment for tourists;
(3) In accordance with the requirements of the people's government at the same level, publish relevant information on the development of the situation and emergency response work in a unified, accurate and timely manner information and publish the consultation hotline.
Article 26 After a tourism emergency occurs, the tourism administrative department at or above the county level in the place of occurrence shall, in accordance with the requirements and relevant regulations of the people's government at the same level, participate in the investigation of the tourism emergency and cooperate with relevant departments The tourism operators and responsible persons who should bear responsibility for the incident shall be dealt with in accordance with the law.
Article 27 Tourism authorities at all levels should establish a tourism emergency reporting system.
Article 28 After receiving the report from the tourism operator in accordance with Article 15 of these Measures, the tourism administrative department shall report to the people's government at the same level and the higher-level tourism administrative department. General tourism emergencies are reported to the districted municipal tourism authorities; major tourism emergencies are reported to the provincial tourism authorities; major and particularly major tourism emergencies are reported to the National Tourism Administration. Reporting tourism emergencies to higher-level tourism authorities should include the following contents:
(1) The time, place and information source of the incident;
(2) Brief history, casualties Number of people and scope of impact;
(3) Names of tourism operators and other relevant units involved in the incident;
(4) Preliminary judgment of the cause and development trend of the incident;

(5) Emergency measures taken and their handling;
(6) Matters requiring support and assistance;
(7) Name, unit and contact number of the reporter .
If the content listed in the preceding paragraph cannot be determined temporarily, the known situation shall be reported first; if new situations arise after the report is made, a supplementary report or renewal report shall be made in a timely manner.
Article 29: Tourism authorities at all levels shall establish a tourism emergency information notification system. After a tourism emergency occurs, the tourism authorities shall promptly notify relevant industry authorities of relevant information.
Article 30 After the handling of tourism emergencies, the tourism authorities at the place of occurrence shall promptly identify the occurrence and causes of the emergency, summarize the experience and lessons learned from the emergency response work, and formulate improvement measures. Measures shall be taken and a summary report shall be submitted within 30 days in accordance with the following procedures:
(1) General tourism emergencies shall be submitted to the districted municipal tourism authorities;
(2) Comparative Major tourism emergencies are submitted to the provincial tourism authorities step by step;
(3) Major and particularly major tourism emergencies are submitted to the National Tourism Administration step by step.
If a travel team encounters an emergency abroad, the tourism authority where the tour group is located shall submit a summary report.
Article 31 Provincial tourism authorities should report the major tourism emergencies that occurred in the region last month to the National Tourism Administration before the 5th of each month for record. The content should include the occurrence of emergencies. The time, place, cause, type of incident and number of casualties, etc.
Article 32: Local tourism authorities at or above the county level shall regularly conduct statistics and analysis of tourism emergencies within their respective administrative regions, and report the relevant situation of the previous year on a case-by-case basis before the end of January each year. Report to the National Tourism Administration.
Chapter 5 Penalties
Article 33 Tourism operators, their principal persons in charge, and tourism practitioners violate laws and regulations regarding production safety and emergency response provisions , handled in accordance with relevant laws and regulations.
Article 34 If a travel agency violates the provisions of paragraph 2 of Article 11 of these Measures and fails to stop the illegal or unsafe service behavior of the performance assistant, or fails to replace the performance assistant, the tourism manager shall The department will issue a warning and may impose a fine of not more than 2,000 yuan; if the circumstances are serious, a fine of not less than 2,000 yuan but not more than 10,000 yuan may be imposed.
Article 35: A travel agency violates the provisions of Article 12 of these Measures by failing to produce safety information cards as required, failing to hand safety information cards to tourists, or failing to inform tourists of relevant information< /p>
