Regulations of Jilin Province on Tourism

Chapter I General Provisions Article 1 In order to actively develop, rationally utilize and effectively protect tourism resources, safeguard the legitimate rights and interests of tourists and tour operators, standardize the order of the tourism market, and promote the prosperity and development of the tourism industry, these Regulations are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this province. Article 2 The term "tourism resources" as mentioned in these Regulations refers to natural landscapes, cultural landscapes, folk customs and achievements in modernization that have the value of tourism development and utilization and can generate economic and social benefits.

The tourism industry as mentioned in these Regulations refers to a comprehensive industry that uses tourism resources and facilities to engage in tourism business activities or provide services for tourists. Article 3 All organizations and individuals engaged in tourism planning, development, operation, service, management and tourism activities within the administrative region of this province shall abide by these regulations. Article 4 The development of tourism should follow the principles of government guidance and market operation; Unified planning and rational development; The principle of strict protection and sustainable development, adhere to the unity of social benefits, economic benefits and environmental benefits, give full play to the advantages of resources and highlight local characteristics. Article 5 The people's governments at or above the county level shall incorporate the development of tourism into the national economic and social development plan, increase investment in tourism, strengthen the construction of tourism infrastructure, optimize the tourism environment, promote regional integration, and encourage and support the development of tourism. Article 6 The tourism administrative departments of the people's governments at or above the county level shall be responsible for the tourism management within their respective administrative areas.

Other relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in tourism management. Chapter II Tourism Development and Promotion Article 7 The tourism administrative department of the provincial people's government shall, jointly with the relevant departments of the province, formulate the tourism development plan of the whole province, which shall be submitted to the provincial people's government for approval and implementation after consulting the tourism administrative department of the State Council.

The tourism administrative department of the people's government of the city (state) or county (city, district) shall, according to the tourism development plan of the whole province, formulate a tourism development plan that conforms to the characteristics of the administrative region, and after soliciting the opinions of the tourism administrative department at the next higher level, it shall be approved and implemented by the local people's government.

The tourism development plans of provincial tourism economic development zones, provincial tourism resorts and key tourist areas shall be approved and implemented by the local people's government after soliciting the opinions of the provincial tourism administrative departments.

Tourism development planning should be based on national economic and social development planning, linked with relevant regional planning, and coordinated with professional planning. Article 8 The development of tourism resources and the construction of projects shall conform to the provisions of national laws and regulations, tourism development planning and construction of tourist areas, environmental impact assessment system and environmental protection. New construction, renovation and expansion of tourism projects and tourism facilities projects shall solicit the opinions of the tourism administrative departments at the same level. Ninth people's governments at or above the county level shall encourage and support the development of tourist souvenirs, native products, handicrafts and other tourist commodities and tourist attractions with local characteristics. Article 10 People's governments at or above the county level shall encourage and support ethnic autonomous areas and areas where ethnic minorities live in concentrated communities to develop ethnic tourism projects, develop tourist routes in ethnic areas and build ethnic tourism brands. Eleventh people's governments at or above the county level shall encourage foreign investors and various domestic economic organizations and individuals to invest and develop tourism resources and operate tourism according to law; Protect the legitimate rights and interests of tourism investors and operators according to law; Encourage all kinds of economic organizations and individuals in the province to set up travel agencies outside the province and abroad to operate tourism projects. Twelfth the right to operate state-owned tourism resources can be transferred to various economic organizations or individuals through public auction, bidding and other forms according to law. Thirteenth in our province, the local tourism market is fully open, and non-provincial travel agencies can organize tourism teams to come directly to our province for tourism activities. Article 14 People's governments at or above the county level shall support tourism propaganda and promote the development of tourism by using related professional meetings, trade fairs, cultural performances, sports events, scientific and technological exchanges and other activities. Fifteenth people's governments at or above the county level shall strengthen the construction of tourism informatization, develop tourism e-commerce, establish and improve tourism information networks, and provide tourism information services. Sixteenth tourism administrative departments organize and guide tourism education and tourism vocational training. Chapter III Tour Operators and Tourists Article 17 Units or individuals engaged in tourism business shall meet the business conditions stipulated by the state, register according to law and obtain a business license.

To engage in travel agency business, a travel agency business license shall be obtained according to law. Eighteenth tour operators' operational autonomy is protected by law, and no unit or individual may illegally interfere with or infringe upon it.

Tour operators have the right to refuse any inspection, fees and apportionment in violation of laws and regulations; Have the right to refuse the relevant departments to force sales or designate them to buy goods; Have the right to refuse tourists' requests that violate laws, regulations and social ethics; Have the right to ask tourists to bear the responsibility for breach of contract. Nineteenth tour operators engaged in tourism business activities shall abide by the following provisions:

(a) to carry out activities in accordance with the approved business scope;

(two) publicly inform the service items and charging standards, clearly mark the price, and charge a reasonable fee;

(three) to provide real information about tourism services, and not to publish false advertisements to deceive and mislead consumers;

(four) to provide tourism services in strict accordance with the agreed service items and service standards, and shall not change the service items or lower the service standards without authorization;

(five) to respect the right of tourists to choose their own goods and services, and not to force tourists to buy tourist goods and accept tourist services;

(six) respect the customs and habits of ethnic minority tourists, and shall not refuse to provide reasonable services for ethnic minority tourists without reason;

(seven) timely inform tourists of possible dangers in the process of traveling, and set up obvious warning signs in the underground landscape, waters and dangerous passages where dangers may occur in scenic spots (spots); In case of danger, effective protection and rescue measures should be taken and reported to the relevant departments in time.
