Chapter I General Provisions Article 1 In order to strengthen the protection, management, rational development and utilization of Erhai Lake resources, and ensure the development of socialist industrial and agricultural production and the safety of people's lives, these Regulations are formulated in accordance with the Constitution of People's Republic of China (PRC), the Law of People's Republic of China (PRC) on Regional National Autonomy and other relevant laws, and in light of the actual situation in this region. Under the guidance of the overall planning of the Autonomous Prefecture, the plan for the protection, management and comprehensive development and utilization of Erhai Lake resources will be formulated to make it play a greater role in the construction of socialist material civilization and spiritual civilization. Article 4 Autonomous Prefecture People's governments shall set up institutions to implement unified management of Erhai Lake. State organs, military units, schools, factories, mines, enterprises and institutions, townships, towns, villages and social organizations around Erhai Lake, and people of all ethnic groups have the responsibility to protect Erhai Lake resources and ecological environment, and have the right to supervise, report and accuse acts that destroy Erhai Lake resources and ecological environment. Chapter II Protection and Governance Article 5 The organs of self-government of autonomous prefectures shall take measures to strengthen the protection and governance of the ecological environment, water resources, biological resources and natural landscape of Erhai Lake. Units and individuals responsible for the destruction of natural resources and water pollution in Erhai Lake are responsible for rectification. Article 6 In order to ensure the all-round development of industrial and agricultural production water, urban and rural domestic water, aquatic products, shipping, tourism and other undertakings in Erhai Lake area, and maintain a virtuous circle of the ecosystem in Erhai Lake, the water level in Erhai Lake must be strictly controlled. Article 8 The relevant counties, cities, townships, towns, villages and cooperatives shall seriously protect the forests in the main mountain ranges of Erhai Lake water source, and it is strictly forbidden to cut down trees indiscriminately, open up wasteland and engage in sideline business. Beware of forest fires; On barren hills and hills, we should be responsible for afforestation and greening according to the ownership of mountain forests to improve the vegetation coverage rate; Strengthen soil erosion control, enhance water conservation capacity and improve the marine environment. Ninth to restore and improve the natural landscape of Erhai Lake. The beach within five meters from the boundary pillar and fifteen meters from the boundary pillar is the forest belt around Erhai Lake, and the Erhai Management Bureau will make unified planning with the forestry and garden departments to speed up the construction. The relevant county, city, township and town governments will assign greening tasks to villages and cooperatives in batches, and take the form of voluntary tree planting, village management or direct distribution to farmers for greening and management. Water source forests and shelter forests of major rivers flowing into Erhai Lake are organized and managed by local forestry, water conservancy departments and township governments. Article 10 In order to prevent and reduce the siltation of Erhai Lake by quicksand, Dali City and Eryuan County shall control the rivers flowing into Erhai Lake respectively. The estuaries along the Erhai Lake shall be organized and managed by the Erhai Lake Administration in conjunction with the water conservancy departments of relevant counties and cities. Eleventh it is strictly prohibited to build, expand or rebuild factories, mines and enterprises that pollute the environment and destroy the ecological balance and natural landscape around Erhai Lake and near the water source. All newly-built, expanded and rebuilt construction projects and other water facilities must comply with the National Measures for the Administration of Environmental Protection of Construction Projects, and can only be constructed and used after they have passed the acceptance by the environmental protection department and met the requirements. The residual oil and waste oil from ships must be recovered and are not allowed to be discharged into the sea. The use of pesticides around Erhai Lake shall conform to the relevant national regulations and standards for the safe use of pesticides.
