2. If the amount is more than 200,000 yuan but less than 3 million yuan, it is classified as "huge amount". How to determine whether the crime of accepting bribes is constituted
1. Whether the amount of bribes accepted by the perpetrator reaches 5 thousand yuan. If the amount of bribes accepted reaches 5,000 yuan, it constitutes the crime of accepting bribes; if the amount of bribes accepted does not reach 5,000 yuan, the circumstances are relatively minor and should generally be regarded as a general illegal act, and administrative sanctions will be imposed by the unit or the superior authority as appropriate.
2. If a perpetrator takes advantage of his position to ask for property from others, whether or not to seek benefits for others, this can constitute the crime of accepting bribes. my country's Criminal Law stipulates that those who ask for bribes will be severely punished.
3. The crime of accepting bribes can only be constituted by illegally accepting property from others and at the same time acting to seek benefits for others. Whether the benefits sought for others are legitimate and whether the benefits sought for others are realized does not affect the establishment of the crime of bribery.
4. If a state employee violates state regulations and accepts various forms of kickbacks and handling fees for personal use in economic transactions, he shall be punished as a briber.
5. Under certain circumstances, relatives of state workers can become criminals for the crime of accepting bribes, regardless of whether the relative himself has the status of a state worker.
