Regulations of Shandong Province on Tourism Management (revised in 2002)

Chapter 1 General Provisions? Article 1 In order to strengthen tourism management, rationally develop and protect tourism resources, establish a good tourism market order, safeguard the legitimate rights and interests of tourists and tour operators, and promote the development of tourism, these Regulations are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this province. ? Article 2 "Tourism" as mentioned in these Regulations refers to an industry that provides tourists with comprehensive services such as sightseeing, accommodation, catering, transportation, shopping, culture and entertainment by using tourism resources and facilities. ? Third tourism management departments, tourism operators and tourists within the administrative area of this province shall abide by these regulations. ? Article 4 The development of tourism should implement the principle of integrating social benefits, economic benefits and environmental benefits, actively create civilized tourist areas, use tourist attractions to carry out patriotic publicity and education, and give full play to the role of tourism in the construction of socialist material civilization and spiritual civilization. ? Article 5 People's governments at all levels shall incorporate tourism into the national economic and social development plan, increase tourism investment, strengthen the construction of tourism infrastructure, improve the tourism environment, and encourage and support the development of tourism. ? Article 6 The tourism administrative departments at all levels are the competent departments of tourism, and shall implement industry management of tourism within their respective administrative areas according to their statutory duties. ? Seventh planning, construction, industry and commerce, environmental protection, forestry, public security, transportation, culture, health, religion and other relevant departments shall perform their respective duties according to law, support and cooperate with the tourism administrative departments to do a good job in tourism management. ? Chapter II Management of Tourism Resources? Article 8 The tourism resources mentioned in these Regulations refer to the natural and cultural landscapes that can be developed and utilized for the development of tourism and can generate economic and social benefits. ? Ninth development of tourism resources adhere to the principle of combining utilization and protection, tourism administrative departments and relevant departments should take measures to do a good job in the utilization and protection of tourism resources.

No unit or individual may destroy tourism resources. ? Tenth tourism administrative departments shall, under the guidance of the national economic and social development plan, formulate the overall planning of tourism development and organize its implementation; Do a good job in planning the general survey of tourism resources and coordinate the development, utilization and protection of tourism resources.

The tourism administrative department shall solicit the opinions of the relevant departments when formulating the overall tourism development plan and the tourism resources development plan. ? Eleventh new construction, renovation and expansion of tourist attractions, should obtain the consent of the tourism administrative department, in accordance with the relevant provisions of the state and province for approval.

The relevant departments for examination and approval of new construction, renovation and expansion of tourist attractions, should be fully demonstrated, pay attention to reasonable layout, to avoid blind construction, redundant construction. Shall not destroy the natural landscape, cultural landscape and historical and cultural heritage.

It is forbidden to build tourist attractions that propagate feudal superstitions and are harmful to citizens' physical and mental health. ? Twelfth tourism administrative departments to implement macro guidance and inspection of resort tourism.

The newly-built national tourist resort is reported to the State Council by the provincial people's government for approval. Newly-built provincial tourist resorts shall be audited by the municipal people's government with districts and submitted to the provincial tourism administrative department for approval. ? Chapter III Tourism Management? Thirteenth units and individuals engaged in tourism business activities, must abide by the relevant laws, regulations and rules, abide by professional ethics, honesty and credit, fair competition, to provide quality services for tourists. ? Fourteenth tour operators should disclose their services, clearly mark the price according to the charging standards stipulated by the price department, and set the price fairly, and must not deceive or blackmail tourists. ? Fifteenth travel agency business license system.

To start a travel agency, an application shall be submitted to the tourism administration department in accordance with the prescribed procedures. After passing the examination and obtaining the "Travel Agency Business License", the business can be carried out only after obtaining the business license from the administrative department for industry and commerce.

Travel agencies shall operate in accordance with the business scope and quality standards approved by the travel agency business license and business license.

The travel agency business license shall not be transferred. ? Sixteenth travel agencies to implement the quality assurance system. The collection and management of travel agency quality deposit shall be implemented in accordance with the relevant provisions of the state and the province. ? Seventeenth engaged in tour guide business, must pass the national unified organization of the tour guide qualification examination, and obtain the "guide card" issued by the tourism administration department, before practicing.

Travel agencies shall not engage in tour guide business without qualification certificates. ? Eighteenth tour guides engaged in tour guide business, should show certificates, wear badges, provide services in strict accordance with the provisions of the responsibilities and standards, and shall not seek illegitimate income by taking advantage of their work. ? Nineteenth tourist hotels implement a star rating system. The evaluation of star-rated hotels shall be handled in accordance with the relevant provisions of the state.

Star hotels must provide services according to star standards.

Hotels that have not been rated as stars shall not use the title of stars for business activities. ? Chapter iv rights and obligations of tourists? Twentieth the legitimate rights and interests of tourists are protected by law, and no unit or individual may infringe upon them. ? Twenty-first tourists have the right to have their religious beliefs and national customs respected. ? Twenty-second tourists have the right to know the real situation of tourism services, and have the right to ask tour operators to truthfully provide the content, grade and cost of services.
