Travel agency refund legal provisions
Legal analysis: If the travel agency cancels the contract within 7 days before departure, it should refund the full cost to the tourists and pay the liquidated damages. 7 to 4 days before departure, the penalty is 1% of the total travel expenses; 3 days to 1 day before departure is 15%; 2% on the day of departure. If the passenger cancels the contract 7 to 4 days before departure, the penalty is 5% of the total travel expenses; 6% from 3 days to 1 day before departure; 8% on the day of departure.
legal basis: article 588 of the civil code of the people's Republic of China stipulates both liquidated damages and deposit. if one party breaches the contract, the other party may choose to apply the terms of liquidated damages or deposit. If the deposit is not enough to make up for the losses caused by one party's breach of contract, the other party may request compensation for the losses exceeding the deposit amount.
