Regulations of Gannan Tibetan Autonomous Prefecture of Gansu Province on Tourism Management

Chapter I General Provisions Article 1 In order to strengthen tourism management, rationally develop and protect tourism resources, establish a good tourism market order, create a good environment for tourism development, safeguard the legitimate rights and interests of tourism operators and tourists, and promote the development of tourism in Gannan Tibetan Autonomous Prefecture (hereinafter referred to as the Autonomous Prefecture), these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of the Autonomous Prefecture. Article 2 Tourism administrative departments, tour operators and tourists within the administrative area of Autonomous Prefecture shall abide by these regulations. Article 3 Tourism shall be subject to industry management. The tourism administrative department of the Autonomous Prefecture People's Government shall be responsible for the tourism management of the Autonomous Prefecture; County (city) tourism administrative department is responsible for the tourism management within their respective administrative areas.

Autonomous Prefecture, county (city) planning, construction, industry and commerce, land and environmental protection, forestry, grassland, public security, transportation, ethnic and religious, culture, health, price and other departments in accordance with their respective responsibilities, with the tourism administrative departments to strengthen the management of tourism. Article 4 People's governments at all levels in Autonomous Prefecture should proceed from the reality of the resource advantages in ethnic areas, incorporate tourism into the national economic and social development plan, especially into the overall plan for the development of the western region, formulate preferential policies, take effective measures to guide and increase investment in tourism, strengthen the construction of tourism infrastructure, improve the tourism environment, and encourage and support the development of tourism. Article 5 Encourage the development of tourism projects with ethnic characteristics and support the research and development of ethnic tourism commodities. The development of tourism should adhere to the principle of developing various economic sectors, protect the legitimate rights and interests of investors according to law, and encourage domestic and foreign organizations and individuals to invest in the development of tourism resources, build tourism facilities and participate in various business activities. Chapter II Tourism Planning and Construction Article 6 The people's government of the Autonomous Prefecture shall formulate a general plan for the development of tourism, which shall be organized and implemented by the tourism administrative department in conjunction with relevant departments.

The people's government at the county level shall, according to the overall planning of tourism development in Autonomous Prefecture, formulate the development plan of this administrative region, which shall be jointly organized and implemented by the tourism administrative department of the county (city). Article 7 Tourism planning shall follow the following principles:

(a) to implement the national laws and regulations on the development and protection of tourism resources, and correctly handle the relationship between protection and utilization, long-term and short-term, whole and part;

(two) to maintain the original features of natural landscape and human landscape, highlight the local ethnic and folk characteristics, and maintain the natural ecological balance;

(3) The development scale, development degree, construction standards and quota indicators of tourist attractions should basically adapt to the local economic development level and leave room for long-term development;

(four) tourist attractions, scenic spots projects, should be fully demonstrated, scientific evaluation of scenic features and resource value, highlight the characteristics of scenic spots, to avoid blind and redundant construction. Eighth new construction, renovation and expansion of tourist attractions, should comply with the overall planning of tourism development in Autonomous Prefecture and local tourism resources development planning, with the consent of the tourism administrative department, in accordance with the relevant provisions of the examination and approval of the project. After the completion of the project, tourism and other relevant departments shall participate in the completion acceptance. Ninth tourism resources development should do a good job in project construction as planned. In the process of project construction, we should fully consider the supporting construction scheme of six elements: food, shelter, transportation, travel, shopping and entertainment, and take the design and production of tourism commodities with local ethnic characteristics as an important content to develop. Chapter III Development and Protection of Tourism Resources Article 10 The development of tourism resources must adhere to the principles of strict protection, unified planning, rational development and sustainable development.

The development of scenic spots must meet the requirements of scenic spot planning and cultural relics protection, and do a good job in protecting the environment and natural resources. Eleventh domestic and foreign organizations and individuals to invest in the development of tourism resources, the construction of tourism development zones, key tourist attractions and tourist facilities and engage in business activities, autonomous prefecture people's governments at all levels to give the following concessions and support:

(a) enterprises or other organizations and individuals that invest in the construction of tourism infrastructure in Autonomous Prefecture can use the land for 40 years. If it continues to be used after the expiration, it may apply for re-applying for land use procedures according to law. Its land use right, real estate and other facilities can be transferred, leased, mortgaged and inherited according to law within the term of use.

(2) If the newly-established tourism enterprises in Autonomous Prefecture invest less than 6.5438+0 million yuan, the land transfer fee is 654.38+00%, if the investment is more than 6.5438+0 million yuan but less than 5 million yuan, the land transfer fee is 20%, and if the investment is more than 5 million yuan, it is 30%. Where a legal person or natural person establishes a joint venture project with land pricing as the capital contribution condition, the price shall be determined at 60%-70% of the determined land price.

(three) enterprises that invest in the development and operation of tourist facilities in Autonomous Prefecture shall be exempted from enterprise income tax for three years from the profit-making year, and enterprise income tax shall be levied at half the current tax rate from the fourth to the fifth year. Twelfth autonomous prefecture people's government tourism leading institutions to coordinate and solve major problems in tourism work, and should arrange tourism development funds, included in the annual budget, increasing year by year, earmarked for tourism promotion, public welfare tourism project construction.

The people's government at the county level may arrange special funds for tourism development according to the needs of tourism development in the region.
