Regulations of Guangdong Province on Rural Roads

Chapter I General Provisions Article 1 In order to strengthen the planning, construction, maintenance, management and operation of rural roads, promote the development of rural roads, and promote the implementation of the rural revitalization strategy, these Regulations are formulated in accordance with the Highway Law of People's Republic of China (PRC), the Regulations on Highway Safety Protection and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the planning, construction, maintenance, management, operation and related work of rural roads within the administrative area of this province. Article 3 The term "rural roads" as mentioned in these Regulations refers to county roads, township roads, village roads and their ancillary facilities that have been incorporated into the rural road planning and built in accordance with the technical standards of highway engineering, as well as roads that have been identified by the transportation department of the provincial people's government and included in the statistical annual mileage, including highway bridges, tunnels and ferries.

County roads refer to inter-county roads except national highways and provincial highways, and roads connecting the seat of county-level people's governments with the seat of township people's governments and the production and distribution centers of major commodities and agricultural products.

Township roads refer to township roads except county roads and highways above county roads, and roads connecting the seat of the township people's government with the established villages.

Village roads refer to roads between established villages and established villages, established villages and natural villages, established villages and the outside world, and natural villages and natural villages, except for township roads and highways above township roads, excluding tractor roads between village streets and farmland.

Ancillary facilities refer to facilities, equipment, special buildings, structures, etc. In order to protect rural roads and ensure their safety and smoothness, rural roads are provided with safety protection, drainage, maintenance, management, operation and service. Article 4 The development of rural roads shall follow the principles of government-led, graded responsibility, participation of all parties, overall planning, construction, management, maintenance and transportation, ensuring safety and smoothness and protecting the environment. Article 5 People's governments at or above the county level shall strengthen their leadership over rural highway work, incorporate rural highway development into the national economic and social development plan of their respective administrative areas, establish and improve the planning, construction, maintenance, management and operation system of rural highways, and establish an incentive and assessment mechanism to promote the sustainable development of rural highways within their respective administrative areas.

The people's governments at the county level shall be responsible for the rural highway work within their respective administrative areas, and incorporate the rural highway work into the government's work objectives, and organize and coordinate relevant departments to do a good job in rural highway work.

Township people's governments are responsible for the planning, construction, maintenance and daily management of township roads and village roads within their respective administrative areas, and ensure the labor force and other necessary working conditions that are compatible with the work tasks. Sixth people's governments at or above the county level shall be responsible for the construction, maintenance and management of rural roads within their respective administrative areas.

The relevant departments in charge of development and reform, public security, finance, natural resources, ecological environment, housing and urban construction, agriculture and rural areas of the people's governments at or above the county level shall, according to their respective functions and duties, do a good job in rural roads and strengthen information enjoyment. Article 7 The villagers' committee shall, under the guidance of the township people's government, assist in the construction and maintenance of township roads and village roads, incorporate the protection of village roads into the village rules and regulations, and enhance the villagers' awareness of loving, protecting and protecting roads. Eighth people's governments at or above the county level shall strengthen the rural highway planning, construction, maintenance, management and operation of capital investment, improve the efficiency of the use of financial funds.

The construction and maintenance of rural roads shall be based on public financial investment supplemented by multi-channel financing, and all sectors of society shall be encouraged to participate. Ninth transportation departments of the people's governments at or above the county level shall establish and improve the rural highway database in accordance with the requirements of unified standards, complete content, reasonable structure, accurate data and up-and-down connection. Chapter II Planning and Construction Article 10 The rural road planning shall be based on the national economic and social development planning and the comprehensive transportation system planning, so as to adapt to the optimization of the layout of villages and towns, the production parks of important agricultural products, the rural economic and social development and the safe and convenient travel of the masses, and build a rural road network with appropriate proportion, smooth connection, reasonable layout, safety and convenience, and meet the requirements of rural revitalization, disaster prevention and mitigation and national defense construction.

Rural highway planning should be linked with land spatial planning, environmental protection, ecology, forestry, water conservancy, tourism and greenway planning, and coordinated with national and provincial highway planning and other modes of transportation development planning. Article 11 The county road planning shall be compiled by the transportation department of the people's government at the county level in conjunction with the relevant departments of planning, development and reform at the same level. After being examined by the people's government at the county level, it shall be reported to the people's government at the prefecture level for approval, and the transportation department of the people's government at the prefecture level shall file with the transportation department of the people's government at the provincial level.

The planning of township roads and village roads shall be prepared by the transportation department of the people's government at the county level to assist the township people's government, submitted to the people's government at the county level for approval, and reported to the transportation department of the people's government at the next higher level for the record.

Township people's governments shall solicit the opinions of villagers' committees and villagers along the line when preparing village road planning.

The approved rural highway planning shall be announced and shall not be changed without authorization. If it is really necessary to change, the original organization shall propose a modification plan and submit it for approval and filing in accordance with the original procedures. Involving changes in village road planning, the opinions of villagers' committees and villagers along the line shall also be sought. Twelfth preparation of national economic and social development planning, land space planning. , involving the contents of rural highway planning, it shall solicit the opinions of the transportation departments of the people's governments at the same level.

Land and space planning and environmental protection planning should comprehensively consider the carrying capacity of resources and environment, make overall use of land and space resources, and coordinate the arrangement of rural highway construction land.
