Regulations of Sichuan Province on Tourism Management

Chapter I General Provisions Article 1 In order to protect and rationally develop and utilize tourism resources, standardize the tourism market, safeguard the legitimate rights and interests of tourists and tour operators, and promote the healthy development of tourism, these Regulations are formulated in accordance with relevant national laws and regulations and in light of the actual situation in Sichuan. Article 2 Anyone who engages in tourism management, tourism activities and tourism management within the administrative area of this province shall abide by these regulations.

Where laws and regulations provide otherwise, such provisions shall prevail. Article 3 "Tourism" as mentioned in these Regulations refers to an industry that attracts and receives tourists by using tourism resources and tourism service facilities, and provides tourists with comprehensive services such as transportation, sightseeing, accommodation, catering, shopping and entertainment. Article 4 The people's governments at or above the county level shall strengthen their leadership over tourism, incorporate the development of tourism into the national economic and social development plan, increase investment in tourism, improve the tourism environment and open up the tourism market. Article 5 The principle of "unified leadership and hierarchical management" shall be applied to the tourism industry.

The provincial tourism administrative department implements industry management for the province's tourism industry.

City (prefecture) and county tourism administrative departments shall implement industry management of tourism in their respective areas.

Planning, construction, industry and commerce, forestry, public security, transportation, price, trade, culture, health, environmental protection, religion and other administrative departments shall, in accordance with the provisions of laws and regulations, and in accordance with their respective division of responsibilities, cooperate with the tourism administrative departments to do a good job in tourism management. Chapter II Tourism Resources Article 6 The tourism resources mentioned in these Regulations refer to natural landscapes, cultural landscapes and folk customs that are attractive to tourists, can be used to develop tourism, and can generate economic and social benefits.

The people's governments at or above the county level shall conduct a general survey and evaluation of tourism resources within their respective jurisdictions, formulate tourism development plans, and organize their implementation.

Tourism development planning shall conform to the national land planning, the overall urban planning, the planning of scenic spots and the planning of cultural relics protection. Seventh encourage the community to raise funds for tourism development through multiple channels, and develop tourism resources and build tourism facilities in accordance with the planning requirements. Article 8 The construction of star-rated tourist hotels, provincial tourist resorts and large-scale artificial tourist attractions shall be submitted for approval in accordance with the relevant construction approval procedures after obtaining the consent of the provincial tourism administrative department.

It is forbidden to build landscapes that promote feudal superstitions and are harmful to people's physical and mental health. Article 9 All units and individuals have the obligation to protect tourism resources, and are not allowed to quarry, mine, dig sand, destroy forests for land reclamation or hunt. Build facilities that pollute the environment and destroy the landscape in the tourist area, or discharge pollutants beyond the standard in the scenic area. Chapter III Tourism Operators Article 10 Tourism operators mentioned in these Regulations refer to units and individuals that specialize in or mainly engage in tourism business and directly provide single or multiple services to tourists.

Tourism operators must operate in accordance with the law, compete fairly, be honest and trustworthy, and provide healthy, civilized and standardized services for tourists, and shall not raise fees or cut service items or lower service standards without authorization.

Tourism operators have the right to set reasonable prices of goods or services according to the national price policy; Have the right to refuse arbitrary charges, fines and various assessments. Eleventh tourism operators should be equipped with tourism safety measures, establish and improve the responsibility system for tourism safety.

Travel agencies shall handle travel accident insurance for tourists in accordance with state regulations. Twelfth tourists personal and property damage, tourism operators should take timely rescue measures, and report to the public security organs, tourism administrative departments or other relevant administrative departments within 24 hours. Thirteenth travel agencies engaged in international and domestic tourism business, must be in accordance with the provisions of the "Regulations on the Administration of Travel Agencies" in the State Council, for travel agency business license, pay quality deposit, and after industrial and commercial registration, can operate tourism business. Fourteenth travel agencies should carry out business activities in accordance with the approved business scope. Domestic travel agencies shall not engage in international tourism business; International travel agencies that have not obtained the qualification to engage in outbound tourism business of China citizens at their own expense shall not engage in outbound tourism business, and the public security department shall not go through the exit formalities for them. Fifteenth overseas travel agencies in our province to bid for tourism offices, should be approved by the provincial tourism administrative department for examination and approval after reporting to the national tourism administrative department for examination and approval. Sixteenth hotels, restaurants to apply for foreign-related tourism business, should pass the safety inspection, reported to the tourism administration department for approval. Seventeenth tourist hotels and restaurants in accordance with the provisions of the state to implement star rating and star review system. Hotels and restaurants that have not been rated as stars shall not use the relevant star titles and signs. Eighteenth star hotels, hotel managers, travel agency managers and tour guides shall obtain qualification certificates in accordance with state regulations before taking up their posts. Nineteenth tourism industry to implement fixed-point management. Qualified tourist business units or individuals such as scenic spots (spots), restaurants, accommodation, shops, transportation, entertainment, etc. may apply for fixed-point operation, and after examination and approval by the tourism administrative department, they may be granted fixed-point tourist signs before receiving the tourist team. The designated implementation measures shall be formulated by the provincial people's government.

Travel agencies are not allowed to arrange reception for tourist teams in non-designated units. Twentieth tourist cars (boats) are managed by the tourism administration department. Travel agencies are not allowed to rent non-designated cars (boats) to receive tourist teams.
