Paragraph 1 of Article 5 of the Law on the Administration of Exit and Entry of Citizens of People's Republic of China (PRC) stipulates: "China citizens may apply to the municipal or county public security organs where their registered permanent residence is located for private reasons, except in the circumstances specified in Article 8 of this Law." Article 8 of the law stipulates: "If one of the following circumstances occurs, it shall not be approved to leave the country: (1) the defendant in a criminal case and the criminal suspect recognized by the public security organ or the people's procuratorate or the people's court; (two), the people's court informed that there are unresolved civil cases can not leave the country; (3) Being sentenced to a penalty and serving a sentence; (four), is being reeducation through labor; (5) The relevant authorities in the State Council believe that leaving the country will endanger national security or cause great losses to national interests. " According to Article 38 of the Prison Law, "released prisoners enjoy equal rights with other citizens according to law." Therefore, released prisoners have the right to apply for passports to go abroad as long as they do not meet the conditions listed in Article 8 above and meet the legal requirements.
