Regulations of Hubei Province on Tourism Management
The term "tourism resources" as mentioned in these Regulations refers to the natural landscape, cultural landscape, folk customs and achievements in modernization that have the value of tourism development and utilization and can produce economic and social benefits. Article 3 These Regulations shall apply to the operation, management and tourism activities of tourism within the administrative area of this province. Article 4 The development of tourism should adhere to the principle of paying equal attention to socialist material civilization and spiritual civilization, and unifying social benefits, economic benefits and ecological benefits.
It is forbidden to engage in tourism business activities that are harmful to the physical and mental health of citizens. Article 5 The people's governments at or above the county level shall, according to local conditions, incorporate tourism into the national economic and social development plan, increase investment in tourism, and promote the development of tourism within their respective administrative areas.
People's governments at higher levels shall lead and help ethnic autonomous areas and economically poor areas to develop tourism. Article 6 The principle of "unified leadership and hierarchical management" shall be implemented in the tourism industry.
The tourism administrative departments at or above the county level (hereinafter referred to as the tourism administrative departments) shall, in accordance with the management authority, implement industry management of the tourism industry within their respective administrative areas.
Provincial tourism administrative departments are responsible for the supervision and management of tourism units and provincial tourism enterprises established by central units in the cities where the provincial people's governments are located. Article 7 Tourism operators may establish or join tourism industry associations according to law.
Tourism industry associations abide by laws and regulations, coordinate and guide members' tourism business activities in accordance with their articles of association, provide consultation, reflect suggestions on tourism development to tourism administrative departments, and safeguard the legitimate rights and interests of tourists and tour operators. Chapter II Development and Protection of Tourism Resources Article 8 Tourism administrative departments shall conduct a general survey and evaluation of tourism resources, make scientific argumentation and formulate tourism development plans.
Tourism development planning should be coordinated with the overall planning of land use, urban planning, ecological environment construction planning, scenic spots planning and cultural relics protection planning. The tourism administrative department that makes the plan shall report to the tourism administrative department at a higher level for examination and approval before organizing the implementation. Article 9 Encourage multi-channel financing to develop tourism. Encourage all economic sectors to invest in the development of tourism resources and the construction of tourism facilities, and implement the principle of "whoever invests, develops and benefits".
Foreign citizens and legal persons, overseas Chinese, China citizens among residents of the Hong Kong Special Administrative Region, compatriots from Macao and Taiwan Province Province who invest in the development of tourism resources and the construction of tourism facilities in this province shall enjoy preferential policies in accordance with the relevant provisions of the state and this province. Tenth in areas with rich and concentrated tourism resources and promising development prospects, in accordance with the relevant provisions of the state, tourist areas with local characteristics can be established and enjoy preferential policies in accordance with the relevant provisions of the state and this province.
The establishment of a national tourist resort shall be applied by the provincial tourism administrative department, approved by the provincial people's government and reported to the State Council for approval. The establishment of a provincial-level tourist resort shall be applied by the people's government of the city or autonomous prefecture where it is located, and the provincial tourism administrative department shall, jointly with relevant departments, put forward audit opinions and submit them to the provincial people's government for approval. Eleventh new construction, renovation and expansion of tourist attractions, should avoid duplication of construction. The relevant administrative departments with the power of examination and approval shall solicit the opinions of the tourism administrative departments when establishing the project. Twelfth tourist attractions, scenic spots management agencies should formulate detailed tourism development plans, approved by the tourism administrative department, and reported to the superior tourism administrative department for the record. Involving land, construction, transportation, forestry, cultural relics, religion, environmental protection and other matters, it shall comply with the provisions of relevant laws and regulations.
It is forbidden to carry out activities that damage tourism resources and destroy the ecological environment within the planning scope of tourist attractions and scenic spots. Chapter III Tourism Management Article 13 Tourism operators shall operate independently according to law. At the same time, enjoy the following rights in tourism business activities.
(a) refusing to check without legal documents;
(two) refusing to collect fees, fines and other penalties in violation of laws and regulations;
(three) refusing to provide free services and other forms of apportionment;
(four) other legal rights enjoyed in tourism business activities. Fourteenth tour operators in the tourism business activities, should operate according to law, adhere to the principle of fair competition, honesty and credit, and fulfill the following obligations:
(a) to carry out business training and professional ethics education for its employees;
(two) in accordance with the provisions of the timely and true reporting of tourism business statistics;
(three) in accordance with the tourism contract or agreement, fulfill the commitment to the service object, publicly indicate the price, and provide services consistent with the quality and price;
(four) to maintain the order of the tourism market, not to operate beyond the scope, not to give or accept kickbacks, and not to seek other illegitimate interests;
(five) other obligations that should be fulfilled in accordance with the law in the tourism business activities.
Tourism professionals shall perform the obligations in items 3, 4 and 5 of the first paragraph of this article in their tourism business activities.
