Regulations on Forest Parks in Jiangxi Province (revised on 20 18)
The term "forest park" as mentioned in these Regulations refers to an area based on forest resources, with a certain scale and quality of forest landscape resources and environmental conditions, which can be used for people to visit, relax or carry out scientific, cultural and educational activities, and declared and approved in accordance with legal procedures. Article 3 The protection and management of forest parks belong to social welfare undertakings. The people's governments at or above the county level shall incorporate the construction of forest parks into the national economic and social development plan of the region, and provide necessary conditions and financial guarantee for the protection and management of forest parks. Article 4 The construction of forest parks shall maintain the integrity of forest scenic resources, adhere to the principles of strict protection, scientific management, overall planning, rational development and sustainable development, and promote the unification of ecological benefits, social benefits and economic benefits. The competent forestry department of the fifth provincial people's government is responsible for the supervision and management of forest parks in the province, and the specific work is the responsibility of the provincial forest park management institutions.
The competent forestry authorities of the people's governments at the city or county level with districts shall be responsible for the supervision and management of forest parks within their respective administrative areas.
The development and reform, finance, public security, transportation, tourism, land and resources, environmental protection, housing and urban and rural construction, quality and technical supervision, water conservancy, culture and other relevant departments of the people's governments at or above the county level shall be responsible for the relevant supervision and management of forest parks according to their respective functions and duties.
Forest park management agencies are responsible for the daily management activities of forest parks. Sixth units and individuals engaged in construction, management, sightseeing and other activities in the forest park have the obligation to protect the resources and environment in the forest park. Any unit or individual has the right to stop and report acts that damage the resources and environment of forest parks. Chapter II Compilation and Planning Article 7 The competent forestry department of the provincial people's government shall, according to the situation of forest resources in the province, formulate the development plan of forest parks in the province, solicit the opinions of relevant departments and the public, and report it to the provincial people's government for approval before implementation.
The competent forestry department of the people's government at the city or county level divided into districts may, according to the development plan of forest parks in the whole province and the forest resources in the administrative area, formulate the development plan of forest parks at the city or county level, and after soliciting the opinions of relevant departments and the public, report it to the people's government at the same level for approval and implementation.
The development planning of forest parks shall conform to the outline of national economic and social development planning, long-term forestry planning, overall land use planning and urban and rural planning, and be connected with tourism development planning, nature reserve development planning and other related planning. Article 8 The establishment of forest parks shall be conducive to the protection and rational utilization of forest scenic resources. The newly established forest park shall not overlap or cross with scenic spots and nature reserves. Where the established forest parks overlap or cross with scenic spots and nature reserves, the planning of forest parks shall be coordinated with the planning of scenic spots and nature reserves. Article 9 Forest parks are divided into national forest parks and provincial forest parks.
The establishment of national forest parks shall be carried out in accordance with the conditions and procedures prescribed by the state. Article 10 An application for the establishment of a provincial forest park shall meet the following conditions:
(a) in line with the province's forest park development plan;
(2) The forest park covers an area of not less than 400 hectares, but in urban areas and forest parks with special protection and development value, the area limit may be appropriately relaxed;
(3) The forest coverage rate is above 70%;
(four) the quality grade of forest park scenic resources has reached the national standard of forest scenic resources quality grade evaluation above two;
(5) The ownership of forests, trees and woodlands is clear and the boundaries are clear;
(six) there are corresponding forest park management institutions and technical and management personnel;
(seven) other conditions stipulated by laws, regulations and rules. Eleventh to apply for the establishment of a provincial forest park, an application report and the following materials shall be submitted:
(a) the feasibility study report and the outline of the overall planning of the forest park, as well as charts, images and other materials of important resources;
(2) Proof of ownership of forests, trees, woodlands and other land;
(3) Agreements signed with the owners and users of forests, trees, woodlands and other natural resources involved in the Forest Park and other land and property such as houses;
(four) the management organization, technology and management personnel of the forest park;
(five) written opinions of the Municipal People's government with districts;
(six) other materials as prescribed by laws, regulations and rules. Twelfth to establish a provincial forest park, it shall apply to the competent forestry department of the provincial people's government. The competent forestry department of the provincial people's government shall, within 20 days, jointly with the relevant departments of provincial development and reform, transportation, land and resources, environmental protection, housing and urban and rural construction, tourism, culture and other relevant departments to organize demonstrations and put forward examination opinions.
The establishment of provincial forest parks shall be approved and promulgated by the provincial people's government and reported to the national forestry authorities for the record.
