What is the reason behind the cruise ship drifting in a typhoon for five days?

It was reported on July 24 that a few days ago, CCTV reporter learned from Shanghai Tourism Quality Supervision Institute that some tourists complained that a cruise ship in Shanghai insisted on setting out even though it knew there was a typhoon, and then temporarily changed its route and changed its previous trip to the island to a cruise ship, which made the tourists very dissatisfied.

This cruise ship Joy was originally scheduled to depart from Shanghai Wusongkou International Cruise Port at 4pm on July 1 Sunday for a five-day and four-night trip to sasebo. Some tourists said that before sailing, they only received a notice from the ship that they had to postpone their departure because of the weather, but they were not told that the typhoon would affect navigation.

Many tourists said that as early as June 30th, the Central Meteorological Observatory released the probability forecast map of Typhoon prapiroon in the next 96 hours. The cruise ship must have received the relevant notice of the typhoon in advance, but insisted on leaving Hong Kong without making a statement.

Tourist Mr. Gan: I know there is a typhoon, but I have to sail in the typhoon area. I didn't say there was a typhoon at 4 o'clock or anything. I just explained that the voyage was delayed because of the weather.

Tourist Mr. Zhang: If the cruise ship informed us before that the flight of this trip would be delayed due to the typhoon, I think it should be the cruise ship or the tourists to ask us whether to cancel this trip or change to the next one.

It is understood that many tourists have nausea, vomiting and can't rest normally because of the typhoon during the voyage. Tourists said that they received a notice from the ship around noon on July 2, and changed the port destination to Kagoshima, Japan due to the typhoon. But because the pilots could not go to sea, they failed to land on the island twice.

After the failure of landing on the island, the ship once again informed the cancellation of landing on the island and changed to sea cruise, which made some tourists who planned to land on the island even more dissatisfied.

Mr. Cheng: There are passengers in Shanghai, Zhejiang, Northeast China and Jiangxi. To tell you the truth, I really hope this cruise can land in Japan, but I spent five days at sea for nothing. If the ship does not land on the island, there are no expenses incurred in berthing, landing on the island, bus, etc. Should be returned to the passengers.

In the official statement of Joy's Novozhen company, the ship explained that it was unable to dock in Hong Kong twice, and at the same time, it bought an insurance for tourists, indicating that all tourists whose trips were affected by force majeure could get corresponding insurance compensation, but did not mention the port fee.

In this regard, lawyer Liu, a special expert of Shanghai Tourism Law Research Center, said that according to the relevant provisions of the Tourism Law of the People's Republic of China, if there are no corresponding expenses due to the change or cancellation of the destination port, these expenses are called refundable expenses, and the travel agency and the ship are obliged to return them to tourists.
