Chapter 1 General Provisions Article 1 In order to protect and rationally develop and utilize tourism resources, regulate the tourism market order, protect the legitimate rights and interests of tourists and tourism operators, and promote the healthy development of the tourism industry, in accordance with relevant national laws and These regulations are formulated based on the actual conditions of Sichuan Province. Article 2 These Regulations shall apply to the protection, development and utilization of tourism resources, tourism operations, services and supervision and management activities within the administrative region of Sichuan Province. Article 3: The development of tourism industry shall implement the principles of government leadership, social participation, market operation and industry self-discipline, adhere to the combination of tourism resource protection and rational development and utilization, and unify ecological benefits, economic benefits and social benefits. Article 4 Local people's governments at or above the county level shall incorporate the development of tourism into national economic and social development plans, strengthen the construction of tourism infrastructure, and promote the integrated development and comprehensive management of tourism and related industries. Article 5 Local people's governments at or above the county level shall establish a coordination mechanism for tourism work, regularly study important issues in tourism development, and coordinate and handle major issues in tourism development. Article 6: The tourism administrative departments of local people's governments at or above the county level are responsible for the organization and coordination of the tourism industry within their respective administrative regions and the guidance, supervision and management of the industry. Other relevant administrative departments shall coordinate the supervision, management, guidance and services of the tourism industry in accordance with the provisions of these Regulations and their respective responsibilities. Article 7 The tourism industry association shall improve the industry self-discipline system, carry out activities in accordance with the law, play the role of service, guidance and supervision, and promote the healthy development of the tourism industry. Chapter 2 Tourism Promotion and Resource Protection Article 8 Tourism development should be planned in a unified manner. The preparation of tourism planning should highlight local characteristics, conform to the overall land use plan and urban and rural overall planning, and coordinate with plans for natural ecological reserves, cultural relics reserves, scenic spots, etc. The preparation of other relevant plans should take overall consideration of tourism functions and the development of tourism. Article 9 The tourism administrative department of the Provincial People's Government shall, in conjunction with relevant departments, organize the preparation of provincial tourism plans and cross-city (state) regional tourism plans, organize reviews, and submit them to the Provincial People's Government for approval and implementation.
The tourism administrative departments of the municipal (prefecture) and county (city, district) people's governments shall organize the preparation of tourism development plans and tourist area plans in conjunction with relevant departments, and submit them for approval after review by the tourism administrative departments at the next higher level. Approved and implemented by the people's government at the level.
Changes and cancellations of tourism plans must be reported to the original approval authority for approval.
If fiscal funds are used to prepare tourism plans, professional institutions with corresponding qualifications should be determined through bidding. Article 10 Local people's governments at or above the county level shall, based on local tourism development and financial conditions, include the funds required for tourism resource protection, tourism promotion, administrative law enforcement, etc. into the department's comprehensive budget for guarantee.
Provincial, municipal (state) people's governments and county-level people's governments where conditions permit should set up special funds for tourism development. Article 11 Local people's governments at or above the county level shall prioritize the construction of transportation projects in tourist attractions based on the needs of tourism development. Main traffic arteries and urban roads should be equipped with standardized tourist traffic signs and signs for major tourist attractions. Article 12 The construction of tourism projects shall comply with tourism planning. Before approval, approval, and filing of tourism project construction, opinions from the tourism administrative department must be sought in writing and submitted for approval in accordance with relevant construction procedures.
The development and utilization of tourism resources must comply with relevant laws and regulations. When developing tourism projects using natural resources such as nature reserves, corresponding protection measures must be taken to avoid damaging the ecology or polluting the environment; developing tourism projects using historical and cultural areas, outstanding historical buildings and other historical and cultural resources must maintain their unique historical features. , no unauthorized reconstruction, relocation or demolition is allowed. Article 13: State-owned tourism resources may be properly separated from ownership and management rights. Legal persons and other organizations may obtain operating rights in accordance with the law through leasing, contracting, bidding and other forms, unless otherwise provided by laws and regulations.
Operators of tourist attractions should standardize their operations in accordance with the provisions of laws and regulations, take corresponding measures to protect tourism resources, provide safe, stable and reasonably priced services to the public, and fulfill universal service obligations. Operators of public service facilities such as sightseeing cars (boats) and ropeways in tourist attractions may not suspend or cease operations without the approval of the administrative agency that made the administrative licensing decision. If approval is given for suspension or closure of business, it shall be announced to the public in advance. Article 14 The local people's governments at or above the county level shall encourage and support the development and construction of tourist resorts, do a good job in organizing and coordinating work, and create a good environment for the development and construction of tourist resorts.
Applications for the establishment of provincial-level tourist resorts shall be reviewed by the tourism administrative department of the Provincial People's Government and reported to the Provincial People's Government for approval and announcement. Apply for the establishment of a national tourist resort and submit for approval in accordance with relevant regulations.
Without approval, no organization or individual may engage in development and business activities in the name of a national or provincial tourist resort. Article 15 The tourism administrative departments of local people's governments at or above the county level shall, in conjunction with relevant departments, conduct a general survey and evaluation of tourism resources within their respective administrative regions, establish tourism resource files, and guide, supervise and coordinate the development, utilization and protection of tourism resources.
The development, utilization and protection of tourism resources across administrative regions shall be organized and coordinated by the people's government at the same level.
