As mentioned above, at the present stage in China, overseas travel of China citizens refers to overseas travel organized by travel agencies. Therefore, Articles 12, 13, 14, 15 and 16 of the Measures for the Administration of Overseas Tourism of China Citizens set strict obligations on travel agencies that organize overseas tourism to ensure the normal order of overseas tourism. The obligations of travel agencies that organize overseas tours (hereinafter referred to as package tours) are as follows:

(1) Travel agencies should safeguard the legitimate rights and interests of tourists. To this end, the overseas travel service information provided by tour groups to tourists must be true and reliable, and no false propaganda is allowed. In addition, in order to prevent the tour group from attracting tourists at a price lower than the cost, the tour group must also fulfill the obligation that the starting price of the tour should not be lower than the cost price.

(two) travel agencies engaged in overseas tourism business, should sign a written travel contract with tourists, and stipulate the rights and obligations of both parties. The travel contract must also clearly stipulate the starting and ending time, itinerary, price, traffic standards and liability for breach of contract. What needs to be pointed out here is that China's "Contract Law" stipulates: "If laws and regulations stipulate that it should be in writing, it should be in writing." In overseas travel contracts, as mentioned above, the contract must be concluded in writing. Once the travel contract is signed, the travel agency shall provide services for tourists in accordance with the conditions stipulated in the travel contract. At the same time, the package travel agency should ensure that the services it provides meet the requirements of protecting the personal and property safety of tourists. In case of situations that may endanger the personal safety of tourists, it is necessary to make clear explanations and clear warnings to tourists, and take effective measures to prevent the occurrence of hazards.

(3) To organize tourists to travel abroad, they should choose a reputable travel agency (hereinafter referred to as an overseas reception agency) established in the destination country according to law and conclude a written contract with it before entrusting them to undertake the reception work. Because, according to the practice of travel agencies, domestic travel agencies generally attract and form tour groups, which are received by travel agencies in destination countries after leaving the country. Therefore, it is very important to choose overseas cooperative travel agencies. It is directly related to whether the tour group can successfully complete the overseas tour. It is a legal obligation for the travel agency to choose a reputable travel agency legally established in the destination country and sign a written agreement with it.

(four) the package tour agency shall arrange a tour leader to accompany the tour group. The so-called tour leader refers to a person who has passed the examination by the tourism administrative departments of provinces, autonomous regions and municipalities directly under the Central Government and obtained a tour guide certificate. Because after the travel team leaves the country, there are many inconveniences in language, customs, itinerary and related procedures. Therefore, the team leader is essential. In a sense, he is the organizer and commander of the tourism team. In order to facilitate tourists to identify tour leaders, Articles 10 and 14 of the Measures for the Administration of China Citizens' Traveling Abroad stipulate that tour leaders must wear tour guides and arrange sightseeing activities according to the agreed travel itinerary; In the process of leading tourists to travel and visit, they should make clear explanations and clear warnings to tourists about situations that may endanger their personal safety, and take effective measures according to the requirements of tour groups to prevent the occurrence of harm. Article 19 of the "Measures" stipulates that "when a tourism team encounters special difficulties and security problems abroad, the team leader must report to the group travel agency and the Chinese embassy in the host country in time". On the other hand, the tour group to which the tour leader belongs "should report to the tourism administration department and the public security department in time" after receiving the report from the tour leader. When a tourist stays abroad, the tour leader shall promptly report to his travel agency and China's embassy or consulate in the host country.

In view of the bad behavior of individual tour leaders, in order to protect the legitimate rights and interests of China tourists, Article 20 of the Measures for the Administration of Overseas Travel of China Citizens stipulates that tour leaders shall not collude with overseas reception agencies, tour guides and other operators who provide goods or services to tourists to deceive or coerce tourists to spend, and shall not ask overseas reception agencies, tour guides and other operators who provide goods or services to tourists for kickbacks, commissions or accept their property.

(5) Article 11 of the Measures for the Administration of Overseas Travel of China Citizens stipulates: "The tourism teams organized by tour groups shall enter and leave the country as a whole through ports open to the country." That is, under normal circumstances, in order to prevent detention or other emergencies, the tour group should leave the country as a whole and enter the country as a whole after completing the tour itinerary. However, if the tour group has determined that it is necessary to enter the country in groups before leaving the country, the package tour agency should file with the frontier inspection station at the entry and exit port or the provincial public security frontier department in advance, so that the tour group can enter the country smoothly. After leaving the country, if it is determined that the tour group needs to enter the country by delegation due to force majeure or other special reasons, the tour leader shall promptly notify the tour group, and the tour group shall immediately file with the relevant entry-exit frontier inspection station or the provincial public security frontier defense department.
