Hangzhou Xiaoshan Xianghu Tourist Resort Regulations

Article 1: In order to strengthen the protection, construction and management of Xiaoshan Xianghu Tourist Resort in Hangzhou (hereinafter referred to as Xianghu Resort), these regulations are formulated in accordance with relevant laws and regulations and in combination with the actual situation of this city. Article 2 These Regulations shall apply to the protection, construction and related management activities of Xianghu Resort.

The scope of Xianghu Resort is determined according to the legally approved planning scope of Xianghu Resort. Article 3 The protection, construction and management of the Xianghu Lake Resort shall adhere to the principles of scientific planning, priority in protection, rational utilization and emphasis on characteristics. Article 4 The Xiaoshan District People’s Government is responsible for the protection, construction and management of Xianghu Resort.

The Hangzhou Xiaoshan Xianghu Tourist Resort Management Committee (hereinafter referred to as the Resort Management Committee) is specifically responsible for the protection, construction and management of the Xianghu Resort and performs the following responsibilities:

(1) Participate in the preparation of the overall plan and regulatory detailed planning of the Xianghu Resort;

(2) Determine the industrial development direction of the Xianghu Resort;

(3) Formulate the Xianghu Resort in accordance with the law Various administrative measures in the resort and organize their implementation;

(4) Implement administrative penalties for illegal acts in accordance with the provisions of these regulations;

(5) Coordinate and cooperate with relevant supervisors The work of the branch offices and dispatched agencies of the department stationed in Xianghu Resort;

(6) Other duties granted by the Xiaoshan District People's Government in accordance with the law. Article 5 The relevant departments of tourism, public security, taxation, transportation, market supervision and management of the Xiaoshan District People’s Government, the municipal port and shipping management agency, and the town people’s government and sub-district offices in the Xianghu Resort Area shall perform their respective duties and establish information Let’s share the mechanism and work together to do a good job in the management of Xianghu Resort. Article 6 The Municipal People's Government shall establish a coordination mechanism for the protection, construction, and management of the Xianghu Resort to coordinate and resolve major issues in the protection, construction, and management of the Xianghu Resort. Xiaoshan District and Binjiang District should establish a regular communication and consultation working mechanism. Article 7 The resort management committee shall organize the formulation of tourism vacation service specifications, build an information service platform, monitor real-time tourism data, publish tourism service information, and disclose management regulations, management measures, service procedures and other information to facilitate public inquiries.

The resort management committee should establish a tourism complaint system, publish the complaint methods, and accept complaints from tourists. Article 8 The overall plan and regulatory detailed planning of the Xianghu Resort shall be organized and prepared by the municipal urban and rural planning department in conjunction with the Xiaoshan District People’s Government and the Resort Management Committee, and shall be submitted for approval in accordance with relevant regulations. The overall plan and regulatory detailed planning of Xianghu Resort are collectively referred to as the Xianghu Resort Plan.

The Xianghu Resort Plan approved in accordance with the law is the basis for the protection, construction and management of the Xianghu Resort, and all units and individuals should abide by it.

Modification of the Xianghu Resort Planning shall be carried out in accordance with the modification conditions and procedures stipulated in laws and regulations, and shall be approved in accordance with the original approval authority. Article 9 The preparation of the Xianghu Resort Plan shall comply with the following requirements:

(1) Comply with relevant laws and regulations;

(2) Comply with the Hangzhou City Master Plan, Hangzhou City The overall land use plan, Hangzhou ecological protection red lines, and Hangzhou environmental functional zoning requirements are consistent with relevant regional plans;

(3) Adhere to the priority of protection and rationally utilize drinking water sources and lake shoreline resources , to prevent environmental pollution;

(4) Adhere to land conservation and intensive development. Article 10 The overall planning of the Xianghu Resort shall determine the scope of the core protection area, construction control area and style coordination area, limit the land use intensity and construction scale, and coordinate the relationship between the protection and construction of the Xianghu Resort, urban and rural development, and residents’ lives.

The resort management committee shall set up boundary stakes at the boundaries of core protection areas and construction control areas in accordance with the approved overall plan of Xianghu Resort. Article 11 Except for the following projects, no other construction shall be carried out in the core protection zone:

(1) Cultural relic protection, cultural display, landscape maintenance, and environmental improvement projects;

(2) ) Flood control and drainage, dredging, hydraulic facility maintenance, hydrology and water quality monitoring facilities, meteorological monitoring facility projects;

(3) Waterways and port facilities, cross-lake (river) bridges and tunnels, water traffic safety Facility projects;

(4) Residential residential repairs;

(5) Roads and municipal infrastructure projects that meet the planning requirements of Xianghu Resort.

In the construction control area, the building floor area ratio and building density should be reasonably controlled to ensure the green space rate and rational development of resources.

The site selection, layout, height, volume, shape, style and color tone of construction projects in the construction control area and style coordination area should be coordinated with the landscape and environment of Xianghu Resort.

If there are already legal construction projects in Xianghu Resort that do not meet the requirements of the preceding paragraph, the Xiaoshan District People's Government shall organize and coordinate and supervise rectification. Article 12 Xianghu Resort shall, in accordance with the provisions of the national industrial structure adjustment guidance catalog, clarify the industrial policy orientation, and implement the relevant national and provincial industrial policies to determine the industry access standards for projects.

The development of the following industries is encouraged in Xianghu Resort:

(1) Tourism, exhibition, accommodation, and catering industries;

(2) Entertainment and leisure , health, and sports industries;

(3) Technology, finance, culture, performing arts, education, and film and television industries;

(4) Others that meet the planning requirements of Xianghu Resort industry.

Investment projects entering Xianghu Resort should comply with national and provincial industrial policies and Xianghu Resort planning requirements. The development of industries with backward technology, high resource consumption and serious pollution is prohibited in Xianghu Resort.

If there are existing industrial projects in Xianghu Resort that do not meet the requirements of the preceding paragraph, they shall be gradually relocated in accordance with the law.
