Enshi Tujia and Miao Autonomous Prefecture Mountain Protection Regulations
Chapter 1 General Provisions Article 1 In order to strengthen the protection of mountains in the urban planning areas of autonomous prefectures, protect the living environment, highlight the characteristics of mountainous cities, and promote the construction of ecological civilization, according to the "People's Revolution of the People's Republic of China and the National "Regional Ethnic Autonomy Law" and other relevant laws and regulations, and in light of the actual conditions of the autonomous prefecture, these regulations are formulated. Article 2 These Regulations shall apply to mountain protection within the urban planning areas of autonomous prefectures.
Mountain protection work in town planning areas, township planning areas, tourist attractions, etc. shall be carried out with reference to these regulations. Article 3 The mountains referred to in these Regulations refer to the mountains identified in the special plans for mountain protection in urban planning areas and statutory plans.
Mountain protection refers to activities that protect the geology, landforms, natural landscapes, cultural landscapes, etc. of the mountains listed in the previous paragraph to maintain their integrity.
Danxia landforms and mountains should be strictly protected. Article 4 Mountain protection shall follow the principles of scientific planning, protection priority, unified management, social participation, and sustainable utilization. Article 5 The people's governments of autonomous prefectures, counties and cities are the main body responsible for mountain protection work, and their main person in charge is the person responsible for mountain protection work within their respective jurisdictions.
The people's governments of autonomous prefectures, counties and cities should establish a joint meeting system, and the person in charge of urban construction management will hold regular meetings to study and solve major problems.
The urban and rural planning, forestry, and land and resources departments of the people's governments of autonomous prefectures, counties, and cities shall specifically perform mountain protection responsibilities. Other relevant departments shall perform mountain protection work in accordance with their respective responsibilities. Article 6 The people's governments of autonomous prefectures, counties and cities shall incorporate mountain protection work into national economic and social development plans, establish organizational leadership and coordination mechanisms, and ensure funding investment. Article 7: All units and individuals have the obligation to protect mountains and have the right to stop and report acts that damage mountains.
The people's governments of autonomous prefectures, counties and cities will commend and reward those who have made outstanding contributions to mountain protection work. Chapter 2 Mountain Protection Plan Article 8 The county and city people’s governments shall organize the preparation of special plans for mountain protection in urban planning areas in accordance with laws, regulations, technical specifications and the overall urban plan.
The special plan for mountain protection shall be reviewed and approved by the Standing Committee of the County and City People's Congress, and approved by the Autonomous Prefecture People's Government, and then reported to the Standing Committee of the Autonomous Prefecture People's Congress for the record.
The special plan for mountain protection in the urban planning area of ??Enshi City is jointly organized and compiled by the urban and rural planning department of the Autonomous Prefecture People's Government and the Enshi Municipal People's Government. Article 9 The special mountain protection plan shall clarify the scope of mountain protection. The mountain protection range is divided into core protection areas and general protection areas.
Core protected areas refer to mountain areas with obvious geological and landform characteristics, high ecological sensitivity, outstanding landscape features, historical relics or high protection value.
The Danxia landform and mountains are included in the core protection zone.
General protected areas refer to the mountain areas outside the core protected areas, which play a protective and buffering role for the core protected areas or have certain protective value. Article 10 The county and city people's governments shall, in accordance with the special mountain protection plan, organize the preparation of statutory mountain protection plans and submit them to the autonomous prefecture people's government for approval.
The legal map for mountain protection in the urban planning area of ??Enshi City is jointly compiled by the urban and rural planning department of the Autonomous Prefecture People's Government and the Enshi Municipal People's Government.
Statutory plans for mountain protection can be prepared and submitted for approval simultaneously with special mountain protection plans. Article 11 When the county or city people's governments organize the preparation of special plans and statutory plans for mountain protection, they shall extensively solicit opinions from experts and the public through demonstration meetings, hearings, etc. After the draft is formed, it shall be announced to the public for no less than thirty days. Article 12 The approved special plans and statutory plans for mountain protection shall be announced to the public by the county and city people's governments. Article 13: No unit or individual may change the special mountain protection plan and statutory plans approved in accordance with the law without authorization. Article 14 When revising the overall urban plan, a special demonstration of mountain protection should be conducted first, and the mountain protection plan should be included in the core content.
Other special plans and regulatory detailed plans involving mountain protection should be connected with the special mountain protection plan. Article 15 If the special plan for mountain protection conflicts with the overall urban plan, it shall be revised.
When revising the special mountain protection plan, the compilation agency shall propose a revision plan for the special mountain protection plan. The revision plan shall be reviewed and approved by the standing committee of the county or city people's congress, and submitted to the Autonomous Prefecture People's Government for approval, and then revised according to the planning preparation procedures. .
During the revision process, experts and relevant personnel who participated in the formulation and review of the original plan should participate. Article 16 If the statutory plan for mountain protection conflicts with the special mountain protection plan, it shall be revised.
When the statutory map for mountain protection is revised, the compilation agency shall propose a revision plan, publicize it and solicit opinions from relevant stakeholders. The revised statutory map for mountain protection shall be submitted to the Autonomous Prefecture People's Government for approval and take effect. Article 17 If the construction of major infrastructure projects or public welfare projects requires the entirety of a protected mountain to be occupied, the special mountain protection plan and statutory drawings shall be revised first; if the protected mountain is partially occupied, the statutory mountain protection drawing shall be revised first. Chapter 3 Protection and Management Article 18 Units and individuals within the scope of mountain protection shall protect and manage mountains in accordance with these regulations.
