Article 1. In order to effectively protect and rationally develop and utilize the scenic resources of the Red River Gorge and strengthen the management of rafting tourism in the Red River Gorge, in accordance with the "Regional Ethnic Autonomy Law of the People's Republic of China" and other laws and regulations These regulations are formulated based on the actual conditions of the autonomous county. Article 2 The scope of management of these regulations: within 100 meters on both sides of the Red River Gorge Rafting Scenic Area (hereinafter referred to as the scenic area) and the double long lines, red double lines, and mahong lines leading to the scenic area.
Scenic spots include tourist areas and protective zones. The waters from Nantianmen Reservoir to Honghe Reservoir, the river course and the first ridge on both sides are tourist areas. Article 3 The tourism management department of the autonomous county people's government is responsible for the management and service of tourism business activities within the scope of these regulations.
Other relevant departments shall, in accordance with their respective responsibilities, jointly carry out management and service work within the scope of these regulations. Article 4 Any unit or individual that develops, constructs, or develops and operates tourism projects within the scope of these regulations must comply with the overall tourism development plan of the autonomous county.
Development and construction units and individuals should submit the design drawings and instructions of the development and construction project to the tourism management department of the autonomous county people's government for review. Review and approve. Article 5 The following activities are prohibited within the scope of these regulations:
(1) Quarrying and mining;
(2) Reclaiming wasteland, grazing, burying graves, and damaging landscapes and vegetation;
(3) Containing rivers and changing the course of rivers without approval;
(4) Discharging sewage and dumping waste at will, polluting the environment;
( 5) Setting up random stalls, hawking on the move, and obstructing traffic. Article 6 In addition to the provisions of Article 5, the following behaviors are also prohibited in tourist areas:
(1) Random graffiti, engraving, and posting;
(2) Open defecation and disorderly conduct Throwing garbage;
(3) Using chemical detergents when bathing;
(4) Moving or destroying public facilities;
(5) Blocking ships, forcing purchases and sales, and hindering the order of rafting operations. Article 7 Rafting tourism operating enterprises shall, in accordance with the "Regulations of the People's Republic of China on the Administration of Water Transport" and the "Regulations on the Administration of Water Tourism Transport of Liaoning Province" and other relevant requirements, obtain the approval of the water transport management agency, and obtain a water transport license and industrial and commercial license. You can only engage in water rafting activities after completing the registration procedures with the taxation and other departments. Article 8 Rafting tourism operating enterprises should charge according to the price regulations of the price department and implement clear price tags. Article 9 Rafting tourism operating enterprises shall promptly clean up garbage and dirt on the rafting river and both sides of the river, maintain environmental sanitation in the tourist area, and prevent water pollution. Article 10 Rafting tourism operating enterprises shall implement the relevant national rafting tourism safety management regulations and adopt the following safety measures:
(1) Establish and improve safety management rules and regulations, set up a special safety management agency or designate a dedicated person to be responsible for safety Management work;
(2) Regularly inspect rafting equipment to keep rafts in good condition and seaworthy;
(3) Equip life jackets, water guns, and water jets that meet safety requirements basins and other rafting equipment, and safety personnel will conduct safety inspections before use;
(4) Regularly check the safety of the river to ensure the smooth flow of the river;
(5) In case of possible danger Arrange rafting protection personnel in the area, and set up obvious prompts or warning signs;
(6) The elderly, children, pregnant women and those with mental illness, heart disease, high blood pressure, dementia, etc. are not suitable for participating in rafting activities , it is strictly prohibited to participate in rafting activities, and an announcement will be made in a prominent position;
(7) Apply for personal accident insurance for tourists in accordance with relevant national regulations. Article 11 Rafting tourism operating enterprises shall formulate accident handling plans and emergency rescue plans in accordance with relevant regulations and local specific conditions, and report them to the tourism management department and relevant departments of the autonomous county people's government for filing. Article 12 When a safety accident occurs in a tourist area, the rafting tourism business enterprise shall take effective measures to organize rescue and immediately report to the tourism management department of the autonomous county people's government and other relevant departments.
After receiving the accident report, the tourism management department of the autonomous county people's government shall immediately report the situation to the autonomous county people's government and the tourism management department of the superior people's government, and actively cooperate with relevant departments to organize accident investigation, treatment of the injured and Other aftermath work. Article 13 Rafting tourism operating enterprises shall cooperate with the relevant administrative departments of the autonomous county people's government in tree planting, greening, mountain closure, forest protection, fire prevention, and pest and disease prevention in tourist areas, so as to maintain a good ecological environment. Article 14 If the trees in the scenic area really need to be renewed or cultivated for logging, the consent of the tourism management department of the autonomous county people's government must be obtained and reported to the relevant departments for approval in accordance with the law. Article 15 Anyone who violates the provisions of these regulations shall be subject to the following penalties by the tourism management department of the autonomous county people's government or the relevant administrative department of the autonomous county people's government:
(1) Anyone who violates the provisions of Article 4 of these regulations shall be ordered to stop violating the law If the behavior causes damage to resources and cannot be restored to its original appearance, it shall be ordered to compensate for economic losses and fined not more than 30,000 yuan.
(2) Anyone who violates Article 5, Item (1) of these Regulations shall be ordered to stop mining, restore to the original state within a time limit, and impose a fine of not less than 3,000 yuan but not more than 5,000 yuan; if the person cannot restore the original state, he shall be fined A fine of more than 10,000 yuan and less than 30,000 yuan is imposed.
(3) Those who violate the provisions of Article 5 (2) and (3) of these Regulations shall be ordered to stop sabotage activities, restore the original appearance of the environment, compensate for economic losses, and impose a fine of not less than 200 yuan but not more than 1,000 yuan. fine.
(4) Anyone who violates the provisions of Article 5 (4) of these regulations shall be ordered to stop, clear the dirt within a time limit, and be fined not less than 300 yuan but not more than 5,000 yuan.
(5) Anyone who violates Article 5 (5) and Article 6 of these Regulations shall be ordered to stop sabotage activities, restore the original appearance of the environment, compensate for economic losses, and be fined not less than 100 yuan, but not more than 500 yuan. the following fines.
(6) Those who violate the provisions of Article 10 (1) of these Regulations shall be ordered to make corrections within a time limit; those who fail to make corrections within the time limit shall be ordered to cease operations.
(7) Anyone who violates items (2), (3), (4), (5), and (6) of Article 10 of these Regulations shall be ordered to make corrections within a time limit and be fined more than 2,000 yuan. A fine of not more than 5,000 yuan will be imposed; if the company fails to make corrections within the time limit, it will be ordered to stop operations.
(8) Anyone who violates Item (7) of Article 10 of these Regulations shall be ordered to make corrections within a time limit and be fined not less than RMB 5,000 but not more than RMB 20,000; if he fails to make corrections within the time limit, he shall be ordered to cease operations.
