During the epidemic period, if the expenses of group travel may not be fully refunded, tourists and tour operators have the right to terminate the travel contract that cannot be continued due to force majeure. For tourists who propose to terminate the contract, if they join a tour group, the tour agency will refund the balance to the tourists after deducting the non-refundable fees paid to the ground agency or performance assistant. The outbreak of this epidemic has restricted traffic or tourism activities, which constitutes force majeure in contract law, thus affecting the performance of tourism service contracts between consumers (tourists) and tourism operators, and should be handled in accordance with the provisions of contract law and tourism law.

Due to the nationwide epidemic, the travel contract between the two parties cannot be fulfilled, which is a force majeure factor stipulated by law. According to the influence of force majeure, both parties may be exempted from liability in part or in whole. Therefore, whether it is all or part, it is necessary to verify the relevant situation in combination with the relevant provisions of the Tourism Law and consider whether the party providing the service has paid the necessary expenses for performing the contract. According to the relevant regulations, if the travel contract is terminated due to force majeure, the travel agency shall return the rest to the tourists after deducting the non-refundable fees paid to the local agency or the performance support personnel.

If tourism is affected by force majeure or unavoidable events after travel agencies and assistants have fulfilled their duty of reasonable care, it shall be handled according to the following circumstances:

(a) the contract can not continue to perform, travel agencies and tourists can terminate the contract. If the contract cannot be fully performed, the travel agency can change the contract within a reasonable range after explaining it to the tourists; If the tourists do not agree to the change, they may terminate the contract.

(2) If the contract is terminated, the package tour agency shall return the balance after deducting the non-refundable fees paid to the land agency or the performance assistance personnel to the tourists; If the contract is changed, the increased expenses shall be borne by the tourists, and the reduced expenses shall be returned to the tourists.
