Tibet Autonomous Region Tourism Management Regulations
Chapter 1 General Provisions Article 1 In order to protect and rationally develop and utilize tourism resources, protect the legitimate rights and interests of tourists and tourism operators, maintain the order of the tourism market, and promote the healthy development of the tourism industry, in accordance with relevant laws and regulations , these regulations are formulated based on the actual conditions of Tibet. Article 2 All organizations and individuals that develop tourism resources, engage in tourism operations, conduct tourism activities, and implement tourism administration within the administrative area of ??the autonomous region shall abide by these Regulations. Article 3 The term "tourism industry" as mentioned in these Regulations refers to the industry that uses tourism resources and tourism service facilities to engage in tourism solicitation and reception, and provides tourists with transportation, sightseeing, accommodation, catering, shopping, culture, entertainment and other services. Article 4 The development of tourism should adhere to the principles of openness, invigoration, high quality and efficiency. Article 5: Expand the opening of the tourism industry to the outside world, encourage and support various economic sectors at home and abroad to invest in the development of tourism resources in various forms, engage in tourism operations, and enjoy preferential policies in accordance with relevant regulations of the state and autonomous regions. Article 6: Adhere to the principle of combining strict protection, rational development and sustainable utilization of tourism resources to achieve sustainable development of tourism. Article 7 The development of tourism shall highlight tourism with local and ethnic characteristics such as snow-capped mountains, grasslands, forests, lakes, rivers, wetlands, wild animals and plants, history and culture, folk customs and customs.
Actively explore and develop industrial, agricultural and other special tourism products, and promote the diversification and quality of tourism products. Article 8 People's governments at all levels and their tourism administrative departments shall encourage and support urban residents, farmers and herdsmen to engage in and participate in tourism operations, and provide them with high-quality services and preferential policies. Article 9 People's governments at all levels shall strengthen their leadership over the tourism industry, establish a coordinated and efficient service system between the tourism administrative department and relevant departments, and ensure the coordinated development of the tourism industry and related industries. Article 10 People's governments at all levels shall incorporate tourism into the national economic and social development plans, implement unified planning, ensure necessary capital investment, strengthen infrastructure construction, expand publicity and promotion, and fully realize the overall development of the tourism industry. Article 11 The tourism administrative department of the People's Government of the autonomous region shall be responsible for the planning, management and supervision of tourism in the entire region.
The tourism administrative departments of the municipal (prefecture) and county (city, district) people's governments are responsible for tourism planning, management and supervision within their respective administrative regions.
All relevant administrative departments in the autonomous region shall do a good job in the management and service of the tourism industry in accordance with their respective responsibilities. Article 12 The tourism administrative department of the autonomous region shall perform the following duties:
(1) Implement tourism laws, regulations, and industry standards, study and formulate long-term plans and annual plans for the development of tourism, and organize their implementation ;
(2) Strengthen the management of the tourism industry, work with relevant departments to cultivate and develop the tourism market, improve the management and service system, and give play to the self-discipline role of industry associations;
(3) Guide development , Utilize tourism resources, conduct grade assessments of tourist attractions (spots), and be responsible for organizing tourism publicity and major promotional activities in the region;
(4) Coordinate tourism transportation with relevant departments, coordinate and guide the production of tourism products Development of production, sales, tourism and entertainment;
(5) Conduct qualification accreditation of tourism employees and formulation of tourism service standards;
(6) Strengthen patriotism and legal education for tourism employees , professional ethics education and vocational skills training, to improve the quality of tourism services and the overall quality of tourism practitioners;
(7) Unify the organization and preparation of normative commentary on major cultural attractions, and revise them in a timely manner;
>(8) Supervise and inspect tourism safety and service quality, accept complaints from tourists, and safeguard the legitimate rights and interests of tourists. Chapter 2 Development and Protection of Tourism Resources Article 13 The tourism administrative departments at all levels shall, together with relevant departments, conduct a general survey and assessment of tourism resources, conduct scientific demonstrations, prepare a tourism development plan, and submit it to the higher-level tourism administrative department for review and approval. Implementation shall be organized upon approval by the people's government at the same level.
Tourism development planning should be coordinated with the overall land use planning, urban overall planning, ecological environment construction planning, nature reserve planning, scenic spot planning and cultural relics protection planning. Article 14 Projects such as the construction, reconstruction, and expansion of tourist attractions (spots) and tourism infrastructure shall comply with the tourism development plans and tourism resource development plans of the autonomous region, city (prefecture), county (city, district).
Relevant competent authorities shall seek the opinions of the tourism administrative authorities when examining and approving applications for tourism projects. Article 15 The development and construction of tourism projects using resources such as forests, waters, nature reserves, cultural relics and historical places of interest shall be implemented in accordance with the provisions of relevant laws and regulations on environmental protection, cultural relics protection, forest and nature protection, etc.
When developing and constructing tourism projects, the cultural relics and natural features of tourist attractions (spots) should be protected. Article 16 All units and individuals have the obligation to protect tourism resources and facilities. Without the approval of the people's government at or above the county level, quarrying, mining, sand dredging, land reclamation, hunting, and felling of trees are not allowed in tourist attractions (spots). If laws and regulations provide otherwise, such provisions shall prevail.
It is prohibited to discharge pollutants, dump garbage, and litter in tourist attractions (spots). Article 17 The tourism administrative department shall work with relevant departments to develop tourism routes and participate in tourism transportation planning and the standardized management of tourism transportation services.
