Legal analysis: If tourists are stranded abroad and fail to return, the tour leader should promptly report to the travel agency, the embassy and consulate of the People's Republic of China in that country, and relevant overseas agencies. After receiving the report, the travel agency should report it to the tourism administrative department and public security organs in a timely manner, and assist in providing information on illegal stayers. Article 16: Outbound tourists shall not illegally stay abroad, and tourists traveling in groups shall not leave the country without authorization. Join the group, get out of the group. Inbound tourists are not allowed to stay illegally in the country, and tourists who enter the country as part of a group are not allowed to split up or leave the group without authorization.

Article 99 If a travel agency fails to fulfill its reporting obligations stipulated in Article 55 of this Law, the tourism authority shall impose a fine of not less than RMB 5,000 but not more than RMB 50,000; if the circumstances are serious, it shall be ordered to suspend operations for rectification. Or the travel agency business license shall be revoked; the directly responsible person in charge and other directly responsible personnel shall be fined not less than 2,000 yuan but not more than 20,000 yuan, and the tour guide license shall be temporarily withheld or revoked.
