Interim Provisions on the Administration of Examination and Approval of Foreign-related Hotels in Xinjiang Uygur Autonomous Region

Article 1 In order to standardize the examination and approval management of foreign-related hotels in our region, these Provisions are formulated in accordance with relevant national laws and regulations and document 1989 approved by the people's government of the autonomous region. Article 2 The Foreign Affairs Office of the People's Government of the Autonomous Region is the centralized management department for the examination and approval of foreign-related hotels, and is jointly responsible for the examination and approval of foreign-related hotels in Urumqi with the Public Security Department of the Autonomous Region, the National Security Department of the Autonomous Region, the Tourism Bureau of the Autonomous Region and the Health Supervision Bureau of the Autonomous Region.

Local, state and municipal foreign affairs offices are the centralized management departments for the examination and approval of local foreign-related hotels, and are jointly responsible for the examination and approval of foreign-related hotels in their respective jurisdictions in conjunction with local public security, national security, tourism and health supervision departments.

The responsibilities of the Foreign Affairs Office are: centralized management of hotels involved, examination and approval of the opening of foreign-related hotels in conjunction with various functional departments, and organization of joint inspection of hotels applying for foreign affairs. Understand and master the comprehensive situation of foreign-related hotels, and be responsible for submitting relevant opinions, suggestions and rewards and punishments to the government.

The responsibility of the public security department is to manage foreign-related hotels and restaurants according to foreign-related laws and regulations. Strengthen the management of temporary accommodation registration for overseas personnel (including foreigners, overseas Chinese, compatriots from Hong Kong, Macao and Taiwan), assist foreign-related hotels to establish rules and regulations, improve the accommodation registration system, and attach importance to the training and inspection guidance for household registration administrators. Establish a public security management system centered on accommodation registration, do a good job in security, timely discover and handle foreign-related matters (cases) according to law, and safeguard national sovereignty and social order.

The duties of the national security department are: according to the Detailed Rules for the Implementation of the National Security Law and other relevant laws and regulations, the national security organs have the right to know and master the relevant information of foreign-related hotels involving national security, examine whether the hotel site selection conforms to the national security regulations, consult or read relevant files, materials and articles, collect the accommodation list and relevant materials of foreign-related personnel, organize foreign-related hotels to establish a national security team, prevent and stop acts endangering national security, and conduct technical security inspections on the communication facilities of foreign-related hotels and the state secret communication in the surrounding environment.

The responsibility of the tourism department is to understand and master the hardware and software of foreign-related hotels, listen to the opinions of the joint inspection unit in the process of participating in foreign-related joint inspection, and lay the foundation for the tourism bureau of the autonomous region to carry out tourism fixed-point and star rating.

The duties of the health supervision department are: sanitary supervision and treatment of foreign-related hotels, annual and on-the-job infectious disease monitoring of employees in foreign-related hotels, infectious disease monitoring of foreign-related cases, infectious disease monitoring of foreigners, and supervision and inspection of imported food in foreign-related hotels. Article 3 In Urumqi, where it is necessary to apply for foreign-related hotels (including hotels and guest houses), the competent department shall apply to the Foreign Affairs Office of the Autonomous Region Government, and send a copy to the district and municipal public security, national security, tourism, health inspection and other departments, and the Foreign Affairs Office of the Autonomous Region Government shall jointly conduct joint inspections with the functional departments of public security, national security, tourism and health inspection. In the form of countersignature, the Foreign Affairs Office of the government of the autonomous region shall synthesize the opinions of various functional departments, report to the people's government of the autonomous region for approval, and be approved by the Foreign Affairs Office of the government of the autonomous region.

All localities, prefectures and cities outside Urumqi, where it is necessary to apply for foreign-related hotels (including hotels and guest houses), the competent department must apply to the foreign affairs office at or above the local level (including prefectures and cities), and send a copy to the public security, safety, tourism health inspection and other functional departments for joint inspection. The foreign affairs office shall, through countersignature, synthesize the opinions of various functional departments and report to the local government (administrative office) for approval. Article 4 The opening of hotels to the outside world is a serious work and a part of foreign-related work. Without joint inspection, all functional departments have no right to unilaterally approve the opening of the hotel. Article 5 After a hotel has obtained the foreign-related qualification, the tourism department may conduct the fixed-point and star rating of foreign-related tourism in accordance with the relevant provisions of the state. Article 6 After a hotel is involved in foreign affairs, it must accept the inspection and management of various functional departments and actively cooperate with them. In the process of inspection, all functional departments shall not exceed their duties or manage beyond their authority. Foreign Affairs Office, public security, national security, tourism, health supervision and other departments can send people to impart relevant knowledge. Article 7 In the course of operation, if a foreign-related hotel is found not to meet the foreign-related conditions, all functional departments have the right to suspend its foreign-related qualifications and deal with them according to regulations. For those who fail to persuade the reform, the foreign affairs office should respect the opinions of various functional departments and negotiate with them to cancel their foreign-related qualifications. Eighth functional departments should be based on the principle and purpose of serving the economic construction of our region, and shall not hold qualified hotels. In case of the above situation, the hotel has the right to report to the superior and be handled by the relevant departments. Article 9 After the promulgation of these Provisions, if there is any inconsistency with these Provisions in the specific examination and approval process, these Provisions shall prevail. Tenth these Provisions shall be interpreted by the Foreign Affairs Office of the autonomous region.
