Regulations on the Administration of Lianhuashan Ecological Tourism Zone in Changchun

Article 1 In order to strengthen the ecological environment protection of Lianhuashan Eco-tourism Resort in Changchun (hereinafter referred to as the Resort), and promote and guarantee the construction and development of the Resort, these Regulations are formulated in accordance with the relevant provisions of laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the protection, development, construction and management of holiday resorts. Article 3 A holiday resort is a specific area established with the approval of the provincial people's government, focusing on the development of ecological leisure, tourism and related industries.

Planning scope of the resort: from the border of Changchun Economic and Technological Development Zone and Jiutai City in the north, to the border of Changchun Jingyue Economic Development Zone and Shuangyang District in the south, to Yangpu Street in the west and to Shitoukoumen Reservoir and Yinma River in the east, with a planned area of 4 17 square kilometers. Article 4 The construction and development of holiday resorts shall adhere to the principles of giving priority to protection, scientific planning, paying attention to characteristics and rational development, so as to ensure the sustainable utilization of ecological resources and realize the unity of economic, ecological and social benefits. Article 5 The Management Committee of Lianhuashan Eco-tourism Resort in Changchun (hereinafter referred to as the Resort Management Committee) is an agency of the Municipal People's Government, which implements unified leadership and management on the economic and social undertakings within its jurisdiction on behalf of the Municipal People's Government. Article 6 The resort management committee shall exercise the following functions and powers:

(a) according to the national laws, regulations and relevant provisions, formulate measures for the implementation of the resort;

(two) the preparation of the economic and social development plan of the resort, and organize the implementation after approval;

(three) according to the preparation of the overall planning of the resort, land use planning and ecological environment protection and other special plans, and organize the implementation after approval;

(four) responsible for the protection, development and management of ecological resources in the resort;

(five) according to the authority to approve and manage all kinds of investment projects entering the resort;

(six) according to the law to implement the expropriation of collective land in the resort and the expropriation of houses and other facilities on state-owned land, and exercise the functions of land consolidation and development and land reserve;

(seven) to be responsible for the financial management of the resort, and to exercise the first-class financial management right and independent treasury management right;

(eight) responsible for the construction and management of infrastructure and public facilities in the resort;

(nine) responsible for the economic and social management of agriculture, forestry, water conservancy, science and technology, education, culture, sports, health and so on in the resort area;

(ten) to coordinate and manage the work of institutions or branches in the resort;

(eleven) other functions and powers entrusted by the state and the provincial and municipal people's governments. Seventh resort management committee shall, according to the actual needs of the resort construction, set up functional departments in accordance with the principle of streamlining and high efficiency, and be responsible for the management of the resort. Article 8 Departments of land, planning, environmental protection, public security (traffic police), fire protection, taxation, industry and commerce may, according to the needs of their work, set up agencies or branches in the resort to exercise dual leadership and perform their respective duties according to law.

Finance, customs, entry-exit inspection and quarantine departments can set up business windows or branches in the resort. Article 9 No unit or individual may change or adjust the overall planning of the resort, land use planning, ecological environment protection and other special plans without authorization. If it is really necessary to change or adjust, it shall be reported to the resort management Committee for approval in accordance with legal procedures. Tenth construction projects in the resort area shall conform to the overall planning of the resort area and the ecological environment protection planning, and carry out environmental impact assessment according to law.

The project construction unit shall, according to the approved environmental impact assessment documents, prepare the ecological environment protection plan and report it to the resort management committee for the record. Eleventh new construction, renovation and expansion of buildings (structures) in the resort area shall go through the relevant examination and approval procedures according to law. Unauthorized construction, according to law; If it is determined by the competent department of urban and rural planning, the competent department of land or the township (town) people's government that it should be demolished, it shall be demolished according to law. Twelfth resort collective land expropriation, expropriation and expropriation of houses on state-owned land by the resort management committee in accordance with relevant laws and regulations.

After the announcement of land requisition is served or the announcement of expropriation and requisition is issued, no unit or individual may carry out the following acts within the scope of expropriation and requisition:

(a) change the use of land and housing;

(two) new construction, expansion and reconstruction of buildings (structures);

(three) new greenhouses, greenhouses;

(4) planting various plants;

(five) other acts of increasing compensation costs.

In violation of one of the provisions of the second paragraph of this article, no compensation will be given. Thirteenth Municipal People's Government shall give priority to the protection of the construction and development of holiday resorts.

If the collective land in the resort area is converted into state-owned land after being expropriated according to law, it shall be paid for transfer in accordance with the relevant laws and regulations.

In addition to the part paid in accordance with the regulations, the rest of the land transfer income will be returned for the social security of the land-expropriated personnel and the ecological environment protection, land consolidation and infrastructure construction of the resort. Fourteenth units or individuals that have obtained the land use right of the resort according to law shall start construction according to the land use and time limit agreed in the land use right transfer contract. If the construction fails to start within the time limit or fails to meet the requirements of development and construction, it shall be disposed of by the municipal land administrative department according to law.
