The tour is postponed due to weather reasons. Can travelers request not to go and have the travel fee refunded?

There are generally three situations that lead to contract changes or cancellations, namely:

The first type: After signing the travel contract, the tourist suddenly changes and is unable to participate or is unable to participate due to illness or other reasons. Therefore, the trip cannot be completed.

In this case, the tourist should notify the travel agency to cancel the contract as soon as possible and handle the cancellation of the tour in accordance with the contract. The travel agency should compensate the travel agency. The travel agency will use the compensation fees collected to pay the transportation department, accommodation hotel, and local reception agencies. and other termination fees from related companies. This kind of compensation varies according to the length of the termination of the contract. The earlier the notice is given, the less the compensation will be. Unless otherwise agreed, the general compensation standard is:

The time when the tourist notifies the contract of termination

Tourists compensate the travel agency's expenses

More than 7 days before departure

10% of the total tour fee

6 to 4 days before departure

p>

20% of the total tour fee

3 to 1 day before departure

50% of the total tour fee

The day before departure

80% of the total tour fee

When a tourist is unable to continue traveling due to illness during the trip, the travel agency shall, after deducting the expenses incurred by the tourist and the resulting losses, pay the remaining amount of the tour fee. The fee will be refunded, and the medical expenses will be borne by the tourists themselves (except for those covered by the insurance company). Tourists who leave the group on their own during the trip or do not participate in certain group activities will be deemed to have automatically given up, and the fees paid will not be refunded. If the tourist is unable to travel with the group due to the responsibility of the tourist, the loss caused shall be borne by the tourist himself.

Second type: The tour is canceled due to travel agency reasons.

According to the contract, when a tour is canceled due to the travel agency's reasons, the travel agency should notify the tourist 7 days before the scheduled departure date, or, with the written consent of the tourist, change the reservation to advance, postpone or join other travel agencies For groups with the same level of standard itinerary, the travel agency will not be liable for breach of contract damages to the tourists. If the tourist does not accept the change, the contract can be terminated, and the travel agency shall at the same time refund all the fees paid by the tourist without interest.

When the travel agency is unable to carry out the trip as stipulated in the contract due to its own reasons, and fails to notify the tourist in advance and take remedial measures, the tourist may not only ask the travel agency to refund all the tour fees paid, but also ask for compensation. . Unless otherwise agreed, the standard compensation standards under normal circumstances are as follows:

Time of termination of contract notified by travel agency

Liquidated damages to be compensated by travel agency

6~ before departure 4 days

20% of the comprehensive service fee

3 to 1 day before departure

50% of the comprehensive service fee

Before departure

80% of the comprehensive service fee for the day

The comprehensive service fee indicated in the above table is the group fee, which is deducted from city transportation fees, room fees, excess mileage fees, special ticket fees and Travel accident insurance premiums and other expenses after the travel agency collects the payment. If a travel agency cancels a tour for any reason, in addition to refunding all tour fees paid by passengers and one-time compensation, it must also pay liquidated damages for contract termination from relevant enterprises such as transportation departments, accommodation hotels, and local reception agencies.

Third type: The team is unable to travel or the contract is changed due to force majeure factors.

After the contract is signed, if there is a national policy price adjustment, the travel agency has the right to adjust the charges, but it must provide relevant documents to prove it. If a tourist refuses to pay the fee, the travel agency has the right to cancel his or her qualification to join the group and charge compensation for business losses as stipulated in the contract.

The team is unable to work due to factors such as natural disasters, climatic conditions, political situations, aviation, shipping and railway sectors, or due to newly promulgated relevant laws, regulations and general binding decisions and orders issued by government agencies. If the trip is successful, the travel agency is exempt from liability for compensation.

When the originally arranged itinerary is changed, delayed, detained or ended early due to force majeure or various unforeseen circumstances during the trip, the travel fee difference incurred will be borne by the travel agency based on the circumstances at the time. Have full discretion. Corresponding adjustments will be made to the itinerary, sightseeing items, food, accommodation, etc., and the resulting cost difference will be handled according to the method of "refunding more and not making up for less", that is, the overrun expenses will be borne by the travel agency. If the service level is reduced or the sightseeing items are reduced due to adjustments, The difference in actual costs will be refunded.
