Do travel agencies have to purchase travel accident insurance for tourists?

According to my country's "Tourism Law", travel agencies are only obliged to remind tourists to take out personal accident insurance, but have no obligation to take out travel accident insurance for tourists. Because Article 61 of the Tourism Law only stipulates that travel agencies should remind tourists participating in group tours to take out personal accident insurance in accordance with regulations. Obviously, travel agencies can neither force tourists to buy travel accident insurance, nor are they obliged to buy accident insurance for tourists. Why do travel agencies remind tourists to take out accident insurance? Because according to the package travel contract, tourists who receive travel services provided by travel agencies must personally participate in the performance of the contract with their own bodies. In the performance of package travel contracts, due to the cross-regional nature of travel services and their susceptibility to external conditions, accidental injuries often occur, resulting in damage to tourists' personal rights and interests.

If the personal damage suffered by tourists is caused by reasons for which others are responsible, it can generally be compensated through the liability of others for damages; however, personal damage caused by objective reasons such as force majeure often cannot be compensated through the liability of others. To obtain relief from liability for damages, it is necessary to spread the risk through insurance. In recent years, with the increasing living standards of our people and the rapid development of the tourism industry, accidental injuries to tourists have occurred frequently during tourism activities, and the damage suffered by tourists may not be within the scope of liability of operators such as travel agencies. However, tourists often do not have personal accident insurance and thus suffer unnecessary losses. In view of the reality that Chinese tourists' awareness of personal accident insurance needs to be improved, the "Tourism Law" stipulates that travel agencies should prompt tourists to purchase personal accident insurance, with a view to helping tourists gradually establish insurance awareness.
