Provisions of Qingdao Municipality on the Administration of Water Tourism Passenger Transport

Article 1 In order to strengthen the management of water tourism passenger transport, maintain the order of water tourism passenger transport market, and protect the legitimate rights and interests of passengers and operators of water tourism passenger transport, these Provisions are formulated in accordance with the relevant provisions of the state and combined with the actual situation of this Municipality. Article 2 All units and individuals that use transport vessels to engage in business passenger transport activities such as sightseeing, leisure and entertainment in the seaworthy waters under the jurisdiction of this Municipality must abide by these Provisions. Article 3 The traffic administrative departments of cities and county-level cities (districts) shall be in charge of the management of water tourism passenger transport, and the shipping management institutions to which they belong shall be specifically responsible for the management of water tourism passenger transport.

All relevant departments shall, in accordance with their respective responsibilities, do a good job in the management of water tourism passenger transport. Article 4 The municipal traffic administrative department shall, jointly with relevant departments, prepare the development plan for water tourism passenger transport, and organize the implementation after the approval of the Municipal People's Government. The development planning of water tourism passenger transport should be coordinated with the professional planning of tourism development.

People's governments at all levels shall take measures to strengthen the construction of infrastructure such as water tourist passenger terminals, and encourage enterprises, institutions and other organizations to develop and construct water tourist passenger transport infrastructure in accordance with the water tourist passenger transport development plan. Article 5 The legitimate rights and interests of water tourism passenger transport operators are protected by law; Water tourism passenger transport operators shall operate according to law, abide by professional ethics, provide civilized and standardized services for passengers, and ensure operational safety and the legitimate rights and interests of passengers. Sixth engaged in water tourism passenger transport business, should obtain business qualifications according to law. It is strictly forbidden to operate without a license.

Existing individuals engaged in water tourism passenger transport business shall sign a management service contract with the water tourism passenger transport business unit. Seventh engaged in water tourism passenger transport business, shall meet the following conditions:

(1) Having a fixed office space and management personnel in this Municipality;

(2) Having a passenger ship meeting the requirements of the state and a corresponding ship certificate;

(3) The crew working on the ship must obtain corresponding valid certificates of competency;

(4) Having corresponding berthing docks and safety service facilities for passenger ships;

(5) Having liquidity suitable for the transportation business;

(six) other conditions stipulated by laws, regulations and rules. Eighth engaged in water tourism passenger business, go through the relevant formalities in accordance with the following provisions:

(1) Apply to the local shipping administration for a water transport license with the ship inspection and registration certificate and relevant supporting documents and materials;

(2) handle the formalities of industrial and commercial registration, tax registration and insurance with the relevant departments with the water transport license and relevant documents;

(3) Holding the above-mentioned documents to the shipping administration organ to obtain the ship's business transportation certificate and relevant bills. Article 9 Where a water tourist passenger transport operator suspends business, closes down, splits up, merges or changes the relevant registered items, it shall report to the local shipping administration and go through the relevant formalities with the relevant departments in accordance with the regulations.

Where the owner of a commercial transport ship changes, the original owner shall register the change with the maritime administrative agency in accordance with the relevant provisions, return the relevant operation license to the issuing authority and go through the formalities for stopping operation, and the new owner shall go through the operation formalities again. Article 10 It is strictly forbidden to forge, alter, fraudulently use, resell or transfer the transport license, ship business transport certificate and passenger transport bill without authorization. Eleventh water tourism passenger business units shall implement the responsibility system for safety, and sign a letter of responsibility for safety with the management organs and employees. Twelfth tourist passenger ships should be equipped with full-time (part-time) safety administrators to do a good job in safety service.

Water tourism passenger transport operators shall not operate in bad weather that affects operational safety. Thirteenth water tourism passenger transport operators must engage in business activities in accordance with the routes, regions, shifts and stops approved by the shipping administration department. Article 14 Water tourism passenger transport operators shall charge according to the fare approved by the competent price department, clearly mark the price, use the bills supervised by the tax authorities, and take the initiative to pay the tickets. Fifteenth prohibit the following acts:

(a) direct or disguised charges, arbitrary charges;

(two) bullying, hauling, or otherwise disturbing the order of water tourism passenger transport;

(three) extortion and making things difficult for passengers;

(4) Insulting or beating passengers;

(five) set up ticket outlets at will;

(six) overload, unreasonable refusal, beyond the navigation area or beyond the wind resistance rating of the ship;

(seven) ships that do not have the conditions for night navigation operate at night without authorization;

(eight) take the lost property of passengers as your own;

(nine) illegal shipment of flammable, explosive, toxic and harmful substances;

(ten) the use of passenger ships for illegal and criminal activities. Sixteenth tourist passenger ships shall comply with the following provisions when operating:

(a) the crew should wear clothes and signs as required;

(two) according to the provisions of life-saving, fire fighting, communication and other facilities;

(three) all kinds of valid documents must be complete and carried with the ship;

(4) Hang a unified operation sign;

(five) the crew and passengers of small yachts shall be equipped with and wear life jackets in accordance with the regulations;

(six) equipped with publicity, tour guide broadcasting facilities, to introduce tourist attractions and safety knowledge to passengers. Seventeenth water tourism passenger transport operators have the right to refuse people who may endanger personal and property safety to take a boat or carry dangerous goods and articles that pollute the environment on board. Eighteenth water tourism passenger transport operators must pay taxes and fees in accordance with the relevant provisions of the state.
