The difference between highway passenger transport and tourist passenger transport

Legal subjectivity:

According to the different modes of transportation, road passenger transport contracts can be divided into ordinary passenger transport contracts, direct passenger transport contracts, urban and rural public passenger transport contracts, tourist passenger transport contracts and charter contracts. According to the passenger transport rules, there are four kinds of bus passenger transport contracts: bus passenger transport, tourist passenger transport, taxi passenger transport and chartered passenger transport. (1) The shuttle bus passenger transport contract refers to the transport contract concluded between the passenger and the shuttle bus passenger transport operator. Shuttle passenger transport operation refers to the passenger transport operation carried out by passenger transport operators at fixed points and lines. Shuttle passenger transport is subject to "compulsory contracting", that is, the offer to conclude a contract for qualified passengers to purchase tickets shall not be rejected by the passenger transport operator. (2) A tourist passenger transport contract refers to a transport contract concluded between a passenger transport operator and a tourist. Tourist passenger transport refers to a mode of operation in which one end of the route must be located in scenic spots, tourist attractions and other tourist spots for the purpose of transporting tourists for sightseeing. (3) Taxi passenger transport contract refers to the transport contract concluded between taxi passenger transport operators and passengers. Taxi passenger transport refers to a mode of operation in which cars and minibuses are the main body, driving, getting on and off and waiting at the time and place required by users (passengers), and charging by mileage or time. (4) A chartered passenger transport contract refers to a contract in which the carrier and the user package all the passenger cars and deliver them to the users (passengers) and transport them according to the instructions of the users. Chartered passenger transport is a mode of operation of passenger transport, which is characterized by the carrier charging freight according to the instructions of users or mileage or chartered time. The following is the process of signing a cargo transportation contract: (1) Submitted for review; (2) Department audit. The person in charge of the undertaking department shall review the relevant business requirements and sign the approval opinions; (3) legal review; (4) Management review. Directly-affiliated (vice-presidents) of various businesses shall review relevant contracts and sign relevant opinions. Any contract involving the company's capital expenditure needs the approval of the president; (5) signature for the record. According to Article 825 of the General Principles of the Civil Law, when handling the transportation of goods, the shipper shall accurately indicate to the carrier the name of the consignee or the instructed consignee, the name, nature, weight, quantity, receiving place and other necessary information about the transportation of goods. If the shipper makes false declaration or omits important information, thus causing losses to the carrier, it shall be liable for compensation. With the consent of the road carrier, the contract modification is established. The form of changing the passenger transport contract is that the passenger submits a visa to the road carrier and changes it to a ride. After the road carrier's visa is approved, the contract is changed, and both parties shall perform their respective obligations according to the changed contract. If the contract is changed due to the passenger's reasons, the passenger should bear the corresponding legal responsibility, and its manifestation is to pay a certain fee. If the contract is changed due to the responsibility of the road carrier, the carrier shall also compensate the passengers for their losses. (1) The number of passengers on the shuttle bus was changed to 1. If passengers can't take the bus on the date and train number specified on the ticket, they can apply for visa change and multiply it two hours before departure. If you don't change your ticket within 2 hours before driving, you can refund your ticket and check the refund fee. 2. If passengers need to cross the station, they should declare in advance and obtain the consent of the drivers and passengers, and make up the fare of the additional section. If it is not specified in advance, the crossing section will be treated as a bus ride without a ticket. 3. Refund of passengers should be handled 2 hours before the scheduled driving time, and within 1 hour after driving at the latest. Driving 1 hour is not refundable; Tickets sold in the car and tickets with visa change will not be refunded; Due to the carrier's responsibility, no refund will be charged. 4. If the bus stops at the departure station, delays or changes its model, it shall be announced. Passengers who request a refund should return all their tickets; If passengers want to take another bus instead of the station visa, if they change their model, they should refund the fare difference. If the shuttle bus stops running for some reason, the station shall assist the passengers to contact and solve the accommodation problem, and the expenses shall be borne by the passengers themselves. If the bus breaks down on the way, the station should send a car to pick it up quickly. If there is any change in the type of pick-up and drop-off vehicle, the fare difference will not be refunded. 6. If the bus has to be diverted due to route congestion, the fare will be charged according to the actual mileage of the diverted route. After the tickets are sold according to the diverted mileage, if the bus returns to the original route, the departure station will refund the fare difference to the passengers before departure. On the way to the shuttle bus, it needs to be temporarily rerouted or bypassed, and the fare difference will not be refunded or replenished. If you can't continue driving, passengers are willing to stop at the parking spot or on the way back, refund the original fare, and make up the fare of the road; Return to the original bus station, free of charge, and return all tickets; If you are willing to wait for the bus in the blocked place, the station and bus personnel will sign their tickets and continue to ride. Refund due to bus outage, operation diversion and other reasons will not be charged. (2) Changes in tourist passenger transport. Tourist passengers who provide comprehensive tourism services must apply for refund before driving, and charge a refund fee: tourist passengers who do not provide comprehensive tourism services will be refunded according to the shuttle bus; Passengers who stop halfway will not be refunded.
