The day before the tour, the tour group suddenly canceled the trip. What responsibility does the tour group need to bear in this case?

1, Article 63 of the Tourism Law stipulates that if a travel agency attracts tourists to travel in groups and cannot leave the group because it has not reached the agreed number, the group agency may terminate the contract. However, tourists should be notified at least 7 days in advance for domestic tourism and at least 30 days in advance for outbound tourism.

2. According to the provisions of this Law, if the travel agency terminates the travel contract and meets the above conditions, the travel agency may not be liable for compensation. However, from the perspective of tourism practice, although there are laws and regulations, it is very difficult for travel agencies to take no responsibility at all. Tourists will ask the travel agency to take responsibility on the grounds that it wastes time and generates transportation expenses.

This law does not rule out the agreement between tourists and travel agencies. If both parties still agree that the contract cannot be terminated after signing, otherwise they will be liable for breach of contract. With such an agreement, the travel agency will still make compensation according to the agreement.

4. If the travel agency's termination of the travel contract does not meet the above requirements, the travel agency shall bear the liability for breach of contract to the tourists, or pay the tourists the direct actual losses that have occurred. As for the indirect losses such as goods purchased by tourists specifically for tourism, travel agencies do not need to bear the liability for compensation.
